NS- 2076 REL:mb(19) 6/6/90 AN ORDINANCE OF THE CITY OF SANTA ANA ADOPTING THE 1988 EDITION OF THE UNIFORM BUILDING CODE WITH AMENDMENTS. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That section 8-43 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 8-43. Adoption by reference. There is adopted by the city that certain code known as the Uniform Building Code, 1988 Edition, and the whole thereof, together with the appendices therein and the 1988 Edition of the Uniform Building Code Standards. The said code is adopted and incorporated as fully as if set forth at length herein as provided for in Section 419 of the Charter of the city. Any provision of this article amending the "Building Code" or "Uniform Building Code" shall be construed as amending the above- said code edition, including such provisions enacted prior to the adoption of the above-said code edition and not thereafter repealed. The above-said code edition, as thus amended, together with all other provisions of this article, shall be known as the Building Code of the City of Santa Ana. SECTION 2: That section 8-90 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 8-90. Board of Appeals (Section 204). Section 204 of the building code is deleted. SECTION 3: That section 8-90.1 of the Santa Ana Municipal Code is hereby repealed. SECTION 4: That section 8-95 of the Santa Ana Municipal Code is amended to read as follows: Sec. 8-95. Exempted work (Section 301(b)). Subsection (b) of Section 301 of the building code is amended by adding the following exception to item 2 therein: Exception: A permit shall be required for any fence required by section 8-20 of the Santa Ana Municipal Code, pertaining to fences required for swimming pools, ponds or other bodies of water. 67.") 68O ORDINANCE NO. NS-2076 PAGE TWO SECTION 5: That section 8-99 of the Santa Ana Municipal Code is amended to read as follows: Sec. 8-99. Fees (Section 304 and Table No. 3-A). Subsections (a), (b), (c), (e) and (f) of section 304 of the building code and Table No. 3-A of the building code are hereby deleted. SECTION 6: That section 8-100 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 8-100. Special inspectors (Section 306(b)). Section 306(b) of the Building Code is amended by adding the following: Special inspectors shall be approved by the building official. The building official shall require registration with the building department prior to approving an applicant. Each person applying for registration as a special inspector may be required to show competence by an examination. Applicants shall pay a registration fee as established by city council resolution. A registration card shall be issued to each such applicant that the building official qualifies. A renewal fee established by resolution of the city council for each classification shall be due and payable on January 1 of each year thereafter, at which time the special inspector may be subject to reexamination. The building official may revoke any special inspector's certificate of registration at any time for due cause by written notice. This notice shall set forth the time and place for a hearing before the building official, at which time and place evidence shall be submitted by the special inspector to show cause why his certificate of registration should not be revoked. Failure to appear at such hearing by the special inspector may result in immediate revocation of said special inspectors certificate of registration. Special inspectors qualification examinations are to be given only for the execution of the work described under Section 306(a) of the Uniform Building Code in the incorporated area of the City of Santa. Anao 681 ORDINANCE NO. NS-2076 PAGE THREE SECTION 7: That section 8-111 of the Santa Ana Municipal Code is hereby repealed. SECTION 8: That sections 8-151, 8-156 and 8-157 of the Santa Ana Municipal Code are hereby repealed. SECTION 9: That section 8-168 of the Santa Ana Municipal Code is hereby repealed. SECTION 10: That section 8-169 of the Santa Ana Municipal Code is amended to read as follows: Sec. 8-169. Re-roofing (Section 3210). Section 3210 is added to the Building Code, to read as follows: Sec. 3210. All re-roofing shall conform to the applicable provisions of Chapter 32 and Appendix Chapter 32 of this code. Roofing materials and methods of application shall comply with the Uniform Building Code Standards or shall follow the manufacturer's installation requirements if approved by the building official. Exception 1: Re-roofing of Group R, Division 3 and Group M occupancies may be done with untreated wood shingles and shakes conforming to Table 32-B-2 and Table 32-C if the original or existing roof covering consisted of untreated wood shingles or shakes. Exception 2: Notwithstanding the provisions of Section 104(b), once during any twelve-month period, any existing roof covering may be replaced with the same kind of covering if the replacement area does not exceed fifty (50) per cent of the gross roof area. SECTION 11: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 8-170, which said section reads as follows: Sec. 8-170. Minimum roof classes (Table No. 32-A). Table No. 32-A of the Building Code is amended in the following respects. (1) Wherever the symbol NR (Nonrated roof coverings) appears, it is replaced by the symbol C (Class C roofing). (2) Footnote 2 is deleted. .' 682 ORDINANCE NO. NS-2076 PAGE FOUR SECTION 12: That section 8-172 of the Santa Ana Municipal Code is hereby repealed. SECTION 13: That section 8-173 of the Santa Ana Municipal Code is hereby repealed. SECTION 14: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sent- ence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconsti- tutional. SECTION 15: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were cc~mitted prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity~of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertain- ing shall continue in full force and effect.
