HomeMy WebLinkAbout56-116Ana, California is inadequate in width to accommodate future demands of traffic thereon and because thereof, and continuing traffic hazard; RESOLUTION NO. 3.~-116 AUTHORIZING THE C0~__~ OF CERTAIN PARCELS OF REAL PROPERTY FOR PUBL1-C-ETI~EET PURPOSES AND I~CLARING THE PUBLIC NECESSITY THEREFOR WHEREAS, Bristol Street as it now exists in the City of Santa the present and is a present NOW, THEREFORE, BE IT RESOLVED: That the C~t$ Council of the City of Santa Aha does hereby find and determine that the public in- terest and necessity require that Bristol Street between Fifth Street and Washington Avenue be widened and improved as shown on a map there- of on file in the Office of the City Engineer and herein referred to for greater detail, to accommodate the present and future demands of traffic thereon and further require that said City do have, take and acquire an easement for said purpose in and. to those parcels of land lying in the City of Santa Aha, County of Orange, State of Califor- nia and described as: PARCEL 1. The Westerly l0 feet of Lot 5 of Tract No. 271, in the City of Santa Aha, County of Orange, State of California, as shown on a map thereof recorded in Book 14, Page 9, Miscella- neous Maps, records of said Orange County. PARCEL la. A spandrel shaped parcel of land bounded Southerly by the South line of said Lot 5, bounded Westerly by the East line of Parcel l, bounded Northeasterly by the arc of a curve concave Northeasterly having a radius of 15.00 feet and tangent to said South line of Lot 5, and tangent to said East llne of Parcel 1. PARCEL 2. The Westerly lO.00 feet of Lot a4 of Tract No. 474 as shown on a map thereof recorded in Book 17, Page 18, Miscella- neous Maps, Records of said Orange County. PARCEL 2a. A spandrel shaped parcel of land bounded Northerly by the North llne of said Lot 24, bounded Westerly by the East line of Parcel l, bounded Southeasterly by the arc of a curve con- cave Southeasterly having a radius of 15.00 feet and tangent to said North line of Lot 24, and tangent to said East line of Parcel 1. The Westerly 10 feet of the following: Beginning at the Southwest corner of Lot 6 of "Tract No. 839~, as shown on a map the~-eof recorded in Book 25, Page 42, Miscellaneous Maps, rec- ords of said Orange County, running thence South parallel to the East line of Bristol Street, 172.23 feet, more or less, to the North llne of "Hedges Addition to Samta Ana", as shown on a map thereof recorded in Book 31, Page 48, Miscellaneous Records of Los Angeles County, California; thence West along the North line of said Hedges Addition, 174.50 feet, more or less, to the center line of Bristol Street; thence North alsng the ce.n. ter line of Bristol Street to a point which is South 89 38' 30" ~est, 30 feet from the Southwest corner of Lot 5 of said Tract No. 839; thence North 89° 38' 30" East along the South line of said Tract No. 839, 174.50 feet, more or less, to the point of beginning; EXCEPTING THEREFROM the South 43 feet, and EXCEPTING THEREFROM the West 30 feet. PARCEL 9a. The Easterly 10.00 feet of the Northerly 15.00 feet of Lot 26 in said Tract No. 662. PARCEL 9b. That portion of said Lot 26 described as a spandrel shaped parcel of land bounded Northerly by the North line of said Lot 26 and bounded Easterly by the West line of Parcel 2, and bounded Southwesterly by the arc of a curve concave Southwesterly, having a radius of 15.00 feet and tangent to said North line of said Lot 26, and tangent to said West line of Parcel 2. PARCEL 10. That portion of Lot 18, of Tmct No. 1290, as shown on a map thereof recorded in Book 39, Page 39, Miscellaneous Maps, Records of said Orange County, described as a spandrel shaped par- cel of land bounded Northerly by the North line of said Lot 18, bounded Easterly by the East line of said Lot 18, and bounded South- westerly by the arc of a curve concave Southwesterly, having a radius of 15.00 feet and tangent to both North and East lines of said Lot 18. -2- PARCEL 11. That portion of Lot 17, of Tract No. 1290, as shown on a map thereof recorded in Book 39, Page 39, Miscellaneous Maps, Records of said Orange County, described as a spandrel shaped par- cel of land bounded Southerly by the South line of said Lot 17, bounded Easterly by the East line of said Lot 17, and bounded North- westerly by the arc of a curve concave Northwesterly having a radius of 15.00 feet and tangent to both South and East lines of said Lot 17. PARCEL 12. That portion of Lot 15 of Tract No. 1256, as shown on a map thereof recorded in Book 41, Page 48, Miscellaneous Maps, records of said Orange County, described as a spandrel shaped par- cel of land bounded Southerly by the South line of said Lot 15, bounded Easterly by the East line of said Lot 15, and bounded North- westerly by the arc of a curve concave Northwesterly, having a ra- dius of 15.00 feet and tangent to both South and East lines of said Lot 15. BE IT FURTHER RESOLVED: That hereby ordered and directed to bring the City Attorney be and he is an action in the name of the City of Santa Ana in the Superior Court of the State of California in and for the County of Orange, for condemnation of said property necessary to be taken as he rein ordered and heretofore described and do all things necessary to prosecute said action to final determination. HE IT FURTHER RESOLVED: That the public interest, necessity and convenience require and it is hereby ordered, that the City of Santa Ana, a municipal Corporation, Plaintiff in the condemnation action or- dered herein, take immediate possession and use of the property herein ordered to be acquired, upon complying with the requirements of the law applicable thereto and that the City Attorney report to the City Council, the amount of money required therefor as soon as the same has been as- certained. BE IT FURTHER RESOLVED: That the said action for condemation of said property so to be acquired shall be taken in accordance with Section 14, Article I of the Constitution of the State of California.
