NS- 2043 REL:mb(7) 11/15/89 AN ORDINANCE OF THE CITY OF SANTA ANA ADDING SECTIONS 41-19, 41-374, 41-385, 41-386, 41-418, 41-431, 41-480, 41-494 AND 41-689 TO THE SANTA ANA MUNICIPAL CODE AND AMENDING SECTION 41-151, 41-366, 41-378, 41-395 AND 41-613.2 TO PROVIDE DEVELOPMENT STANDARDS FOR SERVICE STATIONS AND AUTO REPAIR GARAGES THE CITY COUNCIL OF T ORDAIN AS FOLLOWS: OF SANTA ANA DOES SECTION 1: That the by adding a section, reads'as follows: )al Code is amended which said section Sec. 41-1~ of motor vehicles, ~11 non-factory installed r repair. SECTION 3: That section 41-366 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-366. Operational standards in the C1 district. (a) All business activities in the C1 district shall be conducted and located within an enclosed build- ing, except as otherwise provided in section 41-194, and except that the following business activities, to the extent permitted under section 41-365 and section 41- 365.5, may be conducted outside an enclosed building: (1) Plant nurseries. 389 390 ORDINANCE NO. SECTION 4: That by adding a section, reads as follows: the Santa Ana Municipal Code is amended to be numbered 41-374, which said section Sec. 41-374. Standards for service stations in the C1 district. In addition to the provisions of this chapter, the following minimum standards apply to service stations and any accompanying uses: A five (5) foot landscaped yard shall be provided along all side and rear property lines not abutting streets and not occupied by a building. 2. Driveways on corner lots shall not be located closer than five (5) feet from the corner radius. Sites with more than one street frontage shall have no more than one driveway per street for access to and from the abutting streets. 4. Parallel parking shall not be permitted. 391 ORDINANCE NO. NS-2043 PAGE THREE SECTION 5: That section 41-378 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-378. Operational standards in the C2 district. (b) No sales shall be made directly from a building to persons on a public sidewalk, either through a window or similar opening or by means of a coin-operated device. (c) Service stations, auto repair, and auto body garages are subject to the following require- ments: 1. No outdoor overnight vehicle storage is permitted. 2. No auto repair or auto body activity within 300 feet of property zoned or used for residential purposes shall be conducted before 7:00 a.m. or after 7:00 p.m. on any day of the week. 392 ORDINANCE NO. NS- 2043 PAGE FOUR SECTION 6: That the Santa Ana Municipal Code is amended by adding a section, to be numbered 41-385, which said sec- tion reads as follows: Sec. 41-385. SECTION 8: That section 41-395 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-395. Uses permitted in the C-3 district. Ail uses permitted in the C-2 district pursuant to section 41-377 are likewise permitted in the C-3 district except that service stations and auto repair or auto body are prohibited. SECTION 9: That the Santa Ana Municipal Code is amended by adding a section, to be numbered 41-418, which said section reads as follows: ORDINANCE NO. NS- 2043 PAGE FIVE :393 Sec. 41-418. Service stations, auto repair and auto body in the C4 district. In addition to the provisions of this chapter for cc~amercial uses, service stations are subject to the requirements of 41-374, and auto repair or auto body are subject to the requirements of 41-385. SECTION 12: That by adding a section, reads as follows: the Santa Aha Municipal Code is amended to be numbered 41-494, which said section Sec. 41-494. Service stations, auto repair and auto body in the M2 district. In addition to the provisions of this chapter for commercial uses, service stations are subject to the requirements of 41-374, and auto repair or auto body are subject to the requirements of 41-385. SECTION 13: That section 41-613.2 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-613.2. Prohibition against use of required parking spaces for other purposes. 394 ORDINANCE NO. PAGE SIX NS- 2043 (a) No person shall use, or allow the use of, any parking space or area which is designed for the parking of vehicles, and which is necessary to provide a number of parking spaces in full or partial satisfaction of the off-street parking requirements of this chapter, for any purpose which prevents the use of such parking space or area for the parking of vehicles on a regular basis. (b) Notwithstanding subsection (a) of this section, required parking within a building for an auto repair use may be used for overnight storage for vehicles.
