SHALL BE HE~.
W~F~AS, on November 4, 19~2 the electors adopted
a Charter for the gove~ent of the City of S~taAna and on
November 2, 19 4 said electors adopted a~n~ents to s~d
Charter, which amend~ients were submitted on ~ initative
petition, and
V~EZ~AS, Section 1201 of said Charter fixed the
first Tuesday in April of each odd n~bered year as the time
when the Gener~ Eunicipal Election should be held, but said
amendments, in three separate Sections, referred to the second
~esday in April as the date of said election, thereby creating a
conflict s~d contradiction i~ the te~s of said Charter due to
inadvertance ~d error, ~d
~m~EREAS, internal contradiction in the languajo of any
Charter should not exist.
]~OW THE°~FORE, BE iT ~SOLVED: ~hat the City Council~
on i~s own motion, hereby authorizes and directs that a proposition
bo s~bmitted to the electors of the City to chang~ all reference
to the date of theOener~ ~.~unicipal Election to the first Tuesday
in April of each odd n~bered year by submitt~nd~ for adoption at
the General ~funicipal Election to be held April 9, 19~7 the follow-
i~ proposition, to-wit:

BE IT FURTHER RESOLV~D: _~aat Sections 101.1, 101.2 and
401~1 of the Charter of theCity of S~ta Ana be amended to read
as follows:
"SECTION i01.1. ~¥ARDS OF THE CITY
The City Council shall divide the City into five
Wards by ordinance according to the following fonuula:
"Esch of the five Wards is to be as nearly equal in
number of registered Voters as possible. The ~ards shall be com-
posed of contiguous and compact territory and bounded by natural
boundaries c~ street lines wherever possible; provided however,
that in laying out such wards no precinct at the time fixed by
the Board of Supervisors of Orange County shall be divided, and
further provided that in event said Board of Supervisors shall, at
least sixty days before a Oeneral Hunicipal E~ction, re-~ecinct tho
City with tho result that ~ y ~recinct is divided by a ~ard
lino, tho City Council shall, not loss than thirty days prior
to said General ~unicipal E~ction, modify said ~ard lines to
an extent sufficient to prevent the division of any precinct by
a ~Vard linc. ~ny territory hereafter anno ~ed to or consolidated
with ~eCity shall become a part of the Ward to ~ich it is
contiguous, provided however, that if any berritory ~nexed at
one time shall contain registered electors in excess of twenty-five
hundred as determined by the registration books of the County
of Or~ge at the time of such annexation, the City Council shall,
~ithin ninety days after said annexation, redistrict the City in
the manner prescribed in this Section aa d pursuant to notice
and hearin~ as required by Section lO1.4.
"SECTION 101.2. WARDS, BOUNDARY CH~2~GES.
"The boundary lines of wards shall be changed every two
years by ordinance enacted by a four-fifths vote of the City
Council, not less than ninety days prior to the General Nuni~ipal
Election to be held the first Tuesday of April in each odd
numbered year. The boundary line~ shall be adjusted mo that at
each adjustment no Ward sh~ll vary from any other Ward by more
than ten percent of the registered electors of any of said Wards.
If during the preceeding t~ years there shall not have been a
change of registered elector population in any ~ard to cause
it to vary by ten percent or more from any other Ward, then
no change of Ward lines shall be made. Notice ~ d public hearin~
sh~ll be provided as required by Section 101.4.

"SECTION 401.1. ORDER OF FILLING OFFICES.
The office for Councilmen from Ward One, Ward Three,
and ~ard Five shall be filled at the General Municipal E~ ction
held on the first Tuesday of April,1957, and the office for
Councilmen from Ward Two and Ward Four shall be filled at the
General Municipal Election held on the first Tuesday of April,
1959. Thereafter the office of Councilmen from Yards One, Thr~e
and Five and from Wards Two au d Four shall be filled at the
alternate General Municipal Elections.
The candidate elected from each ~a~d shall be the candidate
receiving the highest ntunber of votes cast for any candidate
fromsaid ~ard."
The Clerk of the Council is hereby directed to print the
proposed amendments to the Charter of the City of SantaAna in
one issue of the Santa Ana Independent not less than 40 days nor
more than 60 days before said Election; to cause the sa~e to be
printed and cause a copy thereof enclosed in an envelope with
sample ballot to be mailed to each ~oter, to publish a "Notice
of Measures"to be voted upon; and to publish a notice that a copy
of proposed ~mendments may be had by registered electors on
application thereof, all as required.
PASSED AND ADOP'iED by the City Council of the City
of Santa Ana at its regular meeting held on the 3rd day of
December, 19~6.
