OF CERTAIN REAL PROPERTY FOR THE WIDENING OF SEVEN-
TEENTH STREET ON THE NORTH SIDE BETWEEN BAKER STREET
AND TOWNER STREET
BE IT RESOLVED that the City Council of the City of Santa Aha
does hereby find, determine and declare that the public interest
and necessity reo~.ire that Seventeenth Street be widened at the loca-
tions hereinbelow described, to accommodate the present and future
traffic demands thereon, and further require the construction of
street improvements at said location, and further require the ac-
quisition for and in connection with said street work of an easement
and right-of-way for all purposes of a public street in the name of
said City across, in and over the land in the City of Santa Ana,
County of Orange, State of California, described as:
PARCEL l: That portion of Lot i of the Bates Tract, as shown
on a map recorded in Book l, page 96 of ~iscellaneous Maps,
Records of Orange County, California, described as follows:
Commencing at the intersecti~ of the northerly line of
Seventeenth Street 60.00 feet wide with the easterly line of
the proposed street, 40.00 feet wide as shown on said map;
thence easterly along said northerly line of Seventeenth
Street, 10.O0 feet to the true point of beginning; thence
easterly along said northerly line of Seventeenth Street,
50.00 feet; thence northerly at right ~ngles to said north-
erly line of Seventeenth Street 20.00 feet; thence westerly
parallel with said north line of Seventeenth Street~50.00 feet;
thence southerly parallel with said easterly line of the pro-
posed street 20.00 feet to the true point of beginning.
PARCEL la: A spandrel shaped parcel of land bounded southerly
by the north line of Parcel l, bounded westerly by a line par-
allel with and 10.00 feet easterly from, measured at right
angles, said easterly line of the proposed street; and
bounded northeasterly by the arc of a curve concave north-
easterly, having a radius of 15.00 feet and tangent to said
north line of Parcel l, and tangent to said parallel line,
which is easterly lO.00 feet from said easterly line of the
proposed street.
PARCEL 2: That portion of Lot i of the Bates Tract, as shown
on a map recorded in Book l, Pa~e 96 of ~iscellaneous ¥~aps,
records of Orange County, California, described as follows:
Beginning at a point in the south line of Section l, Town-
ship 5 South, R~tge 100'West'4' San Bernardino Base and ~eridian,
distant South 89~48, West 145.00 feet from the s~theast
corner of said Lot i of the Bates Tract, and running thence
North 1° 15' East parallel with the East line of said Lot l,
50.00 feet; thence North 89° 48, 40" East to the center line
of Towner Street as shown on a map of Tract No. 1~06, recorded
in Book 39, pages 29 and 30 of Niscellaneous Maps, records of
Orange County, Califomi~; thence South O0° 45' 10" West along
said center line of To~er Street 50.00 feet to said south
line of Section l; thence South 89° 48, 40" West 90.005 feet
to the point of beginning. EXCEPTING therefrom any portion
of said land lying within Seventeenth Street or Towner Street.
PARCEL 3: The West ~5 feet of that portion of Lot 1 of the
Bates Tract, as shown on a map recorded in Bookl, page 96, of
Miscellaneous Maps, records of Orange County, California, des-
cribed as follows:
Beginning at a point in the South line of Section l, Town-
ship 5 South, R~ge l0 West, S.B.B. & M., distant South 89°
48' 40" West 200 feet from the Southeast corner of said Lot 1
of the Bates T~act, and running thence North 1° 15' East parallel
with the East line of said Lot l, 50.00 feet; thence Easterly
parallel with said South line of Section l, to the center ltr~
of Towner Street, as shown on a map of Tract No. 1306, recorded
in Book 39, pages 29 and 30 of Miscellaneous Maps, records of
Orange County, California, thence South O0° ~5' lO" West along
said center line of Towner Street 50.00 feet to said South line
of Section l; thence South 89° 48, 40" West 145.00~ feet to the
point of beginning.
PARCEL 4. The southerly 20.00 feet of the following: That
portion of Lot i of the Bates Tract, as shown on a map thereof
recorded in Book l, page 96 of Miscellaneous Maps, records of
Orange County, California, described as ~ollows:
Beginning at a point in the North line of Seventeenth Street
distant 200 feet West of the Southeast corner of said Lot l;
thence North parallel with the East line of said Lot l, l~0
feet; thence West parallel with the North line of Seventeenth
Street, 100 feet, more or less, to t~e Northeast corner of
the land conveyed to C. Ed Thomas and wife, by deed recorded
September ~2th, 19~4, in Book 1289, page 108 of Official Records;
thence South al ong the East line of said land conveyed to
Thomas, 150 feet to the North line of Seventeenth Street;
thence East along said North line, 100 feet, more or less, to
the point of beginning.
BE IT FURTHER RESOLVED that said land shall be condemned in
accordance with the provisions of the Code of Civil Procedure and
of the Constitution of California relating to eminent domain, and the
City Attorney is directed to prepare and prosecute in the name of the
people of the City of S~ta Ana such proceeding or proceedings as are
necessary to acquire such ease~ents and rights-of-way, and to make
application to the Court for an Order fixing the amount of security
by way of money deposits as said Court may direct, and for an Order
per~itting the City to take immediate possession and use of said
real property or interest therein as a right-of-way for public use,
and to make deposit of such security in the amount so fixed and
determined by the Court in which such proceeding is pending.
