AN ORDINANCE OF THE CITY OF SANTA ANA
REPEALING SECTIONS 9-170 THROUGH 9-194
OF THE SANTA ANA MUNICIPAL CODE TO
REMOVE PROVISIONS PERTAINING TO
OVERTIME WORK
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
SECTION 1: Findings: The City Council of the City of Santa Ana hereby finds,
determines and declares as follows:
A. The City Council enacted Sections 9-170 through 9-194 of the Santa Aha
Municipal Code originally in 1952, to standardize overtime practices in the City of Santa
gala.
B. The City Council amended and/or deleted several of the sections of the
Santa Aha Municipal Code pertaining to overtime work in 1994.
C. That requirements for overtime are mandated by State and/or Federal law
which provide minimum requirements for the payment and/or computation of overtime.
D. That within the minimum requirements of Federal law, State law may
interpose lower minimum requirements for the payment and/or computation of overtime.
E. That Memorandums of Understanding between employee organizations
and the City may modify State overtime requirements that do not conflict with the
minimum requirements of Federal law.
F. That overtime work provisions of the Santa Ana Municipal Code (Sections
9-170 through 9-194) are unnecessary and subject to revision to conform with Federal and
State law and may be abridged by Memorandums of Understanding between the City and
employee organizations.

SECTION 2: That Article VII of Chapter 9 of the Santa Ana Municipal Code,
consisting of sections 9-170 through 9-194, are hereby repealed.
