NS-2256 AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AND ADOPTING AN AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE SANTA ANA SOUTH MAIN STREET REDEVELOPMENT PROJECT WHEREAS, the city Council of the City of Santa Ana (the "City Council") adopted Ordinance No. NS-1639 on July 6, 1982, approving and adopting the Redevelopment Plan for the Santa Ana South Main Street Redevelopment Project Area (the "Redevelopment Plan" and the "Project Area"); and WHEREAS, the Santa Ana Redevelopment Commission ("Commis- sion''), performing functions of the Community Redevelopment Agency of the city of Santa Ana ("Agency") pursuant to Section 33202 of the California Health and Safety Code and Resolution No. 91-102 of this Council, has formulated, prepared and proposed an amendment to the Redevelopment Plan as set forth in Exhibit A, attached hereto (the "Amendment"); and WHEREAS, the Planning Commission of the City of Santa Ana made and submitted its Report and Recommendation on the proposed Amendment, finding that the Amendment conforms to the General Plan of the City, and recommending approval and adoption of the Amendment; and WHEREAS, the Commission submitted the proposed Amendment to the city Council, together with the Report to the City Council; an~ WHEREAS, after due notice, the City Council and the Commission held a joint public hearing on June 20, 1995, to consider the approval and adoption of the proposed Amendment; and WHEREAS, the City Council has considered and evaluated the Amendment, the Commission's Report to the City Council, the Report and Recommendation of the Planning Commission, the economic feasibility of the Amendment and the Environmental Impact Report prepared for the Amendment; has provided an opportunity for all persons to be heard and has received and considered all evidence and testimony presented for and against any and all aspects of the Amendment, including environmental impacts; and WHEREAS, after said joint public hearing the Commission has duly approved the Amendment and recommended that the Amendment be adopted by the city Council; and WHEREAS, all actions required by law have been taken by all appropriate public agencies; ORDINANCE NS-2256 Page 2 541 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: The purposes and intent of the city Council with respect to the Amendment and the Project Area were, and continue to be, the following: a. Elimination of physical blight. b. Creation of new employment opportunities. c. Encouragement patterns. d. Encouragement rehabilitation, of uniform and consistent land use of private commercial/industrial development and capital investment. Implementation of the General Plan. Encouragement of highest and best use of available land consistent with the General Plan. g. Improvement of traffic along the South Main Street corridor. Improvement of market potential through creation of a uniform commercial character. i. Increase availability of off-street parking. j. Development of vacant or under-utilized industrial land. k. Provision or replacement of public streets, alleys, parks, sidewalks, sewers, storm drains, traffic signals, lighting systems, and other public facilities and improvements as necessary. SECTION 2: It is hereby determined that the Amendment is necessary and desirable. SECTION 3: As approved and recommended by the Commission, the City Council hereby approves and adopts the Amendment. The Amendment will hereinafter be known as the "1995 Amendment to the Redevelopment Plan for the Santa Aha South Main Street Redevelopment Project Area." SECTION 4: The Amendment, as set forth in Exhibit A, is incorporated herein by reference and made a part hereof as if fully set forth at length herein. The Redevelopment Plan for the Redevelopment Project Area, as amended by the Amendment approved herein, is referred to hereinafter as the "Amended Redevelopment Plan." 2 O DZ A CZ S-X2S 543 Page 3 SECTION 5: The Redevelopment Plan for the Santa Ana South Main Street Redevelopment Project is hereby amended as set forth in the Amendment. SECTION 6: Any and all written and oral objections to the Amendment filed with and presented to the City Council before, during and after public hearing, including any submitted by affected property owners and taxing agencies, have been considered and evaluated by the City Council, and such written and oral objections are hereby overruled. SECTION 7: The Amended Redevelopment Plan is hereby approved, adopted and designated the official redevelopment plan for the Project Area. S~CTION 8: Based on substantial evidence in the record, including, but not limited to, the Commissions's Report to the city Council on the proposed Amendment, all documents referenced therein, and evidence and testimony received at the joint public hearing, the city Council hereby finds and determines that: Significant blight remains in the Project Area. This blight cannot be eliminated without the establishment of additional debt and the increase in the limitation on the number of dollars to be allocated to the Agency. be The Amended Redevelopment Plan will continue to redevelop the Project Area in conformity with the community Redevelopment Law and in the interests of the public peace, health, safety and welfare. The adoption ~nd carrying out of the Amended Redevelop- ment Plan is economically sound and feasible. The Amendment and the Amended Redevelopment Plan conform to the General Plan of the City, including the Housing Element, which substantially complies with the requirements of Article 10.6 (commencing with Section 65580) of Chapter 3 of Division 1 of Title 7 of the Government Code. fe The carrying out of the Amended Redevelopment Plan will continue to promote the public peace, health, safety and welfare of the City of Santa Aha, and will effectuate the purposes and policy of the