59-38 OF THE CIT¥ OF SANTA ANA OBJECTING TO
OF CERTAIN TAX DEEDED PROPERTY
WHEREAS, the Tax Collector of the Cou~ty of 0~,ange, California
is about to sell certain resl property within the City of Santa Ana,
a municipal corporation, located within said County of Orange des-
cribed as:
Beginning at a point on the northerly extension of the East
line of Lot l, Tract No. 1370, as shown on a msp the~,eof
corded in Book 41, Page 21, Miscellaneous Maps, records of
Orange County, Califor~ia, 23.53 feet northerly from the North-
east corner of said Lot l, and running thence North O0° 24' 0o"
East along said northerly extension of the East line of Lot l,
36.4? feet; thence North 89° 41, 47" East 133..35 feet to the
West line of Lowell Street as granted to the C~ty ~f S~uta Ana
by deed recorded in Book 334, Page 91, Official Records of
Orange County, California; thence South O0° 23'47" West along
the southerly extension of said west line of Lowell Street,
37.44 feet; thence North 89° 53' 10" West 133.35 feet to the
point of beginning,
and which said property has been assigned the designation of A.P.
13-062-16, and is designated as Code Area ll03; and
WHEREAS, the City of Sa~ ta Ana is a taxing agency, the taxes
of which are collected by the County of Orange through the County
Tax Collector, and the taxes which have remained unpaid have resulted
in the sale of the above described property to the State of California,
and said taxes include taxes levied by said City of Sa~ ta Aha.
NOW, THEREFORE, BE IT RESOLVED BY 'EtE CITY COUNCIL OF ~tE CITY
OPm SANTA ANA: That said City objects to the proposed sale of the
real property herein above described for the reason that the same does
now lie within the proposed boundaries of Russell Avenue in said City
and said real property is needed for public street right of way, was
originally intended for said purpose and should not now be sold to
an individual owner; that such a sale to an individual owner would
require the City of Sa~ ta Aha to proceed in an action of eminent
domain to acquire said property for public street purposes.
BE IT FURTHER RESOLVED: That the Mayor a~ d the Cle~ of the
Council are hereby authorized and directed to execute for and on be-
half of said City an Agreement, and enter into the same with the
Board of Supervisors of said County of Orange for purchase of said
real property by the City of Santa Aha, California; said Agreement
to be in the form identical with the fonm attached hereto and by
reference made a part hereof.
PASSED AND ADOP~n~ by the City Council of the City of Santa
Ana at its regular meeting held on the l~th day of Feb~ry~ 1~9.
