RESOLUTION NO. -' 59-171 GRANTING VARIANCE ON APPLICATION
NO. 1140 BUT MODIF~G THE CONDITIONS RECOMMEi~DED BY
THE PLANNING COMMISSION
WHEREAS, the Planning Commission, after hearing, recommended
that a variance be granted under the findings and on the conditions
set forth in its Resolution No. 5169, and the City Council, after
consideration and hearing, has determined that there should be a
modification of recommended conditions;
NOW, THEREFORE, BE IT RESOLVED: That a variance is hereby
granted on Application No. ll40 filed by Hamilton N. Ra_vmor~d to
permit the construction of a single family residence with four bed-
rooms on the front part of the lot in an R-1 District where a single
family dwelling presently exists, together with two sheds and two
utility buildings, one of which utility buildings is presently used
as a wedding chapel, said new family residence to be constructed on
the southeast corner of said property, upon the following conditions:
1. That the single f~nily residence be constructed as and
in the location hereinabove referred to, and in accordance with and
as shown on a plot plan submitted to the Planning Commission and in
the Planning Commission's file.
2. That the use of any portion of the property as a wedding
chapel or wedding service be discontinued.
3. That the owner dedicate to the City for street purposes
a strip of land across the entire frontage of said property, 42 feet
wide from the center line of Newhope Avenue, measured at right angles.
4. That the o~uer dedicate to the City all vehicular access
rights from said property, except at the existing driveway opening
in an area approximately 12 feet in width.
5. That the owner post a surety bond or enter into an
acknowledged agreement with the City to guarantee construction of
all street improvements to City standards across the entire frontage
of said property within 180 days from demand for such const~ction
by the City, such demand not to be made until some other portion of
Newhope Avenue in the vicinity of subject property is to be, is being,
or has been improved with standard street improvements.
BE IT ~rdR~tER RESOLVED: That the findings of the Planning
Commission as to the requirements for the granting of a variance
contained in Resolution No. 5159, are hereby approved.
BE IT FURTHER RESOLVED: That this variance applies to property
known and numbered as 14861 Newhope Avenue, Santa Ana, California,
which is located in an R-1 District.
