NS- 2137 r AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ADDING DIVISION 25 TO ARTICLE III OF CHAPTER 41 OF THE SANTA ANA MUNICIPAL CODE TO ESTABLISH THE SP (SPECIFIC PLAN) DISTRICT, REZONING CERTAIN PROPERTY IN THE BRISTOL CORRIDOR TO THE SO DISTRICT AND THE Rl DISTRICT, ADOPTING SPECIFIC PLAN NO. 90-1 FOR THE BRISTOL CORRIDOR, AND ADOPTING SPECIFIC PLAN FOR STREET ALIGNMENT NO. 55 FOR BRISTOL STREET BETWEEN WARNER AVENUE AND SANTIAGO CREEK. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Article III of Chapter 41 of the Santa Ana Municipal Code is hereby amended by adding a division, to be numbered 25, which said division reads as follows: DIVISION 25. SP (SPECIFIC PLAN) Sec. 41-592. Applicability ot SP (specific Plan) division. The provisions of this division shall apply to all property within a district which has been designated as SP (Specific Development) and for which a specific plan has been adopted by ordinance. The provisions in such a specific plan shall control the use and development of property in the SP district to the same extent as if set forth in full in this division. The provisions of this chapter which apply to the use and development of property generally in the city shall apply to property in the SP district except to the extent otherwise provided in the applicable specific plan. Sec. 41-592.1. purpose of SP District. The purpose of the SP district is to provide for the orderly implementation of adopted specific plans. Sec. 41-592.2. Uses permitted in the SP District. No use of property is permitted in the SP District except those uses stated in the applicable specific plan to be 1 493 permitted uses or uses permitted subject to the issuance of a conditional use permit. No use of property which is required to have a conditional use permit by the applicable specific plan is permitted in the SP district in the absence of such conditional use permit. r- Seo. 41-592.3. Development standards in the SP district. The development of property in the SP district shall comply with all applicable development standards set forth in the applicable specific plan. Sec. 41-592.4. operational standards in the SP district. No activity shall be conducted in the SP district manner which violates any applicable provision of applicable specific plan. in a the SECTION 2: All those parcels of real property shown on Exhibit A, attached hereto and incorporated herein, as to be included in the SP (Specific Plan) district are hereby reclassified from their current zoning district designations to the SP (Specific Plan) district. All those parcels of real property shown on said Exhibit A as to be included in the R1 (Single-family Residence) district are hereby reclassified from their current zoning district designations to the Rl (Single-family Residence) district. Amended sectional District Maps numbers 1-5-10, 2-5-10, 11-5-10, 12-5-10, 13-5-10, 14-5-10, 23-5-10, and 24-5-10 showing the above described changes in use district designations are hereby approved. SECTION 3: That certain document entitled "Bristol Street Corridor Specific Plan, Administrative Draft, City of Santa Ana, February 19, 1991" is hereby approved and adopted as the specific plan for the area reclassified to the SP (Specific Plan) district pursuant to section 2 of this ordinance. The Clerk of the Council is hereby directed to certify to the adoption of said specific plan on the face thereof and to maintain the same in the records of her office. SECTION 4: That certain document entitled "Specific Plan for Street Alignment No. 55," a public record on file in the Public Works Agency of the city, is hereby approved and adopted as the specific plan for street alignment of Bristol Street between Warner Avenue on the south and santiago Creek on the north. SECTION 5: That section 41-701 of the Santa Ana Municipal Code is hereby amended to read as follows: 2 .........---'~--'-r- 495 Sec. 41-701. Bristol Street. On both sides, fifty (50) feet from construction center line, between Sunflower Avenue and Warner Avenue and between Santiago Creek and the Garden Grove Freeway. ~ SECTION 6: That section 41-701.5 of the Santa Ana Municipal Code is hereby repealed. SECTION 7: That section 41-733 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-733. specific plans for establishment, scope. street alignment; The following specific plans for street alignment are hereby established and reestablished with survey center lines and/or construction center lines and with right-of-way lines, between which lines no person shall erect, move in or structurally alter any building or structure; excepting however, nothing herein is intended to prohibit the construction or erection of a hedge, masonry wall or fence, provided said hedge, masonry wall or fence meets with the provisions of the district within which it is located and all other provisions of this Code. Parking spaces located in the area between a street and its future right-of-way line as established by a specific plan for street alignment shall not be included in the determination of whether the uses served by those parking spaces have sufficient parking spaces under the off-street parking requirements of this chapter. SECTION 8: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 41-749.2, which said section reads as follows: Sec. 41-749.2. specific plan for street Alignment No. 55. Bristol Street between Warner Avenue and santiago Creek. SECTION 9: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The city Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. 3 497 SECTION 10: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
