RESOLUTION NO. 59-30 DECLARING THE VACATION AND ABANDON~ENT OF CERTAIN 4~D~SOUTH 0F~DELHI ROAD AND EAST OF MAIN STREET AND REgERVING UTILITY ~ASEIv~.NTS THEREIN WHEREAS, heretofore on Januar~y 5, 1959, the City Council adopted Resolution No. 59-2, declaring its intention to vacate those portions of unnamed ~ leys therein and hereinbelow described, which said Resolution was published and posted as required by law; and WHEREAS, public hearing was duly held on the 16th day of February, 1959, upon ~ue notice in said Resolution and said posted notices contained; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of S~ta Aha hereby finds from all the evidence submitted that the portions of unnamed alleys hereinbelow described are unnecessary for present or prospective street purposes. BE IT MJRTHER RESOLVED: That the City Council hereby makes its order vacating, abandoning a~d closing up for street purposes all those portions of unnamed alsys in the City of Santa Aha next herein described, save and except that the public utility easements reserved as a part of said description are hereby ordered reserved to the utility now occupying the same. Said areas lie in the City of County of Orange, State of California, and are described Santa Ana, as~ 1. e Extending from Central Avenue to Adams Street, between railroad tracks and ~easor Street: (20-foot ~lley). In and between Block 5, Tract 39, Block H, of the South Santa Ana Tract: Bounded on the no~th by the westerly extension of the northerly line of Lot 13, Block 5; and on the south by a line beginning at a point 2.5 feet north of the southeast corner of Lot 10, Block H, extend- ing east to the westerly line of Lot 14, Block 5. Reserving and excepting from said vacation a pe~nanent easement and right of w~ to construct, maintain, oper- ate and renew gas pipe lines and appurtenant structures and the right to protect the same from all hazards in and over the westerly 6 feet of said ~lley. ~xtending from Orange Avenue to Cypress Avenue, south of Central Avenue. In Block G, South S~ta Ana Tract: A 15- foot alley bounded on the east by the westerly line of Orange Avenue, and on the west by the easterly line of Cypress Avenue. Reserving and excepting from said vacation ~ ease~nent to construct, place, operate, inspect, maintain, repair, replace and remove such aerial and underground telephone, telegraph and communication st~ctures as the company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers and necessary fixtures and appurtenances in and over the land described The south seven and one half (7.5) feet of that certain alley to be vacated abutting Lots 9 to 16 inclusive of Block G, South Santa Aha Tract, as said Lots and Block are shown on map of said tract recorded in Book 5 at Page 43 of ~iscellaneous Maps in the office of the County Re- corder of Orange County. Between Cypress Avenue and Nain Street, south of Central Avenue, in Block F, South Santa Aha Tract: That portion of a 20-foot ~ley bounded on the east by the westerly line of Cypress Avenue and on the west by a line 150 feet west of smd parallel to the westerly line of Cypress Avenue. Between Orange Avenue and Cypress Avenue, north of Central Avenue. In Block D, South Santa Aha Tract: The 10-foot alley bounded on the east by the westerly line of Lot 3, Tract 1~75, and on the west by the easterly line of Cypress Avenue. Extending from Cypress Avenue to Nain Street, north of Central Avenue. In Block E, South Santa Aha Tract: The 10-foot alley bounded on the east by the westerly side of Cypress Avenue, and on the west by a line 50 feet east of and parallel to the center line of South Main Street. PASSED AND ADOPTED by the City Council of hhe City of Santa Aha at its regular meeting held on the 16th day of February, 1959.
