RESOLUTION NO. 59-116 GRANTING VARIANCE UPON
DIFFERENT COND~T'IONS 'THAN THOSE RECOMMENDED BY
THE PLANNING COMMISSION
WHEREA~, heretofore the Planning Commission held a hearing
after due notice on Variance Application No. 1105 and recommended
that the same be approved upon certain conditions; and
WHEREAS, the City Council after study, determined that said
Variance should be granted but that the conditions imposed upon the
granting thereof should be modified as hereinbelow set out.
NOW, THE~EF0~, BE IT RESOLVED: That a Variance is hereby
granted on Application No. ll05 to per, it the use of the property
k~own and numbered as ~l~t Fifth Street, Santa Aha, herein-
below described to be used as a salvage yard and auto wrecking
yard and for retail sales of new and used auto parts upon the fol-
lowing conditions:
1. That the ex~sting shed and barn-like building be removed.
2. That an 8 foot block wall be constructed across the
entire front of the property but that no portion of said wall or
any new structures or signs shall be placed closer than 72 feet
from the surveyed center line of Fifth Street and that said block
wall shall extend 25 feet Southerly along but inside of the Wester-
ly property line adjacent to but not touching the Westerly boundary
line'of said property so that said Southerly extention shall begin
at a point 72 feet from said center line of Fifth Street and extend
to a point 97 feet South of said center line of Fifth Street. That
an 8 foot corrugated iron fence shall be erected and maintained con-
tinuously in a state of good repair without exposed, rusting, de-
formation or externally protruding edges to inclose the entire re-
maining boundary line of said property but that no portion of said
fence shall be constructed within one foot of said boundary line.
3- That the owner of said property dedicate to the City,
the Northerly 42 feet of said property measured Southerly and aZ
right angles to the existing center line of Fifth Street for street
right-of-way across the entire street frontage of said property.
4. That the owner dedicate to the City, all vehicular ac-
cess rights to Fifth Street.
5. That the a~ea between the block wall and the new right-
of-way line be blacktopped and that lines indicating parking stalls
for angle parking at 30 degrees be painted upon said blacktop ad-
Jacent to said wall, to provide not less than 12 parking stalls
not less than 9 feet and 6 inches from the center of one stall
boundary line to the next nearest stall boundary line. That at
no time during the operation of any use permitted by this Variance
or while any of said property is used for any salvage yard opera-
tion or any car wrecking or for the sale of new or used automobile
parts or the storage of any item which has resulted from any of
said uses, maintained upon any portion of said property, shall
any piece of machinery, motor vehicle part, salvaged item, or
anything made of metal be piled, stacked, stored or maintained in
a position or manner so as to be visible from the street or from
any side of said property.
6. At no time while any portion of said property is used
for any of the uses permitted under this Variance or while say
item resulting from or usable in the carrying on of any such uses
is stored upon the property shall any motor vehicle or trailer be
stored or parked North of the block wall to be located 72 feet
South of said center line of Fifth Street for the purpose of offer-
ing the same for sale or in any way indicating that the same is
for sale and no vehicle not in a condition to be lawfully operated
upon the highways of the State and no vehicle not in good ~,n~ing
order shall be parked or stored North of said block wall.
7. No repair, mechanical or w~ecking work shall be done
on any vehicle North of said block wall, it being the express in-
tent of this condition that the area North of said block wall shall

be exclusively for parking of employees and customers and that the
same shall not be used for display purposes or for storage purposes
except temporary parking of said employees and customers.
8. Applicant shall apply to the City Council for any drive-
1my area desired by him and a reconveyance of the rights of ingress
and egress shall be granted to him after agreement with said Court-
cil.
9. All structures except as herein otherwise indicated shall
be built in accordance with the plot plan submitted with the appli-
cation.
The property to which this Variance applies is described as:
Beginning at the Northwest co~ner of the Northeast Quar-
ter of the Southeast quarter of the Southwest quarter of
Section 9, Township 5 South, Range 10 West, San Beruardino
Base and Meridian, thence East along the North line of
said Southeast quarter of the Southwest quarter, 360 feet
to a point; thence South parallel to the West line of said
Northeast quarter of the Southeast quarter of the South-
west quarter to the North line of the land conveyed by
E. A. Teel and wife to Anna J. McArthur by deed recorded
August 23, 1897, in book 33, page 53 of Deeds; thence West
along the North line of said land of Anna J. McArthur 360
feet to the West line of the Northeast quarter of the South-
east quarter of the Southwest quarter of said Section 9;
thence North along the West line of said Northeast quarter
of the Southeast quarter of the Southwest quarter to the
point of beginning.
