HomeMy WebLinkAbout56-308RESOLUTION NO. 55-308 INITIATING PROCEEDINGS FOR TILE ANNEXATION OF TERRITORY TO THE CI~Z OF SANTA ANA~DESIGNATED "FIRST AIND TUSTIN S~ ANNEX"~ A~D GI~ING NOTICE OF TI~'~ ~{D PLACE OF HEA~RING OF PROTESTS THERETO. ?g~F~EAS~ the boundary Con~r~ission of Orange County~ California~ has approved the description of certain real property as hereinbelow set out for the purpose of annexation~ and the Plam~ing Co~ission of the City of Santa Ama has approved said annexation; and WKEREAS~ the City Council of the City of Santa Ana~ California has de- ter~nined the advisability of initiating proceedings for such annexation~ and Y~s deten~ned that said real property is uninhabited as hereinbelow defined; NOW~ THERF~'ORE~ BE IT HESOLVEN}: That the City Council of the City of Santa Aha hereby initiates proceedings for the annexation of the real property herein described; that the reasons why said Council initiates proceedings in this particular matter are as follows: 1. Said territory now has no water~ sewer~ or other municipal services available to it~ and there is indication of demand for such services. 2. The area cannot develop without the availability of such services~ and there presently appears to be no way in wh~h said services can be supplied to said territory other than as a part of the City of Santa Aha. 3. That Santa Aha presently h~s a sewer line running through said territory adequate to give service thereto. 4. That the iow fire insurance rate available to territory within the City of Santa Aha, together with the other city services~ make such annexation most advantageous to said area. 5. Annexation to the City of Santa Aha will be mutually beneficial to said City and to the territory herein proposed to be annexed. That said City Council hereby declares its intention to annex all of said territory under the provisions of the Ar~exation of Uninhg0ited Territory Act of 1939~ and hereby finds and declares that said territory is deemed unin- habited since it now has~ on the date of the adoption of this Resolution~ less than twelve registered voters residing therein. '~at said territory is con- tiguous to the City of Santa Ana~ lies in the Count~ of Orange~ State of California~ and is described as: beginning at the intersection of the center line of Tnstin Ave. with the easterly prolongation of the north line of First Street; and running thence westerly along said north line of First Street (66 feet wide) to the east line of lot 16 of the Mabury Tract as shown on a n~ap thereof recorded in Book 165 page 300, Deeds of Los Angeles County, and to the boundary of the City of Santa Aha; thence southerly along the southerly extension of said east line of Lot 16 and along said city boundary to the south line of said First Street and to an angle point in said city boundary; thence westerly along said city boundary of the City of Santa Aha, and along said south line of First Street to an angle point in said city boundary and to the east line of Lot A of the Stafford and Tustin Tract as shown on a map thereof recorded in Book 2, page 619 of Miscellaneous Records of Los Angeles County; thence southerly along said east line of Lot A and along said city boundary to the north line of Lot 3 in Tract No. 24 as shown on a map thereof recorded in Book 9~ Page 23~ Miscellaneous Maps, Records of Orange County; thence easterly along the north line of Lot 3 and 4 in said ~act No. 24 580 feet more or less to the northeasterly right of way line of the freeway~ thence S 33°-k5'-01" E~ 130.00 feet more or less to the beginning of curve in said right of way line; the radial line to said curve bears S 42°-41'02" W; thence along the arc of said curve concave northeasterly, b~ving a radius of 1920.O0 feet 412.25 feet to the north line of ~in Street (80 feet wide) as shown on said map of the Stafford and Tustin Tract; thence easterly along said north line of M~in Street and its easterly extension to the center line of Tustin Avenue; thence northerly along said center line of Tustin Avenue to the point of beginning. That "First and Tustin SW Annex" is hereby designated as an appropriate name for said annexation. That said Council hereby declares its intention to and it will annex said territory to and include it within the Santa ~ Elementary School District, Santa kna High School District and Santa Ana Junior College District and upon the completion of said annexation~ said territory shall be and become a part of said School Districts. NOTICE IS HEREBY 6IVEN 'that February 4~ 1957~ at the hour of 7:30 P.M. in the Council Chambers in the City Hall at Third and b~in Streets~ in the City of Santa Ana~ California~ is the time and place fixed at which said Council will hear protests ~de by any person owning real property within said territory so proposed to be am]exed. At any time before said hour~ any owner of any of said property n~y file written protest against this proposed annexation.
