INTENTION TO VACATE PORTIONS OF SMELTZER, SUGAR AND
FAIRVIEW AVENUES, A~ND CLINTON ~ND KELLOG STREETS
NEAR THE EAST BANK OF THE SANTA ANA RIVER
WHEREAS, the Depart~,ent of Public Works has reco~lended that
the portions of streets hereinbelow described be vacated;
NOW, THEREFORE, BE IT RESOLVED: That the map attached heret~
marked "Exhibit A", hereby approved and ordered filed with and as a
part of this Resolution in the office of the Clerk of the Council
and reference is made to said map for further particulars and exact
details of this proposed street vacation, and the City Council here-
by declares its intention to vacate and abandon portions of streets
lying in the City of Santa Ana, County of Orange, State of California,
described as:
That portion of Fairview Avenue described as follows:
Co~mencing at the intersection of the center line of
Fairview Avenue with the center line of Kellogg Street
as shown on a map of a re-plat of Smta Ana Acres record-
ed in Book ~, Page 8, ~iscellaneous Naps, Records of Orange
County, California, and running thence South 0° 47' 20"
East along the southerly extension of said center line of
Kellogg Street 30.00 feet to a point on the south li~ of
said Fairview Avenue; thence South 89° 22' 28" West along
said south line 3~9.20 feet to the true point of beginning;
thence westerly along the arc of a tangent curve concave
northerly having a radius of 1,042.00 feet to the westerly
line of said Fairview Avenue as shown on said map; thence
southeasterly along said west line to said south line of
Fairview Avenue; thence North 89° 22' 28" East along said
south line 313.92 feet more or less to the true point of
beginning.
That portion of Kellogg Street described as follows:
Commencing at the intersection of the center line of Fairview
Avenue with the center line of Kellogg Street as shown on a
map of a re-plat of Santa Ana Acres recorded in Book ~, Page
~iscella~eous ~aps, Records of Orange County, California,
and running thence ~orth 0° 47' 2o. West along samd center
line of Kellogg Street ~4.00 feet; thence South 89° 22' 28"
West 30.00 feet to the true point of beginning being a
~oint on the west line of Kellogg Street; thence North 0°
7' 20" West alon~z said west line to the north line of said
Kellogg Street as shown on said map; thence easterly along
said north line 4.10 feet;°thence2 South 0° 47' 20" East
930.2~ feet; thence South 04' 2~" West 140.17 feet; thence
South 0° 47' 20" East 1[~.08 feet to the beginning of a tan-
gent curve concave northwesterly having a radius of 2~.00
feet; thence southerly and westerly along the arc of said
curve through a central angle of 90o 09' 48" an arc distance
of 39.34 feet to a tangent line; t~ence South 89° 22' 28"
Mest along said tangent line 2.0~ feet to the true point of
beginning.
That portion of Smeltzer Avenue described as follows:
That portion of Smelt er Avenue bounded easterly by the west-
erly line of the Rancho Santiago de Santa Ana; and bounded
westerly by the easterly right-of-way line of the former
Newbert Protection District right-of-way for the channel
of the Santa Ana River; the center line of said Smeltzer
Avenue being on the south line of Section 15, Township 5
South, Range l0 West, San Bernardino Base nd Meridian.
That portion of Sugar Avenue described as follows:
That portion of Sugar Avenue bounded easterly by the wester-
ly line of the Rancho Santiago de Santa Ana; and bounded
westerly by the easterly right-of-way line of the former
Newbert Protection District right-of-way for the channel
of the Santa Ana River; the center line of said Sugar Avenue
being on the south line of the north half of Section l~,
Township ~ South, Range l0 West, San Bernardino Base Md
Meridian.
That portion of Clinton Avenue described as follows:
That portion of Clinton Avenue bounded southerly by the north
line of Edinger Street; and bounded northerly by the easter-
ly right-of-way line of the former Mewbert Protection
District right-of-way for the channel of the S~uta Aha River;
the center line of said Clinton Avenue being on the east
line of the west half of Sections l~ and 22, in Township ~
South, Range l0 West, San Bernardino Base and Meridian.
BE IT FURTi~R RESOLVED: That the hour of 7:30 P.M. on the
8th day of September, 19~9, in t he Council Chambers, City Hall,
3rd and ~ain Streets, Santa Aha, California, is the time and place
fixed for hearing all persons interested in or objecting to said
proposed vacation of said streets. The City Council hereby declares
its intention to proceed with said street vacation under the pro-
visions of the Street Vacation Act of 1941 (Sections 8300 through
8374 of the Streets and Highways Code of the State of California).
The C~rk of the Council is hereby ordered to publish this
Resolution in the manner prescribed by law for the publication of
Ordinances of the City, and the Director of Public Works is ordered
to post conspicuously along the line of said streets notices stating
the passage of this Resolution of Intention, and the time and place
of hearing thereon. Such notices shall be posted not more than
300 feet apart and at least three shall be so posted. Such publi-
cation and posting shall be completed at least l0 days before the
date of hearing.
