HomeMy WebLinkAbout59-120RESOLUTION NO. 59-120 APPROVING MAP AND DECLARING IN- TENTION TO VACATE A PORTION OF ARTESIA STRW.~..T BETWEEN FIFTEENTH AND SIXTEENTH STREETS AND A PORTION OF SIXTEENTH ST~W.W.T RUNNING 160.76 FEET WESTERLY FROM THE EAST SIDE OF ARTES IA STREET WHEREAS, heretofore, the Planning Commission has recommended that the street right-of-way hereinbelow described be vacated, the Director of Public Works has approved said vacation and the City Council, after study, has concluded that the same may not be neces- sary for present or prospective street purposes by the fact that there is proposed a new public street lin~--ge between Fifteenth and Sixteenth Streets Just Westerly of the portion herein proposed to be vacated. NOW, THEREFORE, BE IT RESOLVED: That the map attached hereto marked "Exhibit A" is hereby approved and ordered filed with and as a part of this Resolution in the office of the Clerk of the Council and reference is made to said map for particulars and exact details of this proposed vacation. The City Council hereby declares its in- tention to vacate and abandon those portions of A~tesia and Sixteenth Streets lying in the City of Santa Ana, County of Orange, State of California and described as: That portion of Artesia Street ~unntng Nort~ from Fif- teenth Street to Sixteenth Street between College and Daisy Avenues ar~ that portion of Sixteenth Street,lyi~ng East of a line r~nning due North and South and being lbO.7b feet ~est of the East line of said Artesia Street measured at right angles. BE IT FURTHER RESOLVED: That the hour of 7:30 P.N. on the 15th day of June, 1959 in the Council Chambers, City Hall, ~aird and Main Streets, Santa Aha, California is the time and place fixed for hear- ing all persons interested in or objecting to said proposed street vacation. The City Council hereby declares its intention to proceed with said street vacation under the p~ovisions of the Street Vacation Act of 1941 (Sections 8300 t~roug~ 8374 of the Street and Highways Code of the State of California); and The Clerk of the Council is hereby ordered to publleh this Resolution in the manner prescribed by law for the publication of Ordinances of the City and the Director of Public Works is hereby ordered to post conspicuously along the lines of said streets, no- tices stating the passage of this Resolution of intention to vacate streets and the time and place of hearing thereon. Such notices shall be posted not more than 300 feet apart and at least t~ee shall be so posted. Said publication and posting shall be completed at least ten days before the date of hearing. BE IT FURTHER ~SOLVED: ~at it is declared to be unnecessary to reserve any public service easements for the reason that applicant for this vacation has offered to post a bond to guarantee its willing- ness to relocate all public utility structures in the new street right-of-way.
