RESOLUTION NO. 59-231 GRANTING VARIANCE ON APPLICATION
NO. ll60 WHERE THE PLANNING COM~SSION RECO~iENDED DENIAL
WHEREAS, the Planning Commission after hearing has recom-
mended that no variance be granted on Application No. ll60, and the
City Council after consideration has decided that the same should
be granted;
NOW, TPIEREFORE, BE IT RESOLVED: That the City Council finds
that special circumstances ~ply to this property, which was form-
erly C-1 District in the County, and by reason of annexation has
become R-1 District in the City, and that reasonable property rights
are not available to this location that are available to others,
that is, an empty store building to be used as construction equip-
ment parking and office immediately north of this parcel, and a
construction yard three lots on the opp~tte corner of the street,
and ab e er tavern three lots south of this parcel on the same side
of the street; that the variance as applied for should be granted
to affect Lot 15 of Tract No. 366, as shown on Orange County Asses-
sor's Map, Book 99, Page 21, and known as 14695 South Verano Street,
Santa Ana, California, to allow said property to be used for an
office and equipment parking area for the contracting firm known
as PAVING CONTRACTORS, who use small trucks, tractors, etc., on
the following conditions:
1. That not more than two tractors and two trucks shall be
stored on said property.
2. That no inflsmable liquids be stored upon the property.
3. That a solid fence or block wall six feet high be con-
structed along Silver Drive and Ver~qo Street.
4. That owner execute and deliver a deed to the City dedi-
cating an easement for street purposes across the entire frontage
of said property on Verano Street 52 feet wide, measured at right
angles from the center line of Verano Street, together with a span-
drel corner on a 25-foot radius at Verano Street and Silver Drive.
5. That the record owners of said property enter into an
acknowledged agreement with the City agreeing at their own proper
cost s~nd expense to install sidewalks, curb and gutter, and stand-
ard paving between existing concrete pavement and the curb, across
the entire frontage of said property on Verano Street when the par-
cel of property immediately north of this property is so improved.
6. That the owner install sidewalk, curb and gutter, and
pave~an area 18 feet from the curb on Silver Drive adjacent to said
property, when similar improvements are installed on the property
immediately west of this parcel.
7. That not more than 200 gallons of diesel or motor lubri-
cating oil be stored on the property, and that the same be stored
in compliauce with Fire Department regulations.
8. That said agreement be recorded, to operate as a lien or
obligation upon the land.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 8th day of September, 19~9.