Community Redevelopment Law. The condemnation of real property is necessary to the execution of the Amended Redevelopment Plan, and adequate provisions have been made for the payment for property to be acquired as provided by law. The Agency has a feasible method and plan for the 3 ORDiNaNCE NS-22S6 545 Page 4 relocation of families and persons who might be displaced, temporarily or permanently, from housing facilities in the Project Area. There are, or shall be provided, within the Project Area or within other areas not generally less desirable with regard to public utilities and public and co~nmercial facilities and at rents or prices within the financial means of the families and persons who might be displaced from the Project Area, decent, safe and sanitary dwellings equal in number to the number of and available to such displaced families and persons and reasonably accessible to their places of employment. Families and persons shall not be displaced prior to the adoption of a relocation plan pursuant to Sections 33411 and 33411.1 of the Community Redevelopment Law. Dwelling units housing persons and families of low or moderate income shall not be removed or destroyed prior to the adoption of a replacement housing plan pursuant to Sections 33334.5, 33413 and 33413.5 of the Community Redevelopment Law. The elimination of blight and the redevelopment of the Project Area could not reasonably be expected to be accomplished by private enterprise acting alone without the aid and assistance of the Agency. j. The project area continues to be predominantly urbanized. ke The time limitation and the limitation on the number of dollars to be allocated to the Agency that are contained in theAmendc~dRedevelopment Plan are reasonably related to the proposed projects to be implemented in the Project Area and to the ability of the Agency to eliminate blight within the Project Area. SECTION 9: The City Council is satisfied that permanent housing facilities will be available within three years from the time occupants of the Project Area are displaced and that pending the development of the facilities, there will be available to the displaced occupants adequate temporary housing facilities at rents comparable to those in the community at the time of their displace- ments. SECTION 10: The City Council determines that (a) the publicly owned buildings, facilities, structures, and other improvements set forth in Exhibit C of the Redevelopment Plan as amended by the kmendment (the "Improvements") are of benefit to the Santa Ana South Main Redevelopment Project area and to the immediate neighborhood of that area, (b) that no other reasonable means of financing the Improvements are available to the community, and (c) that the payment of funds for the acquisition of land or the cost 4 547 Page 5 of the Improvements will assist in the elimination of one or more blighting conditions inside the project area or provide housing for low- or moderate-income persons, and is consistent with the implementation plan adopted for the Santa Ana South Main Redevelopment Project pursuant to Section 33490 of the Community Redevelopment Law. SECTION 11: The Clerk of the Council is hereby directed to send a certified copy of this'ordinance to the Agency, whereupon the Agency is vested with the responsibility for carrying out the First Amendment and the Amended Redevelopment Plan. SECTION 12: Ordinance No. NS-1639, and all findings and statements contained therein, shall remain in full force and effect except to the extent changed by this amending ordinance. If the City of Santa Aaa General Plan is hereafter amended to permit other uses, then such other uses shall be permitted under this Redevelopment Plan subject to approval by the Agency. BRIDGE cONSTRUCTION IMPROVEMENTS Bridge construction improvements which include the following are needed in order to upgrade existing infrastructure and meet the anticipated needs resulting from projected growth. 1. Overcrossing and construction of four-lane bridge; AltOn Avenue at Newport Freeway. McGaw Overerossing 554 IV. STREET CONSTRUCTION/TRAFFIC CIRCULATION/SYSTEM IMPROVEMENTS Street construction, sidewalks, curbs and gutters, landscaping and median improvements, and traffic circulation system improvements including the following are needed in order to alleviate existing traffic delays, improve traffic flow, provide greater accessibility, for emergency vehicles, and eliminate safety hazards which currently exist. I. Streetscape Improvements: Tree Replacement, South Main, First Street to SR55 Street Light Upgrading, South Main, First Street to Warner Landscaped Median Construction, South Main, Various Locations Sidewalk and Curb Reconstruction, Various Locations 2. Street Widening, Construction, Railroad Grade Separation Freeway Interchange: Street Realignment, McFadden at S. Main Dyer at southbound and northbound SR55 Main Street, Warner to SR55 Grand at Warner MacAnhur, Main Street to SR55 Off-Rarap, MaeArthur southbound at SR55 Dyer, Hai!~a~y to Main Standard, Chesmut to First Wright and Lyon Ali~munent Freeway On/OffRamp; SR55 at Main and Sunflower 3. Intersection Signalization: St. ,Madrews a:n.d Grand Avenue St. Andrews and Lyon Main and Edinger Main and Warner Main and Dyer Edinger and Standard 1-405/SR-55 Congestion Relief project Traffic Management Center 555 V. RECREATION IMPROVEMENTS Improvements to City. parks including the following are needed for additional recreational opportunities throughout the Project Area and fund the upgrades required by the American Disabilities Act. Although the Project Areas include a relatively small percentage of residential land use, employees of the areas use nearby recreational facilities and the presence of this employment base rasults in the need for residential neighborhoods and requisite amenities in the vicinity.
