AN ORDINANCE OF THE CITY OF SANTA ANA
AUTHORIZING AN AMENDMENT TO THE CONTRACT
BETWEEN THE CITY COUNCIL OF THE CITY OF
SANTA ANA AND THE BOARD OF ADMINISTRATION
OF THE CALIFORNIA PUBLIC EMPLOYEES
RETIREMENT SYSTEM
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES
ORDAIN AS FOLLOWS:
SECTION 1: That an amendment to the contract between
the City Council of the City of Santa Ana and the Board of
Administration, California Public Employees Retirement
System is hereby authorized, a copy of said amendment being
attached hereto, marked "Exhibit A" and by such reference
made a part hereof as though herein set out in full.
SECTION 2: The Mayor of the City Council of the City of
Santa Ana is hereby authorized, empowered, and directed to
execute said amendment for and on behalf of said Agency.

tive July 1, 19#7, end witnessed November 2~'~/~,., end es amended effective

1960, September ~ 1963, April 1, 1964, February 1, 1965, .January 16, 1969,
November 1, 1970, June 1, 1974, December 16, 1976, December 1, 1978, October 1,
1981, and July 1, 198q, which provides ~o~ participation of Public A~ency in
amid System, Board and Public Agency hereby a~ree ss follows:
Paragraphs I through 12 are hereby stricken from said contract as executed
effective July 1, 1984, and hereby replaced by the following paragraphs
numbered 1 through 12 lnclusive;
All words and termY used herein which are defined in the Public Employ-
:~s' Retirement Law shall have the meaning se defined therein unless
herwlse apeciflcally provided, eNormal retlrement age* shall mean

Public Agency shall participate in the Public Employees* Retirement
System from and after July 1, 1947 makZn~ its employees as hereinafter
provided, members of said System subject to all provisions of the
Public Employees' Retirement Law except such ss apply only on election
of a contracting agency and are not provided for herein end to all
amendments to said Law hereafter enacted except those, ~hieh by express
provisions thereof, apply only on the election of · contrmcting agency.

The fraction of final compensation to be provided for each year of
credited prior and current service as a local miscellaneous member
shall be determined in accordance ~lth Section 21251.13 of said
Retirement Law (2S at ese 60 Full).
The fraction or final compensation to be provided for each year of
credited prior and current service for those local safety members
hired on or e~er October 1, 1981 ~all be determined in accordance
v~th Sectton 21252,6 of said Retirement Law (2~ at' age 55 Full),
The fraction of final compensation to be provided for each year of
credited prior end current service for those local safety members
hired prior to October 1, 1981 shall be determined in accordance with
Section 21252.01 of sa~d Retirement Law (2S st age 50 Full).
The follow~nf additions! provisions of the Public FJnployeea' Retire-
ment Law, which apply or~y upon election o~ a contracting agency,
shall appl~ to the Public Agency and its employeea~
s. Sections 21380-21387 (1959 Survivors 'Program) excluding Section
21382.~ (Increased 1959 Survivors benefits).
Sections 21263/21263.1 (Post-retirement survivor allowance).
e. Section 20930.3 (Hllttary service credit) as defined in Chapter
1#37, Statutes of 197q, for those local miscellaneous and those
local ~afety members hired prior to October 1, 1981.
d. Section 20#61.6 (Reduction of benefits), applied to ~ectlon
20930.3, Statutes of 197q (Hllitary service credit) for local
miscellaneous and local safety members hired on or after
October 1, 1981, and applleable to Section 21252.01 (from 2J ~
50 Full Formula to 2~ f 55 Full Formula) for those local safety
members hired on or after October 1, 198].
e. Section 2002#.2 (One-year final cnmpensation), for local fire
and local miscellaneous members only.
Public Agency, in accordance with section 207qO, Government Code,
ceased to be an 'emplpyers for purposes of Chapter 6 of the Public
Employees, Retirement La~ effective on December 16, 1976. Accumulated
contributions of Public Agency as of the aforementioned date shall be
fixed and determined as provided in Section 20759, Government Code,
and accumulated contributions aa of the aforementioned date and con-
tributions thereafter made shall be held by the Board es provided in
Section 20759, Government Code.

safety members of said Retirement System:

A reasonable amount, as fixed by the Boord~ payable in one

Contributions required of Public Agency and its employees shall be
subject to adjustment by Board on account of amendments to the Public
Employees~ Retirement Lac, and on account of the experience under the
~etirement System as determined by the periodic investigation end
valuation required by said Retirement Law.
Contributions required of Public J~ency and its e;ployees shall be
paid by Public Agency to the ~etirement System within thirty days
after the end of the period to ~hich said contributions refer or es
may be prescribed by Board regulation. If ~ore or leas than the cor-
rect amount of contributions lo paid for any period, proper adjustment
shall be made in connection trlth subsequent remittances, or adjust-
ments o~ account of errors in contributions required of any employee
may be made by direct cash payments beteeen the -.~ployee end the Board.
