?~U~ER~S, the ATCHISON, TOPEI~ A~ S~D~A FE RAILWAY C0~LOANY
has filed an Application dated March 4, 1954, seeking authority
from the City to construct, maintain and operate a spur track
connecting its lines with a new industry, across 'Jashington Street,
to facilitate the delivery of freight to said industry; and
~RF~AS, the Public %~orks Department of the City of Santa ~na
has examined said Application, plan and profiles and has found no
objection thereto;
N0~, ~EREFORE, BE IT RESOL~D: That the City Council of the
City of S~nta Ann does hereby approve the Application hereinabove
referred to and hereby grants and issues a Per~-~it to the ATCHISON,
TOPEI~A 'Y20 SAA~A FE RAI~Y C0tfPAL~Z_ for the construction,maintenance
and operation of a spur track across the City right of wsy on IVash-
ington Street in the City of Santa Ann, County of Orange, State of
California described as:
Beginning at a point in the northerly lino of ~;ashington
Street, distant thereon 28.2 f~et easterly of the easterly
line of Lincoln Street; thence southerly 60.0 feet on a 22,904.3-
foot radius curve, concave easterly, to a point in the southerly
line of ~!ashingto~ Street, distant thereon 8.8 feet easterly of
the easterly line of Lincoln Street,
under the authority and in compliance with the terms and conditions
of the City of Santa ann and under the following con-

ditions:
(a) That
said Permittee shall pay all charges resulting from
inspection of all construction work occasioned by t~e construction
of said spur track;
(b) Thst Permittee shall pay all expenses, costs of construc-
tion, maintenance and repair occasioned by the construction, main-
tenance, operation and necessary repair of said spur track, includ-
ing the cost of all street work involved in the construction of any
new approach made necassary by the construction of said spur track;

(c) That Permittee shsll have the ssme obligations in relation
to maintenance of the street right of way and paving at the said
crossing of ~sshington Street by said spur track as it has under
franchise for the crossing of its main line track On City streets at
grade;
(d) That Permittee will be bound by and will comply with~ the
provisions of Section 1304 of the Charter of t~e City of Santa Aha
pertaining to franchises and will be bound by all the provisions
thereof in the construction, operation, maintenance and repsir of
said spur track.
