OF CERTAIN REAL PROPERTY FOR THE WIDENING OF McFADDEN
STREET
WHEREAS, McFadden Street as it now exists between the Pacific
Electric Railway Company right-of-way and Kilson Drive in the City
of Santa Ama is inadequate in width to accommodate the present and
future demands of traffic thereon; aud
~EREAS, all of the property along the south side of said
street between said points is being widened and improved by the
developer of Tract No. 2483 with the exception of one parcel which
is being voluntarily transferred to said City for street widening
purposes, which will leave one parcel of real property extending
beyond the southerly curb line of said street;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana does hereby find and determine that public inter-
est and necessity require that McFadden Street between the Pacific
Electric Railway Company right-of-way on the west and Ktlson Drive
on the east be widened and improved along the south side thereof,
as shown on a map on file in the office of the City Engineer and
herein referred to for greater detail, to accommodate the present
and future demands of traffic thereon, and further require said
City to have, take and acquire an easement for said purpose in and
to that certain parcel of land in the City of Santa ina, County of
Orange, State of California, described as:
Beginning at a point on the center line of McFadden
Street which is 1~5.00 feet westerly from the inter-
section of the center lines of McFadden Street and
Oak Street as shown on a map of Tract No. 466 recorded
in Book 16, page 48, Miscellaneous Maps, Records of
Orange County California, and also as shown on a map
of Tract No. 2483, recorded in Book 86, page 4 of said
Miscellaneous Maps, thence South 0° 45' 00" East 31.00
feet; thence North 89° l~' 00" East 100.00 feet; thence
North 0° 45' 00" West 31.00 feet; thence South 89° 15' 00"
West lO0.00 feet along said center line of McFadden
Street to the point of beginning.
EXCEPTING therefrom that portion thereof previously
granted for McFadden Street.
BE IT FUR~{ER RESOLVED: That the City Attorney be and he is
hereby ordered and directed to bring an action in the name of the
City of Santa Aha in the Superior Court of the State of California
in and for the County of 0rsmge, for condemnation of said property
necessary to be taken as herein ordered and heretofore described
and do all things necessary to prosecute said action to final
detenuination.
BE IT FURTHER RESOLVED:
and convenience require and it
~nat the public interest, necessity
is hereby ordered, that the City of
Santa Ana, a Municipal Corporation, Plaintiff in the condemnation
action ordered herein, take irmuediate possession and use of the
property herein ordered to be acquired, upon complying with the
requirements of the law applicable thereto, that the City Attorney
report to the Director of Finance, the amount of money required
therefor, and that the Director of Finance shall deposit said
amount with the Clerk of the Court.
BE IT FUR~ER RESOLVED: That the said action for condemna-
tion of said property so to be acquired shall be taken in accord-
ance with Section 14, Article I of the Constitution of the State
of California.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the ~' day of '~.- 1956.
