RESOLUTION DIRECTING TAX REFUND TO THE YOUNG MEN'S
CHRISTIAN ASSOCIATION OF SANTA ANA AND AUTHORIZING
THE COUNTY OF ORANGE TO WITHHOLD FROM CURRENT COL-
LECTIONS FOR REIMBURSEMENT
WR]~EAS, heretofore the Supreme Court of the State of
California in a decision cited as 35 Cal. (2d) 760, held that cer-
tain types of property held by a Y. M. C. A. were exempt from tax-
ation; and
WHEREAS, the Y. M. C. A. in Santa Ana paid their 1950-51 taxes
under protest to the County of Orange and the City of Santa Aha
under Assessment Number 5332, Book 3, Page 136; and
WHEREAS, all the issues in the case cited hereinabove were
applicable to the local situation and an application of the princi-
ples laid down in said decision entitled the Y. M. C. A. to a refund
of a large portion of said tax so paid; and
WHEREAS, the County of Orange has heretofore taken action to
refund those portions of said taxes improperly assessed, levied, and
collected and has requested that the City of Santa Ana authorize the
return of its portion of said tax;
NOW, THEREFORE, BE IT RESOLVED: That the County of Orange is
hereby authorized and directed to refund to the Young Men's Christian
Association of Santa Aha, a Corporation, the sum of $285.59 paid
under protest under said Assessment Number 5332 as aforesaid and the
County of Orange is hereby authorized to withhold from current collec-
tions due to the City of Santa Ana, the amount of $285.59 in reimburse-
ment for the amount so refunded.
PASSED AND ADOPTED by the City Council of the City of Santa Aha
at its regular meeting held on the 1st day of December, 1952.
