TO VACATE A PORTION OF EAST FIFTH STREET BETWEEN POINSETTIA
STREET AND THE SOUTHERN PACIFIC COMPANY RAILROAD RIGHT-OF-WAY
WHEREAS, after study, the Planning Commission has recommended
vacation of a portion of Fifth Street hereinbelow described, and the
Director of Public Works has recomv~ended s~ d vacation, but with a
qualification attached thereto, and the City Co~nacil, after study,
has concluded the same may be unnecessary for present or prospective
street purposes;
NOW, THEREFORE, BE IT RESOLVED that the map attached hereto
marked "Exhibit A" is hereby approved and ordered filed with and as
a part of this Resolution in the office of the Clerk of the Council
a~d reference is hereby made to said map for particulars and exact
details as to said proposed street vacation, and the City Council
hereby declares its intention to vacate and clo~e up as a public
Street that portion of Fifth Street in the City of Santa Ana, Cali-
fornia, described as:
East Fifth Street (60' wide) lying between Poinsettia
Street and the Southwesterly righ~-of-way line of the
Southern Pacific Railroad Right-of-Way.
BE IT ~IRT'{ER RESOLVED that the hour of 7:30 o'clock P.~.
on the 4th day of August, 19~8 in the Council Chmmbers, City Hall,
~t 3rd and ~ain Streets, in the City of Santa Ana, California, is
hereby fixed as the time and place for hearing all persons interested
in or ob3ecting to the proposed vacation of said portion of Fifth
Street; that the City Council hereby declares its intention to pro-
ceed with said vacation under the provisions of t~e Street Vacation
Act of 1941 (Sections 8300 through 8374 of the Streets and Highways
Code of the State of California).
The Clerk of the Council is hereby ordered to publish this
Resolution in the manner prescribed by law for the publication of
Ordinances of the City, and the Director of Public Works is hereby
ordered to post, conspicuously along the lines of said alley herein
proposed to be vacated, notices stating the passage of this Resolu-
tion of Intention, and the time abm place of the hearing thereon; such
notices shall be posted not more than 300 feet apart and at least
three shall be posted along said portion of said alley. Said publi-
cation and postiug shall be completed at least l0 days before August
4., 1 58.
