HomeMy WebLinkAbout55-058~SOL~ON NO.55-58 RESOLUTION AUTHORIZING THE CONDE~TION OF CERTAIN HEAL PROPERTY FOR PUBLIC STREET PURPOSES TO W~DEN EAST FIRST STREET AND DECLAR- ING THE PUBLIC NECESSITY THEREFOR WEE~tS, East First Street as it now exists in the City of Santa California, is inadequate in width to accon~modate the present and future demands of traffic thereon and because thereof, is a present and continuing traffic hazard; NOW, THEREFORE, BE IT RESOLVED: That the Council of the City of Santa Aha does hereby find and determine that the public interest and necessity require that East First Street between Hathaway Street and the Easterly City Limits be widened and improved as shown on a map thereof on file in the office of the City Engineer and herein referred to for greater detail, to accommodate the present and future demands of traffic thereon and further require that said City do have, take and acquire an easement for said pu~ose in and to that parcel of land, described as: PARCEL l: The Northerly 17 feet of the following described property: Lot A of the Stafford and Tustin Tract, in the City of Santa Ana, County of Orange, State of California, as shown on a map thereof recorded in book 2, page 618, Miscellaneous Records of Los Angeles County, California; the Northwest corner of said Lot A being South 5© links and East 50 links of the exterior boundaries as established by said Stafford and Tustin Tract; excepting therefrom the Easterly 379.00 feet granted to the City of Santa Ana by deed as recorded in Book 1876, page 280, Records of Orange County, California; and further require that said City do have, take and acquire in fee simple for said purposes the entire parcel of land described as: PARCEL 2: Beginning at the Northeast corner of Lot "A" of "Menges and Crooks' Sub. of G. B. Lyon's Subdivision", in the City of Santa Ana, County of Orange, State of California, as shown on a m~p thereof recorded in Book l, page 98, Miscellaneous Maps, records of said Orange County; thence South 75 feet; thence West 130 feet; thence North 75 feet; thence East 130 feet to the point of beginning; EXCEPTING T~EREFROM that certain l0 foot strip off the Eastside con- veyed to the City of Santa Ana by deed recorded March 29, 1904, in book 103, page 243, Deeds, records of said Orange County; for the reason that the part taken to be used for said purposes would leave the re- mainder thereof in such size~ shape and condition as to require said City to pay compens~ion for the taking of such part which would be equal to the fair and reasonable value of the whole parcel and said Council hereby finds and declares that the entire p~rcel is necessary for the public use, benefit, safety, economy and general welfare. BE IT FURTHER EESOLVED: That Resolution No. 55-28 is hereby rescinded and repealed. BE IT FURTHER RESOLVED: That the City Attorney be and he is hereby ordered and directed to bring an action in the name of the City of Santa Ana in the Superior Court of the State of California in and for the County of Orange, for condemnation of said property necessary to be taken as herein ordered and heretofore described and do all things necessary to prosecute said action to final determination. BE IT FURTHER BESOLVED: That the public interest, necessity and convenience require and it is hereby ordered, that the City of Santa Ana, a Municipal Corporation, Plaintiff in the condemnation action ordered herein, take immediate possession and use of the property herein ordered to be acquired~ upon complying with the require- ments~f the law applicable thereto and that the City Attorney report to the City Council, the amount of money required therefor as soon as the same has been ascertained. BE IT FURTHER RESOLVED: That the said action for condemnation of said property so to be acquired shall be taken in accordance with Section 14, Article I of the Constitution of the State of California.
