RESOLUTION NO. 59-217 GRANTING VARIANCE ON APPLICATION
NO. 1154 WHERE CONDITIONS WERE MODIFIED
WItEREAS, the Planning Commission held a public hearing on
notice on Vari~ ce Application of H. J. and J. R. Adam~, No. 1154,
and recommended to the City Council that the Variaace be denied; and
WHEREAS, the City Council after consideration and hearing the
parties interested, has determined that said Variance should be
granted, on conditions;
NOW, THEREFORE, BE IT RESOLVED: That Variance is hereby
granted to affect the real property in the City of Santa Ana, County
of Orange, State of California, described as:
Parcel l: Lot Two of Tract No. 81, Shaw & Russell,s~Sunnyside
Addition as shown on a M~p recorded in Book 10, Page 31 of
Niscellaneous Naps, Records of Orange County, California.
Excepting therefrom the South 6.23 feet as conveyed to the
City of Santa Ana by deed recorded June 17th, 1922 in Book
429, Page 13 of Deeds.
Parcel 2. The Westerly half of the alley adjoining said
Parcel I on the East abandoned by Order of the Board of
Trustees of the City of Santa Ana July 20th, 1925, a cert-
ified 9opy of which Order was recorded July 22nd, 1925 in
Book 2b, Page 253 of Miscellaneous Records,
to permit the construction of a five-unit apartment on the rear of
said property known and numbered as 933 Cypress Street, Santa Aha,
California, in an R-1 District adjacent to an R-2 District, on the
following conditions:
1. That the owner replace broken sidewalk on Cypress Street.
2. That, before any building permit is issued or any building
started, the owners enter into an agreement with the City of Santa
Ana, agreement to be acknowledged by the owners, providing that the
existing old structure, a ~ngle family residence on the front of
s~d property, be removed within five years from the issuance of a
building permit for the construction of said five-unit apartment,
and agreeing that in event said old single family dwelling str~cture,
its foundations and all parts thereof have not been moved within
s~ d five-year period, the City is granted the right to enter upon
the land with its agents, employees, or private contractor employed
by City to remove said existing old structure, entirely at the cost
of the o~er of said land, or to bring an action in the Coumts of
this State for the specific performance of said agreement to compel
the record owners of said land to then remove said old residence
structure and all parts thereof, and to fill and level any excava-
tion remaining, and for a reasonable atto~ney,s fee to be fixed by
the Cou~t, and/or an action for any expense incurred by City in or
for the removal of said structure, in the filling and leveling of
said land, and for such attorney fee, and costs.
3. That owner provide parking as indicated on the plot plan,
all of the parking area to be blacktopped or concreted, and properly
marked to indicate the parking stalls.
4. That each one-bedroom unit be not

Ana at its regular meeting held on the 17th day of August, 1959.
