W.N WASHINGTON AVENUE AND SEVENTEENTH STREET WHEREAS, Bristol Street as it now exists between Washington Avenue and Seventeenth Street in the City of Santa Aha, California, is inadequate in width to accommodate the present and future de- mands of traffic thereon; NOW, ~4EREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby find and determine that the public interest and necessity require that Bristol Street between Seven- teenth Street and Washington Avenue be widened and improved, as shown on a map thereof on file in the office of the City Engineer and herein referred to for greater detail, to accommodate the present and future demands of traffic thereon and further require that said City do have, take and acquire an easement for said purpose in and to those parcels of land in the City of Santa Ana, County of Orange, State of California, described as follows: PARCEL 1. The Easterly l0 feet of the North 55 feet of Lots i and 2 of Tract No. 758, as per map recorded in Book 23, Page 26 of Miscellaneous Maps, in the office of the county recorder of said county. PARCEL 2a..The Easterly~10.00 feet of the Northerly 94-43 feet of the Southerly 100.~3 feet of Lot i of Tract No. 758, as per map recorded in Book 23, Page 26 of Miscellaneous Maps, in the. office of the county recorder of said county. 2b. A spandrel shaped parcel of land bounded Easterly by the West line of Parcel 2a, bounded Southerly by the North line of the Southerly 6.00 feet of said Lot l, and botuuded Northwesterly by the arc of a curve concave Northwesterly having a radius of 15.00 feet and tangent to said West line of Parcel 2a and tangent to said North line of the Southerly 6.00 feet of said Lot 1. PARCEL 3a. The Easterly lO.00 feet of the Northerly 96.00 feet of Lot 4© in Tract No. 758, as per map recorded in Book 23, Page 26 of Miscellaneous Maps, in the office of the County Recorder of said County. 3b- A spandrel shaped parcel of land bounded Easterly by the West line of Parcel 3a, bounded Northerly by the North line of said Lot 40, bounded Southwesterly by the arc of a curve concave Southwesterly having a radius of 15.00 feet and tangent to said West line of Parcel 3a, and tangent to said North line of Lot 40. PARCEL 4' The Easterly 10.00 feet of the Northerly 24.00 feet of Lot 41 and the Easterly 10.00 feet of the Southerly 24.00 feet of Lot $0 of Tract No. 758, as per map recorded in Book 23, Page 2b, ~..Iiscellaneous Maps, in the office of the County Recorder of said County. PARCEL 5. The Easterly 10.00 feet of the Southerly 48.00 feet of the Northerly 72.00 feet of Lot 41 in Tract No. 758, as per map recorded in Book 23, Page 26, of Miscellaneous Maps, in the office of the County Recorder of said County. PARCEL 6a. The Easterly 10.00 feet of the Southerly 48.00 feet of Lot 41 of Tract No. 758, as per map recorded in Book 23, Page 26, of Miscellaneous Maps, in the office of the County Recorder of said County. 6b. A spandrel shaped parcel of land bounded Easterly by the West line of Parcel 6a, bounded Southerly by the South line of said Lot 41, bounded Northwesterly by the arc of a curve concave Northwesterly, having a radius of 15.00 feet, and tangent to said West line of Parcel 6a, and tangent to said South line of Lot 41. H. A spandrel shaped parcel of land bounded wester- ly by a line parallel with and 40.00 feet easterly from, measured at right angles, the west line of said section 12, bounded northerly by a line 50.00 feet southerly from, measured at right angles, the north line of said section 12, bounded southeasterly by the arc of a curve concave southeasterly, having a radius of 25.00 feet and tangent to said west and north boundaries of said spandrel. The Westerly 40.00 feet of the Southerly 179.90 feet of that portion of Section 12, Township 5 south, Range l0 west, S.B.B. & M., in the land allotted to Jacob Ross in Decree of Partition of the Rancho Santiago de Santa Ana, re- corded in book "B" of Judgments of the 17th Judicial District Court of Los Angeles County, California, described as follows: Beginning at the northwest corner of said section 12; thence south 285.64 feet along the west line of said section to the north line of the land described in deed to C. H. Harris and wife, recorded December 24, 1923 in Book 502, Page 254 of Deeds, of said Orange County; thence east 174.655 feet along the north line of said Harris Land; thence north 285.64 feet parallel with said west line of Section 12 to the north llne of said Section 12; thence west 174.675 feet to the point of beginning. The westerly 40.00 feet of the following: That portion of Section 12, Township 5 south, Range l0 west, in the land allotted to Jacob Ross in decree of partition of the Rancho Santiago de Santa Ana, recorded in book "B" of Judgments of the 17th Judicial District Court of California, described as follows: Beginning at the northwest corner of the south 6 acres of a 10.59 acre parcel of land described as beginning at the north- west corner of said section 12; thence south l0 chains along the west line of said section; thence east 10.59 chains; thence north l0 chains; thence west 10.59 chains to the point of be- ginning of said 10.59 acre parcel, said northwest corner of said south 6 acres being southerly 285.74 feet, more or less, from the northwest corner of said section 12; thence easterly 174.62 feet along the north line of said south 6 acres; thence southerly 50.00 feet parallel with the westerly line of said section 12; thence westerly 174.62 feet parallel with the north line of said south b acres to the westerly line of said section 12; thence northerly 50.00 feet to the point of begin- ning. Sundquist et ux by deed re?orded April 12, 1938 in Book 930, Page 526 of Official Records, thence easterly 174.60 feet parallel with the center line of West 17th Street, to the northwest corner of the land conveyed to Bennie C. 01son et ux by deed recorded June 28, 1939 in Book 999, Page 291 of Official records; thence southerly 80.46 feet along the west line of said land conveyed to Bennie C. A spandrel shaped parcel of land bounded southerly by the north line of Parcel 29b, bounded westerly by the east line of Parcel 29a, bounded northeasterly by the arc of a curve concave northeasterly having a radius of 15.00 feet, and tangent to said north line of Parcel 29b, and tangent to said east line of Parcel 29a. BE IT FURTHER RESOLVED: That the City Attorney be and he is hereby ordered and directed to bring an action in the name of the City of Santa Aha in the Superior Court of the State of California in and for the County of Orange, for condemnation of said property necessary to be taken as herein ordered and heretofore described and do all things hecessary to prosecute said action to final dete~cination. BE IT FURTHER RESOLVED: That the public interest, necessity and convenience require and it is hereby ordered, that the City of Santa Ana, a Municipal Corporation, Plaintiff in the condemnation action ordered herein, take Irmuediate possession and use of the property herein ordered to be acquired, upon complying with the requirements of the law applicable thereto, that the City Attorney report to the Director of Finance, the amount of money required therefor, and that the Director of Finance shall deposit said amount with the Clerk of the Court. BE IT FURTHER RESOLVED: That the said action for condemna- tion of said property so to be acquired shall be taken in accord- ance with Section 14, Article I of the Constitution of the State of California.
