REAL PROPERTY FOR PUBLIC STREET PURPOSES TO WIDE~ TENTH
STREET AT ENGLISH STREET AND DECLARING THE PUBLIC NECESSITY
THEREFOR o
WHEREAS~ Tenth Street as it now exists in the City of Santa An~ just
Easterly of English Street, is inadequate in width to acconmmodate the present
and future demands of traffic thereon, and because thereof is a present and
continuing traffic hazard, and
WHEREAS, the City of Santa Ana has acquired title to the property be-
tween Artesia Street and Townsend Street and there is left between Townsend
Street and English Street a length of 228.82 feet in which area Tenth Street
is only 25 feet wide;
NOW, THEREFORE~ BE IT RESOLVED: That the Council of the City of
Santa ~na does hereby Find and determine that public interests and necessity
require that the City do have~ take and acquire in fee simple for the purpose
of creating a street thereon the entire parcel of land described as:
Lying in the City of Santa Ana, County of Orange, State of
California, and commencing at a point on the East line of English
Street 620 feet North of the Northeast corner of Hickey and English
Streets; running thence East parallel with the North line of Hickey
Street, 228.82 feet to a point; thence North parallel with the East
line of English Street, 55.26 feet, more or less, to the North line
of the land conveyed to W. H. Young by deed recorded in book 270,
page 397, of Deeds, records of Orange County, California; thence
West along the North line of the land conveyed by said deed 228.82
feet to the East line of English Street and thence South along the
East line of English Street 55.26 feet, more or less, to the point
of beginning~
for the reason that the part taken to be used for said street purposes would
leave the remainder thereof in such size, shape end condition as to require
said City to pay compensation for the ts.king of such part, which would be equal
to the fair and reasonable value of the whole parcel, and said Council hereby
finds and declares that the entire parcel is necessary for the public use, benefits,
safety, economy and general welfare.
BE IT FURTHER HESOLVED: That the City Attorney be and he is hereby
ordered and directed to bring an action in the name of the City of Santa Aha
in the Superior Court of the State of California in and for the County of Orange,
for condemnation of said property necessary to be taken as herein ordered and
heretofore described and do all things necessary to prosecute said action
to final determination.
BE IT FURTHER RESOLVED: That the public interest~ necessity and
convenience require and it is hereby ordered, that the City of Santa Aha,
a municipal corporation, Plaintiff in the condemnation action ordered herein,
take immediate possession and use of the property herein ordered to be acquired,
upon complying with the requirements of the law applicable thereto and that
the City Attorney report to the City Council, the amount of money required
therefor as soon as the same has been ascertained.
BE IT FURTHER RESOLVED: That the said action for condemnation of
said property so to be acquired shall be taken in accordance with Section 14,
Article I of the Constitution of the State of California.
PASSED ANDADOPTEDby the City Council of the City of Santa Ana at
its regular meeting held on the 21st day of March, 1955.
