NS-~025 DMF:mb(36) 4/6/89 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING DIVISION ELEVEN SECTIONS 2-660 AND 2-661 OF THE SANTA ANA MUNI- CIPAL CODE RELATING TO THE COMMUN- ITY CABLE CITIZENS BOARD. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Division 11 of Article IV of Chapter 2 of the Santa Ana Municipal Code is hereby amended to read as follows: DIVISION 11. CABLE TELEVISION ADVISORY BOARD Sec. 2-660. Establishment of cable television advisory board. There is hereby established the cable television advisory board of the City of Santa Ana, having such powers as set forth in this division. The cable television advisory board shall consist of seven (7) members who shall be subject to appointment and removal and shall serve terms in accordance with section 901 of the Charter of the City of Santa Ana. Sec.2-661. Scope of authority. The cable television advisory board shall have the following powers and duties: (1) It shall consider all matters that may be referred to it by the city council or the city manager, and shall render its recommendations, counsel and advice in regards thereto. (2) It shall conduct state of the art reviews as re- quired by any cable television franchise agreement and report its findings to the city council and city manager. (3) It shall conduct an annual review of the quality of service provided by any cable television fran- chisee and report its findings to the city council and city manager. (4) It shall hear and resolve controversies between complaining persons and any cable television fran- chisees which cannot be resolved between the com- plaining person and the franchisee. ORDINANCE NO. NS- PAGE TWO SECTION 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sent- ence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconsti- tutional. SECTION 3: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertain- ing shall continue in full force and effect.
