NS- 2160 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING THE SANTA ANA MUNICIPAL CODE BY ADDING AN ARTICLE ENTITLED CAMPING AND STORAGE OF PERSONAL PROPERTY TO CHAPTER 10 OF THE SANTA ANA MUNICIPAL CODE AND AMENDING SECTION 1-18.3 RELATING TO ENFORCEMENT AUTHORITY. city Council of the city of Santa Ana does ordain The as follows: ~ That the Santa Ana Municipal Code is hereby amended by adding an Article to Chapter 10, to be numbered Article VIII, which said Article reads as follows: ARTICLE VIII. CAMPING AND STORAGE OF PERSONAL PROPERTY Section 10-400. Purpose. The public streets and areas within the City of Santa Ana should be readily accessible and available to residents and the public at large. The use of these areas for camping purposes or storage of personal property interferes with the rights of others to use the areas for which they were intended. The purpose of this Article is to maintain public streets and areas within the City of Santa Ana in a clean and accessible condition. Section 10-401. Definitions. Unless the particular provisions or the context otherwise requires, the definitions contained in this section shall govern the construction, meaning and application of words and phrases used in this Article. (a) Camp means to pitch or occupy camp facilities; to live temporarily in a camp facility or outdoors; to use camp paraphernalia. (b) Cam_~p__facilities include, but are not limited to, tents, huts, or temporary shelters. (c) Camp paraphernalia includes, but is not limited to, tarpaulins, cots, beds, sleeping bags, hammocks or non-city designated cooking facilities and similar equipment. ORDINANCE NS-2160 Page 2 (d) Park means the same as defined in section 31-1 of this Code. (e) Store means to put aside or accumulate for use when needed, to put for safekeeping, to place or leave in a location. (f) Street means the same as defined in section 1-2 of this Code. seotion 10-402. Unlawful Camping. It shall be unlawful for any person to camp, occupy camp facilities or use camp paraphernalia in the following areas, except as otherwise provided: (a) any street; (b) any public parking lot or public area, unimproved. improved or seotion 10-403. Storage of Personal Property in Publio Plaoes. It shall be unlawful for any person to store personal property, including camp facilities and camp paraphernalia, in the following areas, except as otherwise provided by resolution of the City Council: (a) any park; (b) any street; (c) any public parking lot or public area, unimproved. improved or SECTION 2: That Section 1-18.3 of the Santa Ana Municipal Code is hereby amended to reads as follows: Bee. 1-18.3. Recreation, parks an4 Oommunity services authority to issue oitations. The director of recreation, parks and community services and park rangers employed within the department of recreation, parks, and community services have the duty to enforce the provisions of Chapter 31 and Article VIII of Chapter 10 of this Code where the director has maintenance responsibility, and are authorized to arrest persons without a warrant whenever they have reasonable cause to believe that the person to be arrested has committed a violation of said provisions in their presence. In any case in which a person is arrested pursuant to this section and the person arrested does not demand to be taken before a magistrate, said officer or employee making the arrest shall prepare a written notice to Ns-2160 Page 3 5 appear and release the person on his or her promise to appear as prescribed by Chapter 5 C, Title III, of Part 2 of the Penal Code of the State of California (commencing with Section 853.6). ~ If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The city Council of the city of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. ~ Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full. force and effect.
