NS- EJC:mb(35) 12/7/88 Rev. 2/6/89 2001 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING SECTIONS 2-600, 2-603, 2-604, AND 2-607; REPEALING SECTIONS 2-602, 2-605, 2-606, 2-608 AND 2-609; AND ADDING ARTICLE XV TO CHAPTER 13 OF THE SANTA ANA MUNICIPAL CODE RELATING TO THE SANTA ANA PUBLIC LIBRARY. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That section 2-600 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 2-600. Establishment. A public library is established in the City for its inhabitants and nonresident taxpayers. The public library shall provide free basic library services, subject always to such ordinances and resolutions as may be made bY the city council. Any person who violates any such ordinance or regulation may, in addition to any other penalty, be excluded from the privileges of the library. SECTION 2: That section 2-602 of the Santa Ana Municipal Code is hereby repealed. SECTION 3: That section 2-603 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 2-603. Library board. There is hereby established the library board of the City of Santa Ana, having such powers as set forth in this division. The library board shall consist of seven (7) members who shall be subject to appointment and removal and shall serve terms in accordance with section 901 of the Charter of the City of Santa Ana. SECTION 4: That section 2-604 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 2-604. Scope of authority. The library board shall have the following powers and duties: (~) It shall consider all matters that may be referred to it by the city council or the city manager, and 109 ORDINANCE NO. PAGE TWO NS- 2001 shall render its recommendation, in regard thereto as may be reque~ ring authorities; (2) It shall consider all matters reg~ usages and services of the librar strative matters; (3) On its own motion, make such stud plans and recommendations as it m~ (4) Consider the annual budget during preparation by the library direct( mendations with respect thereto t( and the city council; and (5) Solicit to the fullest extent post of other public and private agenc! the library programs of the city. SECTION 5: That section 2-605 of the Sa~ Code is hereby repealed. SECTION 6: That section 2-606 of the Sa~ Code is hereby repealed. SECTION 7: That section 2-607 of the Sa] Code is hereby amended to read as follows: Sec. 2-607. Meetings. The library board shall hold at 1~ meeting each month at such times and P by resolution. NS- 2D01 PAGE THREE ARTICLE XV. LIBRARY FUND Sec. 13-140. Creation of library fund. There is hereby created and established the "Library Fund." Sec. 13-141. Deposit of moneys. Amounts received from library fund raising activities, donations, and amounts derived from gifts, bequests and devises to the library shall be deposited in the library fund. Sec. 13-142. Expenditure of funds. Money in the library fund shall only be expended for library purposes. SECTION 11: That membership and terms of office of the library board as it exists on the date of adoption of this ordinance shall continue without interruption under this ordinance. SECTION 12: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sent- ence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconsti- tutional. SECTION 13: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ORDINANCE NO.
