RESOLUTION NO. 59~8 GRANTING VARIANCE ON APPLICATION
NO. 1083 OF FAR.%~RS UNDERWRITERS ASSOCIATION, WHERE
PLA~NINO C0~ISSION RECOmmENDED DENIAL
WHEREAS, Variance Application No. 1083 was considered before
the ?lanning Commission on ~arch 23rd, 1959, ~nd said hearing was
continued for a Further hearing held thereon on Ap~l 13, 1959, and
after said hearings the Planning Comnis~ on voted 4 to 3 to recormuend
to the City Council th~ s~id variance be denied; and
~tEREAS, s~ d report came before the City Council on the 20th
day of ~pril, 19~, a t which time there were protests against the
granting of said variance, mud arguments t~esented by spokesmen repre-
senting Nr. ~d ~rs. Lacy and ~r. and ~rs.Salveson, owners of the
real property involved, and Farmers Underwriters Association, a cor-
poration, that had entered into ~ escrow to purchase said property;
and
WHEREAS, after study, consideration and hearing, it aDpears to
the City Council th~ s~ d variance should be granted;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Aha finds that the variance as applied for should be
granted to permit the construction of a regional, operational and
administrative office building for the Farmers Insursnce Group upon
that portion of said property lying ~ong the Southern Pacific ~ail-
road right of way and protected from the street by single family
residences built along the westerly side of said triangle facing
Flowe~ Street, and along the southerly side of said triangle facing
a street which would be the extension of Nemory Lone, extended
easterly from Flower Street.
BE IT FURTHER RESOLVED: That said City Council finds that
speci~ circumstances attach to said property which do not generally
apply to other property in the vicinity by reason of the fact that
the Southern Pacific Railroad right of way runs ~ ong the northeast-
erly boundary of said propert~ and immediately beyond the Railroad
right of way is located the Santa AnaFreeway, resulting in continu-
ous heavy traffic, noise ~d vibration, and that all of the property
lying easterly of said Santa Ana Freeway is used for industrial
or commercial purposes; taat because of said facts subject property
cannot reasonably be expected to develop for residential uses, as
property lying west and south of this property has done; that the
granting of the variance will not result in material ds_mage or
prejudice to other property in the vicinity because of the manner
of said development and the buffer strip provided for the protec-
tion of other property.
BE IT FURTHER RESOLVED: That the City Council overrules the
Planning Commission and grants said variance to permit the construc-
tion of an office building for a regional, operational and adminis-
trative office for the Farmers Insuraace Group on the interior area
of said triangle upon the following conditions:
1. Tentative and Final ~aps for subdivision for R-1 use pro-
viding for 37 parcels with a minimum of 8,000 square feet to be filed
and approved, and further that the ~pplicant execute a contractural
agreement with the proper city officials to provide in the deed for
the sale of all 37 lots limiting the same to the construction of
homes for no other pur!?ose and that said homes should be of 1700
square feet or more providing that said restrictions should be ir-
for a period of l0 years, before a building pe~it is
revocable
issued.
2.
That a site plan showing parking and place~ent of building
be submitted and approved by all of the roll, lng: Planning Commis-
sion, Planning Department, and City Council.
3. That a 6-foot masonry wall be erected along the north line
of Lots 1 through l0 and east line of Lots 22 through 37 and the
north line of Lot 37 except that the wall along the north side of
Lot 37 be not more than 4 feet high for depth of the required front
yard (all lot numbers refer to Tentative Nap
4. That the ~plicant shall construct streets as shown on ~ap
3374, shall construct streets, curbs, sidewalks, sewers and stub-outs
to parking area, to be installed prior to issuance of building permit.

That the trees on the property be ~.~aintained and none re-
~noved except as may be necessary for the immediate construction of
streets, curbs, ~dewalks, walls, landscaping and parking areas, and
for the construction of the Farmers !nsurau ce buildmn~j, and as may be
required for the immediate construction of homes on the 37 R-1 lots.
6. That said applicant shall reimburse the City for the cost
of the installation of a traffic signal at !'.'!emory Lane nd Flower
Street, not to exceed ~3,~00.00~
to affect the real property described as:
Parcel One: All that certain land situated in the City of
Santa Ana, County of Orange, State of California, described
as follows:
Commencing at tne southwest corner of the 160-acre tract of
land conveyed by Alfred B. Chapm~ to Thomas }~. Shaffer by
deed recorded February ll, 1874 in book 29, page 30 of Deeds,
records of Los ~geles County, C~lifornia; running thence
South 89° 40' East to the point of intersection of the South-
west boundary of the right of way of the Southern Pacific
Railroad Comp~ay with the South line of said 160-acre tract;
thence in a Northwesterly direction along the said Southwest
boundary of said right of w~y of t he Southern Pacific Railroad
Company to the point of intersection of s~d Southwest bound-
ary of said right of way with the ~est line of said 160-acre
tract; thence South 20feet West to the point of beginning.
All that certain land situated in the Rancho S~ntiago de Santa
Ana, City of Santa Ana, County of Orange, Stateof California,
described as follows:
The North 9.79 acres of lot 12 of the Potts, Borden end Sidwell
Tract, as per map recorded in book ~, page ~24 of ~iscellaueous
Records, in the of~ce of the County Recorder of Los Angeles
County, California.
EXCEPTING therefrom a strip of land i rod wide off the South
side thereof.
ALSO EXCEPTI}~G therefrom the following described real property:
Beginning at a point in t he West line of said lot Twelve,
~4.27 feet South of the northwest corner thereof; running
thence South 0° l~' East along the ~est line of said lot Twelve,
75 feet~ thence South 89° 39' East 24o feet to a point; thence

16 of Record of Surveys, in the office of the County Recorder
of Orange County, C~ifornia, of Potts, Borden and Sidwell
Tract, as shown on a map recorded in book 4, page 624 of ~is-
cellaneous Records, in the office of the County Recorder of
Los Angeles County, California.
