A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA SETTING A HEARING FOR THE
PURPOSE OF DETERMINING WHETHE~ OR NOT THE
PUBLIC CONVENIENCE AND NECESSITY ~EQUIRE THE
IMPROVEMENT OF DELHI ROAD AHD ~, ALL
WITHIN THE CITY OF SANTA
WHEREAS Section 17 of Artt$~ XIII of the Constitution

WHEREAS, Section 2804 of the Streets and Highways Code
of the State of California provides that the "Special Assessment
Investigation, Limitation and Majority Protest Act of 1931" shall
not apply to any proceeding otherwise subject thereto when said
improvement proceeding is by a charter city and said city has
complied with the provisions of Section 17 of Article XIII of
the Constitution of the State of California; and
WHEREAS, the City of Santa Ana is a charter city of the
State of California.
NOW, THEREFORE, THE CITY COUNCIL 0F THE CITY OF SANTA
ANA DOES RESOLVE AS FOLLOWS:
SECTION 1. That said City Council proposes to initiate
proceedings for the improvement of:
Delhi Road between the center line of Main Street
and a point 159.49 feet % east of the center line
of Evergreen Street; --
Flora Street between the center line of Main Street
and a point 330 feet $ east of the center line of
Cypress Avenue;
~lora Street between the center line of Halladay
Street and the center line of Evergreen Street;
Central Avenue between the center line of Main

line of Evergreen Street;
Adams Street between the center line of Cypress
Avenue and the center line of Evergreen Street;
Emmett Street between the center line of Halladay
Street and a point 15B.50 feet ~ east of the center
line of Evergreen Street; --
Cypress Avenue between the center line of Flora
Street and a point 174.03 feet $ south of the
center line of Adams Stre$; --
Orange Avenue between the center line of Central
Avenue and the south property line of South Santa
Ana Tract;
Measor Street between the center line of Central Avenue and the center line of Adams Street;
Halladay Street between the center line of Delhi
Road and a point 158.21 feet $ south of the center
line of Emmett Street; and --
Evergreen Street between the center line of Delhi Road and the center line of Emmett Street,
all in the City of Santa Ana, by' the clearing of right of way,
grading, preparing subgrade and paving with asphaltic plant mix,
construction of concrete curbs, gutters, sidewalks and driveway
aprons, and appurtenant work thereto. The nature, location, and
extent of the proposed improvement and the district to be
assessed for the cost a~expenses thereof are as shown
respectively on the plan and profile No. AD 197, adopted by the
City Council of the City of Santa Ana, by Resolution No. 58-11
on January 6, 1958, and assessment district map No. AD 197,
Sheet No. l, adopted by said City Council by Resolution No. 58-12
on January 6, 1958, and in accordance with specification entitled
"Specifications For Street Improvements In Assessment District
No. 197", which said specification duly was adopted by said City
Council by Resolution No.58-11on the 6th day of January, 1958,
which said plan and profile, assessment district map and
specification now are on file in the offices of the City Engineer and
of the Council

assessment district map and specification reference is made for
all particulars relative thereto.
SECTION 2. That the total estimated cost of the pro-
posed improvement is $263,081.91.
SECTION 3. That the said improvement shall be conducted
under the Improvement Act of 1911, which is Division 7 of the
Streets and Highways Code of the State of California.
SECTION 4. That notice hereby is given that on the
20th day of January, 1958, at 7:30 o'clock P.M., in the Council
Chamber located in the City Hall of said city, there shall be a
public hearing before said City Council for the purpose of
determining whether the public convenience and necessity require
the above described improvement.

SECTION 5. That the~k~ Clerk/shall give notice of
the hearing by posting a copy of this resolution in the manner
prescribed by Section 5065 of the Streets and Highways Code and
by publication as hereinafter provided. Any person interested
may make protest against the proposed improvement in writing

SECTION 6. That the ~ Clerk/hereby is directed to
publish this resolution in the Santa Ana Register on two
successive dates, the first publication to be made not less than
ten (lC) days prior to the date of the above public hearing.

of this resolution and thenceforth and thereafter the same shall
be in full force and effected.
