HomeMy WebLinkAbout58-107I~ESOLUTIOM NO. 58-107 AUTHORIZING EXECUTION OF DEED AFTER SALE OF G~ROPERTT WHEREA~, heretofore the Fire$%i~._tion located at 1322 North Sycamore Street in Santa Aha was vacated as a Fire Station, declared surplus real properSy, and was offered for sale, and WHEREAS, thereafter the City Council entered into an agreement with the President of the Santa Aha Board of Realtors for Multiple Listing of said property under t~e condition that the President of said Board was acting as the agent of the Board and not as an in- dependent broker, and that 40% of any 5% commission resulting from the sale of said property would be paid to the President of said Board to be deposited by him into the Treasux-y of said Board as a part of said Board's general fund, and that 60% of said 5% comm- ission of any sale should be paid to the agent making said sale, and WHEBEA~, Elizabeth S. Miller, a member of said Santa Aha Board of Realtors, obtained Bernard Beck___er, who made a written offer to purchase ssi d property for $24, 000.00, and who deposited with said offer the sum of $1,000.00 as a payment outside of escrow; that after discussion before said Council on February 3, 1958, said sale was approved for a total purchase price of $25,200.00, the $1,000.00 deposited being payment for a one-year option to purchase at said figure, less said deposit and any rent that might be paid during said option, which said rent was fixed at $100.00 per month, and WHEREAS, Mr. Booker has now moved into said building and de- termined that he would purchase ~he same by the payment of the entire unpaid balance of the purchase price, through escrow, at this time; NOW, THEREFORE, BE IT HESOLVED: That the Mayor and the Clerk of the Council are hereby directed to execute a Joint Tenancy Grant Deed conveying to Bernard Becket and Cecilia M. Becket, husband and wife, that certain property in the City of Santa Aha, California, described as: ~1~e East 115 feet of the following described parcel of land: Begtm~lug at a point 38-2/llths rods West of a point 78-10/llths rods South of the Northeast cor~er of Section Twelve, Township Five South, Range Ten West, San Bernardino Base & Meridian, and running thence North 55-2/5tbs feet; thence East to the West line of Sycamore Street, as said Street is described in Decree of Condemnation, a certified copy of which Decree was recorded January 8th, 1929 in Book 22~, Page 401 of Official Records of Orange County; thence South along the said West line of Sycamore Street 55~Sths feet to the North line of land conveyed to W. H. James and wife by deed recorded September 1st, 1928 in Book 184, Page 488 of Official Records of Orange County; thence West to the point of beginning, in consideration of the purchase price of $25,200.00, $1,000.00 having been heretofore received by the City, is hereby acknowledged; that Carl J. ~hornton, the City's designated agent, is hereby directed to place his Certificate of Acceptaxce upon s~d deed and to deliver the same to the Orange County Title Company ~or recording by them through the escrow now pending with sa~ d Company.
