WHEItEAS, by reason of the rapid increase and concentration of population within the boundaries of Orange County Sanitation District U,~. 6 an~ the Midway City Sanitary District, and ~he cohdltion of the soil within said districts, cesspools and septic tanks are overflowing onto the surface of the ground and causing a serious existing and poten- tial hazard to the public heal,h, and WHEREAS, by reason of the foregoing conditions, said Districts have requested the consent of the Cities and Sanitary Districts of the Orange County Joint 0utfall Sewer to connec~ the sewage disposal sys- tems and lines of said districts to the trunk sewer lines and sewage disposal system and treatment plant of the Orange County Joint Outfall Sewer, and permission to discharge immediately into said trunk sewer Tines and disposal system of said Orange County Joint Outfall Sewer, all sewage arising within the boundaries of said districts, prior to the time authorized by the provisions of that certain agreement ~de and entered into by and between Orange County Sanitation Districts Nos. l, 2, 3, 5, 6, 7 and ll and the Cities and Sanitary Districts of the Orange County Joint 0utfall Sewer da~ed February 28, 1951, and entitled "Agreement of Sale and Purchase" and prior to the time auth- orized by the provisions of that certain agreement made and entered into by and between the Midway City Sanitary Distric~ and the Cities and Sanitary Districts. of the Orange County Join~ Outfall Sewer dated the 8-2-10. day of April , 1952, and WHEBLAS the Cities and Sanitary Districts of the Orange County Joint Outfall Sewer have been urged by the State and County Health Departments and Regional Water Pollution Control Board No. 8 of ~he State of California to permit Orange County Sanitation District No. 6 and Midway City Sanitary Distric~ ~o connect their sewage disposal systems to the Orange County Joint Outfall T~unk Sewer lines and dis- posal system and to discharge sewage therein, in order to eliminate said serious hazard to the public health, and WF~BEAS, by reason of the limited capacity available in the trunk sewer lines and sewage disposal system of the Orange County Joint Out- fall Sewer, it will be neeessary to construct 3300 feet of l~-inch steel pipeline to parallel the 42-inch portion of the line in Section l, and wHEP~EAS Orange County Sanitation District No. 6 has offered to enter into an agreement with the Cities and Sanitary Districts of the Orange County Joint 0utfall Sewer for the Joint construction of said additional line, upon the terms and conditions of that certain agreement submitted to and approved by the Executive Committee of the Joint Out- fall Sewer on January 7, 1954, a copy of which is on file in the -1- &dministrative Office of the Orange County Joint Outfall Sewer at Anaheim California, and a copy of which is on file in the office of the City ~Clerk ~ of the City of Santa A~a .... j and WHEREAS said agreement has been duly considered by the Joint £xecutive Committee of the Orange County Joint Outfall Sewer and said ~ommittee has recommended to each of the Cities and Sanitary Districts that said agreement be approved and entered into by the Cities and San- itary Districts of the Orange County Joint Outfall Sewer with said Orange County Sanitation District No. 6, upon the terms and conditions therein set forth, and that an agreement be made and entered into with the Midway City Sanitary District permitting said Sanitary District to connect its sewage disposal system and lines to the trunk sewer line and sewage disposal system and treatment plant of the Orange County Joint 0utfall Sewer and to discharge sewage therein, upon the terms and conditions of said agreement, a copy of which is on file in the Admin- Istr~tivo Office of the Orange County Joint Outfall Sewer, and a copy of which is on file in the of~ige of the ..C..it~ Clerk of the ~i.ty of. Santa Ana NOW, THEREFORE, BE IT RESOLVED by the City Council of the . Cit[ of Santa Ana that that certain agreement s~bmitted to the Joint Executive Committee of the Orange County Joint Outfall Sewer on the 7th day of January, 1954, to be entered into by and between said Sanitation District No. 6 and the Cities and Sanitary Districts of the Orange County Joint Outfall Sewer, a copy of which is on file in the Administrative Office of the Orange County Joint Outfall Sewer and in the office of the Cit~Clerk , of the Cit~of Santa Aha , be and the s~n~ is hereby approved, and that the Mayor and the .. Ci~ Clerk of the City of Santa Aha be and they are hereby authorized to execute said agreement for an on behalf of said City of Santa Aha , and that upon the final execution ~f said agreement bY all parties'thereto and the receipt of the money therein provided to be paid, said Orange County Sanitation District No. 6 be and it is hereby authorized to connect its sewage disposal system and lines to the trunk sewer lines and sewage disposal system and treat- ment plant of the Orange County Joint 0utfall Sewer and to discharge sewage therein in accordance with the terms, conditions and provisions of said agreement, and BE IT FURTHER RESOLVED that that certain agreement to be made and ontered into by and between the Midway City Sanitary District and the Cities and Sanitary Districts of the Orange County Joint Outfall Sewer, a copy of which is on file in the office of the Cit~Clerk . .. of the City of San%a Aha , be and the same is hereby approved, and ~at the ~yor ' and the Cit~Clerk of the City of Santa Ana be and they are hereby authorized to execute said agreement for and on behalf of the ~'f City of Santa A~m , and that upon the final execution said agreement by all the part'~es thereto and the receipt by the Orange County Joint Outfall Sewer of the money to be paid to it by Orange County Sanitation District No. 6, said Midway City Sanitary District be and it is hereby authorized to connect its sewage disposal system and lines to the trunk sewer lines and sewage disposal system and treatment plant of the Orange County Joint Outfall Sewer and to discharge sewage therein in accordance with the terms, conditions and provisions of said agreement. -2- day of THE FOREGOING RESOLUTION is signed and approved by me this 1st February . , 1954.
