RESOLUTION AUTHORIZING THE CITY OF SANTA ANA TO ENTER INT0
THREE YEAR LEA~ OF LAND FOR THE PURPOSE OF LAND DISPOSAL
OF SEWAGE AND THE MAKING OF A PAYMENT IN AJ~OUNT OF $3150.00
TO MAKE SAID LEASE POSSIBLE
WHEREAS, heretofore the necessity of providing the City of
Newport Beach use of the ocean outfall for disposal of sewage pro-
duced in the City was recognized and in order to do so, land dis-
posal of sewage from the inland Cities and Sanitary Districts would
become necessary during periods of peak flow; and
WHEREAS, after negotiations, an agreement was reached with
said City of Newport Beach covering the costs and other details of
the rental of facilities for the use of said City and agreements made
for the leasing of the necessary lands for land disposal of sewage;
NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ann
as contraeting Agent for said Cities and Sanitary Districts, be and
it is hereby authorized and directed to execute that certain lease
whereon WALTER R. GISLER, TON P. GISLER, HAROLD GISLER, EMMA G.
STOFFEL, DEI3~& G. HARPSTER, AGNES G. MARSHALL and LUCILLEG. ALLAIRE
are Lessors and the City of Santa aha is Lessee, dated January l,
1952 for a term of three years at an annual rental of $7,000.00 per
year covering that certain real property in the State of California,
County of Orange, and described as follows:
Beginning at a 2 x & post on the North line of Section Five,
Township Six South, Range Ten West, S.B.B. & N., ~0 chains
East of the Northwest corner of said Section Five; thence
East along said Section line 22.37 chains to a post and
board fence with barbed wire; thence along same the follow-
ing courses and distances; So~th 25~° ~est 6.07 chains;
South 23~° West 3.81 chains; South 48~° East 3.73 ~hains;
South 27-3/~° West 32.46 chains; thence leaving said fence
West 5.&3 chains; thence North 40 chains to beginning.
EXCEPTING THEREFROM the portion conveyed to Newbert Protec-
tion District by deed recorded September 23rd, 1910 in Book
lB1, page 253 of Deeds.
ALSO EXCEPTING THEREFROM the portion conveyed to the City
of Santa ann by deed recorded July l$th, 1926 in Book 661,
page 257 of Deeds.
BE IT FURTPJER RESOLVED: That the City of Santa Ann as con-
tracting Agent for said Cities and Sanitary Districts be and it is
hereby authorized and directed to pay for said Cities and Sanitary
Districts, the sum of $3150.00 to the ORANGE COUNTY PRODUCTION CREDIT
ASSOCIATION, 717 N. Main Street, Santa ~na, California, to apply on
the indebtedness due said Association by one CASEY BLUE for the pur-
pose of having that certain real property owned by the City of New-
port Beach bounded on the North by Hamilton Street, on the West by
Ward Street and on the East by the Santa kna ~iver. and containing
approximately 90 acres, released from the lien of a crop mortgage
so that the same may be made available to the present tenant under
land lease, Mr. IRVINE PHILLIPS, in exchange for his release of the
real property hereinabove described.
That the City of Santa Aha does hereby resolve and agree to
pay its proportionate share of the cost to be borne by the Ora~e
County Joint Outfall Sewer under the terms of the agreement covering
rental of the use of the ocean outfall to the City of Newport Beach
for the rent due under said lease and the payment of $3150.00 as
such proportionate share is determined in accordance with the agree-
ments and modifications thereto between said Cities and Sanitary
Districts of the Orange County Joint 0utfall Sewer.
BE IT FURTHER RESOLVED: That when Resolutions in substan-
tially the same words and figures as this Resolution have been
passed and adopted by the Cities of Anaheim, Fullerton and Orange
and the La Habra Sanitary District, Placentia Sanitary District,
Buena Park Sanitary District and Garden Grove Sanitary District, and
Santa Aha
certified copies of said Resolutions filed with the/City Clerk, the
Mayor and City Clerk are directed to execute the Lease hereinabove
referred to on behalf of the City of Santa ~na as contracting Agent
for the member Cities and Sanitary Districts comprising the Orange
County Joint Outfall Sewer.
