AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA AMENDING SECTION 5-51 OF THE
SANTA ANA MUNICIPAL CODE RELATING TO DOG
LICENSE-FEE

THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
Section 1. The City Council of the City of Santa Ana hereby finds, determines
and declares as follows:
Currently, Section 5-51(a) of the Santa Ana Municipal Code states that a
dog license is valid for a period of one year from the date of purchase.
It is appropriate to empower the Director of Finance to provide for
the issuance of multi-year licenses, in an effort to reduce staff time
and associated costs with processing annual dog licenses.
Currently, Section 5-51(c) of the Santa Ana Municipal Code charges a
penalty assessment of ten dollars against all persons who fail to secure a
dog license within thirty days after the license is required.

An average of 25% of all dog licenses are paid late and require
collection efforts by the Director of Finance.

Due to fluctuating costs associated with collection efforts by the
Director of Finance, it is appropriate to set the penalty amount of
the fee by resolution of the City Council. Said fee shall be paid to
the Department of Finance.

It is also appropriate to empower the Director of Finance to
establish procedures for the collection of the penalty assessments.
Currently, Section 5-51(d) of the Santa Ana Municipal Code waives the
license fee for dogs kept in a duly licensed commercial kennel and for
seeing eye dogs trained to assist blind persons.
It is appropriate to amend Section 5-51(d) to include a waiver for
signal dogs and service dogs, in addition to seeing eye dogs, as
defined in Penal Code Section 365.5.
All provisions of the Santa Ana Municipal Code which are repeated herein
are repeated solely in order to comply with the provisions of section 418 of
Ordinance No. NS-2483

the Charter of the City of Santa Ana. Any such restatement of existing
provisions of the Code is not intended, nor shall it be interpreted, as
constituting a new action- or decision of the City Council, but rather such
provisions are repeated for tracking purposes only in conformance with
the Charter.
Section 2. Section 5-51 of the Santa Ana Municipal Code is hereby amended to
provide for the issuance of multi-year dog licenses and set the penalty fee for late payment by
resolution of the City Council. (new language underlined, deleted language in strikeout for

Sec. 5-51. Dog License-Fee.
(a) A license fee is levied on all dogs over the age of four (4) months (except as
otherwise hereinafter provided) owned, kept or harbored by, in the custody of,
or under the control of any person within the city. The amounts of fee for
neutered and unneutered dogs and exemptions therefrom, if any, shall be
established by resolution of the council. Each license fee shall be paid
......... , to the director of finance. The license shall be valid for a period a._~s

The Director of Finance may provide for the renewal of dog licenses by mail.
(b) Any person who imports or brings into the city any dog with the intent to
remain longer than one (1) month shall, within five (5) days after its arrival,
cause the same to be vaccinated and licensed as herein provided.
(c) A penalty assessment ~ shall be set by resolution of the
City Council from time to time and paid to the Department of Finance and
charged against all persons who fail to secure said license within thirty (30)
days after said license is required. Collection of said assessment shall be in
conformity with the procedures established by the Director of Finance that are
not inconsistent with the provisions of this chapter as may be necessary or
desirable to aid in the enforcement of the provision of this chapter.
(d)
Said license fee shall be deemed a debt due the city from the owner, and in
addition to the criminal penalties of this Code provided, such debt may be
collected in the name of the city as any other debt may be collected.
The foregoing license fee shall not apply to any dog while kept in a duly licensed
commercial kennel any .......
