DEED
WHEREAS, heretofore, the City of Santa Ann acquired title to
certain real property hereinbelow described and thereafter reserved
a 12 foot easement in the deed conveying the same, which deed was
recorded September ll, 19~2 in Book ll~6, page 560, Miscellaneous
Records, County of Orange, State of California; and
W~I~.REAS, it was later found that said easement did not serve
the purpose for which it was originally intended because a like
easement had not been obtained by the City on all lots fronting
on said Street, and the utilities originally intended to be in-
stalled in said easement area have been placed in the street right
of way and there is, therefore, now no present or prospective use or
purpose for said easement so reserved;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ann hereby determines that the easement across the
property hereinbelow described has never been placed to any public
use, is unnecessary for present or future use by the City, and that
said easement should be quitclaimed to the record owners of said
property;
BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the
Council are hereby authorized and directed to execute a Quitclaim
deed to remise, release and forever quitclaim to the record owners,
all of the City's interest in or to that certain real property in
the City of Santa Ann, County of Orange, State of California de-
scribed as:
The South twelve feet (12') of Lots 35, 36, and 37 in
Block "B" of Tract No. 638 in the City of Santa Ann,
County of Orange, State of California, as per map
thereof recorded in Book 19, page 17 of Miscellaneous
Mapm in the office of the County Recorder of said County,
and to deliver the same in escrow that the unencumbered ownership
of said property may invest in the record owners thereof.
PASSED AND ADOPTED by the City Council of the City of Santa Ann
at its regular meeting held on the ~th day of
October , 1953.
