HomeMy WebLinkAbout58-247EESOLUTION NO. 58-247 A RESOLUTION OP THE CITY COUNCIL O1~ THE CITY OP SANTA ANA PROPOSING MODIFICATIONS IN THOSE PRO- CEEDINGS FOR THE IMPROVEMENT OF ST. ANDKEN PLACE INSTITDT~u PURSUANT TO RE~OLUTION NO. 58-139 THE CITY COUNCIL OF THE CITY OF SANTA ANADOESRESOLVEAS FOLLOWS: SECTION 1. That said City Council hereby proposes to modify the hereinafter listed resolutions and documents pertaining to those certain proceedings instituted pursuant to Resolution No. 58-139 for the improvement of St. Andrew Place and other streets, as such streets are set forth in said resolutions and documents. Each of the hereinafter listed resolutions and documents are pro- posed to be modified by deleting therefrom: "by the removal of existing improvements, grading, pre- paring of subgrade, paving with asphaltic plant mix, construction of concrete curbs, gutters, and driveway aprons" and substituting therefor in each place in each of said resolutions and documents where the above quoted language appears, the follow- ing: "by the removal of existing improvements, grading, pre- paring of subgrade, paving with asphaltic plant mix, construction of concrete curbs, gutters, driveway aprons, and sidewalks, the construction of drainage structures in Halladay Street, Anahurst Place, St. Gertrude Place, St. Andrew Place, and Delhi Road." Those resolutions and documents so proposed to be modi- lied are: 1) Resolution No. 58-139 adopted June 2, 1958; 2) 3) Affidavit dated June 14, 1958, relating to the publi- cation of Resolution No. 58-139 on June 6 and June 14, 1958; the copy of Resolution No. 58-139 made a part thereof; and Resolution No. 58-139 as so published on said days; Resolution No. 58-150 adopted June 16, 1958; Resolution No. 58-151 adopted June 16, 1958; 5) Affidavit of Publication dated July 10, 1958, relat- ing to the publication of Resolution No. 58-151 on -1- July 3 and July 10, 1958; the copy of the resolution made a part thereof and said resolution so published on said days; 6) Notice of Improvement signed by the Street Superin- tendent of said city posted ou June 27, 1958, giving notice of the adoption of Resolution of Intention No. 58-151,and the copy of said notice so posted, attached to and made a part of the Affidavit of Post- ing dated June 27, 1958; 7) Notice signed by the Clerk of the Council of said city and mailed ou June 27, 1958, and the copy of said notice attached to the Affidavit of MAiling thereof dated June 27, 1958; 8) Resolution No. 58-176 adopted July 21, 1958; 9) Notice Inviting Bids signed by the Clerk of the Council ~f said city and dated July 21, 1958; lO) Affidavit of Publication of the Notice Inviting Bids dated August 14, 1958, relating to the publication of the Notice Inviting Bids on August 7 and August 14, 1958; the copy of the Notice Inviting Bids made a part thereof, and the Notice Inviting Bids so published on said days; n) Notice Inviting Bids posted on or near the Council Chamber door on August l, 1958, and for a period of five days immediately thereafter; 12) Resolution No. 58-198 adopted August 18, 1958; 13) Notice of Award of contract signed by the Clerk of the Council of said city and dated August 18, 1958; Affidavit of Publication dated August 28, 1958, re- lating to the publication of the Notice of Award of the contract, published on August 21 and August 28, 1958, a copy of the Notice of Award made a part there- of, and said notice as so published on said days. SECTION 2. That said City Council hereby proposes to modify Resolution No. 58-151 as to the second "~hereas" clause thereof by changing the resolution number referred to therein from 58-i48 to 58-150. SECTION 3. That item 7 of the bid proposal contained estimated quantities of concrete. That said estimated quantities, as so shown, include the estimated quantities of concrete necessary for sidewalks, even though sidewalks are not specifically set forth therein, and the bid as submitted for concrete work shall be deemed to be for sidewalks as well as for concrete work specifically set -2- in said item 7. SECTION 4. The purpose of this resolution and the modi- fications proposed hereby is to clarify apparent inconsistencies in the above-mentioned documents, the plans and specifications per- taining to the proceedings, and to set forth correctly the factual data relating thereto. The plans and specifications called for con- struction of sidewalks and the drainage structures and, therefore, the modifications proposed herein, if ordered, will not increase or decrease the estimated.cost of the work. SECTION 5. Notice hereby is given that on the 3rd day of November , 1958, at 7:B0 o'clock P.M., any person interested in the proceedings referred to in said resolutions, notices, and affidavits above noted, said proceedings being for the improvement of St. Andrew Place and other streets, as set forth in said above resolutions, having any objections to the changes or modifications proposed herein may appear before said City Council and show cause why said changes or modifications should not be ordered, and any person interested may file written objections to the proposed changes and modifications with the Clerk of the Council at any time not later than the time set for hearing. SECTION 6. The Clerk of the Council hereby is directed to publish this resolution in the "Santa Aha Register" at least once, such publication to be at least ten (lC) days prior to the date of the above public hearing. SECTION 7. The Clerk of the Council shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
