AN ORDINANCE OF THE CITY OF SANTA ANA
AMENDING ORDINANCE NO. NS-2039 WHICH
APPROVED AND ADOPTED THE REDEVELOPMENT
PLAN FOR THE BRISTOL CORRIDOR REDEVELOP-
MENT PROJECT
WHEREAS, on December 4, 1989, the city Council of the City of
Santa Ana adopted Ordinance No. NS-2039, approving and adopting the
Redevelopment Plan for the Bristol Corridor Redevelopment Project
Area; and
WHEREAS, in an opinion dated January 29, 1993, the Court of
Appeal of the State of California, Fourth Appellate District,
Division Three, determined that the adoption of the Redevelopment
Plan for the Bristol Corridor Redevelopment Project Area was
defective for two reasons:

The City of Santa Ana and the Community Redevelopment
Agency of the city of Santa Ana failed to identify the
dwellings that are or are being provided for the dis-
placed residents in accord with section 33367, subdivi-
sion (d) (8) of the Health and Safety Code; and
The City of Santa Ana and the Community Redevelopment
Agency of the City of Santa Ana failed to show why non-
blighted property which will not be affected by the
widening of Bristol Street must be included in the
project area; and
WHEREAS, the City Council previously adopted Ordinance No. NS-
2202 in order to show why non-blighted non-Bristol property must be
included in the project area and identify the replacement dwellings
that are or are being provided the displaced residents, but such
showing and identification were again deemed inadequate by the
Superior Court of the County of Orange; and
WHEREAS, the Executive Director of the City's Community
Development Agency has caused a report to be prepared to show in
more detail why non-blighted non-Bristol property must be included
in the project area and identify the replacement dwellings that are
or are being provided the displaced residents; and
WHEREAS, the city Council, through its adoption of this
ordinance, desires to show why non-blighted non-Bristol property
must be included in the project area and identify the replacement
dwellings that are or are being provided the displaced residents,
in order that the Redevelopment Plan for the Bristol Corridor
Redevelopment Project Area may go forward, in accordance with the

opinions of the Court of Appeal and the Superior Court;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES
ORDAIN AS FOLLOWS:
SECTION 1: That certain "Report of the Executive Director of
the Community Development Agency to the city Council on the Bristol
Corridor Redevelopment Project," dated August 5, 1994 (the "Execu-
tive Director's Report"), submitted to the City Council for its
August 15 regular meeting, is hereby approved and adopted by the
City Council as its findings and conclusions with respect to the
matters set forth therein.
SECTION 2: That paragraph (i) of Section 3 of Ordinance No.
NS-2039 is amended to read as follows:
i) There are, or are being provided, within the Project Area
or within other areas not generally less desirable with regard to
public utilities and public and commercial facilities and at rents
or prices within the financial means of the families and persons
who might be displaced from the Project Area, decent, safe, and
sanitary dwellings equal in number to the number of and available
to such displaced families and persons and reasonably accessible to
their places of employment. This finding is based upon the facts
set forth in the Executive Director's Report.
SECTION 3: That paragraph (j) of Section 3 of Ordinance No.
NS-2039 is amended to read as follows:
j) Inclusion of any lands, buildings, or improvements which
are not detrimental to the public health, safety or welfare is
necessary for the effective redevelopment of the entire area of
which they are a part, and any such area is not included solely for
the purpose of obtaining the allocation of tax increment revenues
from such area pursuant to Section 33670 of the Community Redevel-
opment Law without other substantial justification for its
inclusion. This finding is based upon the facts set forth in the
Executive Director's Report.
SECTION 4: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity
of the remaining portions of this ordinance. The city Council of
the City of Santa Ana hereby declares that it would have adopted
this ordinance and each section, subsection, sentence, clause,
phrase or portion thereof irrespective of the fact that any one or
more sections, subsections, sentences, clauses, phrases, or
portions be declared invalid or unconstitutional.

Strip Halls: Due to continued problems resulting in poor maintenance and vacancies,
the Cit~ has attempted to address the bltshting influence of retail "strip malls."
Commercial development standards have been adopted and, with the inclusion in a
redevelopment project area, assistance will be available to monitor deterioration and
vacancy. Strip malls have been observed to age rapidly in Santa And. Inclusion in the
Plan is considered of utmost necessity in order to assure and facilitate long-term
maintenance, These storefronts offer potential relocation opportunities for businesses
displaced by the Bristol widening. Spaces could be master-leased by the Redevelopment
Agency and subleased to displaced businesses to mitigage loss of compensable business
good will. Leaving such properties out of the project area could put them at a
competitive disadvantage if they are not eligible for redevelopment assistance, while
