NS-2428 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING THE HARBOR BOULEVARD SPECIFIC PLAN (SP-2) FOR THE AREA COVERING NORTH HARBOR BOULEVARD THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The City Council of the City of Santa Ana hereby finds, determines and declares as follows: The Harbor Boulevard Specific Plan was adopted by Ordinance No. NS- 2222 on June 20, 1994. The City Council has determined that it would be appropriate to amend the Harbor Boulevard Specific Plan to facilitate a project to construct a sanctuary and ancillary chumh facilities at 288 South Harbor, located in the area covered by this Specific Plan. The City Council has this date adopted a resolution certifijing and approving a negative declaration pursuant to Environmental Review No. 99-179, which incorporates this proposed amendment to the ordinance adopting the Harbor Street Specific Plan, known as Zoning Ordinance Amendment No. 00-02. The Planning Commission of the City of Santa Ana has by resolution, following a duly noticed public hearing held on Apdl 10, 2000, requested that the Council amend the ordinance adopting the Harbor Street Specific Plan by approving Zoning Ordinance Amendment No. 00-02. On May 1, 2000, the City Council held a duly noticed public hearing to permit and consider public testimony regarding this Zoning Ordinance Amendment No. 00-02. SECTION 2: As set forth in Exhibit A to this Ordinance, which is incorporated herein by this reference as though fully set forth, section 3.6.1 of the North Harbor Specific Plan is hereby amended to add to the list of permitted uses in the Specific Plan area: "10. Churches and accessory church buildings subject to the issuance of a conditional use permit pursuant to Article V, Chapter 41 of the Santa Ana Municipal Code." Ordinance No. NS-2428 Page t of 4 68 SECTION 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. SECTION 4: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed pdor to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
