HomeMy WebLinkAbout60-016RESOLUTION NO. 60-16 CALLING A SPECIAL MUNICIPAL ELECTION TO BE HELD ON ~tE 5TH DAY 0F APRIL, 1960, TO SUBMIT TO THE ELECTORS IN THAT TERRITORY DESIGNATED "SOUTH SANTA ANA ANNEX NO. 2" THE QUESTION OF ANNEX- ATION OF SAID TERRITORY TO THE CITY OF SANTA ANA, CALIFORNIA, AND ORDERING A CORRECTED DESCRIPTION AND MAP OF SAID TERRITORY TO BE SUBMITTED TO THE ORANGE COUNTY BOUNDARY COMMISSION TO DELETE ALL TERRITORY WEST OF BRISTOL STREET WHICH IS SOUTH OF PAULARIN0 AVENUE WHEREAS, heretofore the City Council of the City of Santa Aha adopted Resolution No. 59-278, con~enting to commencement of proceedings to annex certain inhabited territory to said City after receiving a request therefor~ referring said request to the Santa Ana Planning Commission, and receiving from said Planning Commission a report recommending said annexation, and thereafter the proponents of said annexation published notice of intention to circulate a petition for said annexation and filed an affidavit of such publication attached to a copy of said published notice which contained an accompanying statement of reasons for said annexation; and WHEREAS~ said City Council thereafter adopted Resolution No. ~9-279 acknowledging receipt and ordering filed said affidavit of publication together with the copy of the notice published contain~g description of the property, reasons for the annexation and names of the proponents, and approving circulation of a peti- tion for annexation, and said petition was thereafter duly cir- culated, filed, examined and presented to said City Council, to- gether with the Certificates of the Clerk of the Council of said City, and the Certificate of the County Clerk of Orange County, showing that more than one-fourth of the qualified electors re- siding within said territory had signed said petition for annexation; and WHEREAS, Said City Council thereafter adopted Resolution No. ~9-315 declaring intention to call a special election in territory in said Resolution designated "South Santa Aha Annex No. 2", to submit the question of annexation of territory to the electors residing therein, and fixing January 18, 1960, at 7:30 PM, in the to 5:00 P.M. on tional days for 35120; and Santa Ana Council Chambers as the day, hour and place for owners to show cause why said territory should not be annexed, and notice for owners of land within said territory to file protests, and at said hearing it appeared protests filed against said election represented less ~han one-half of the value of said territory. which fact was found and dec.red, and the period of time for filing p~otests against said election was then and there extended January 28, 1960, to allow any objectors ten addi- such filing, as required by Government Code Section WHEREAS, after January ~8, 1960, all protests were again examined and it was t;~en detem~ined that a majority protest had not been made, and this fact was declared by the Council's state- ment that the protest represented 4% of the assessed value of said territory; NOW, ~EREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha finds and declares that protest against the annexation of territory heretofore designated as "South Santa Aha Annex No. 2", and against the holding of an election on the ques- tion of annexation, has not been made by the owners of one-half of the value of said territory, as shown on the last equalized assessment roll of the County of Orange, California, and said City Council hereby calls a special municipal election on the question of annexation of said territory to the City of Santa Aha, California, and the same is ordered to be held in said territory on the 5th day of April, 1960, to submit to the electors residing in said territory the question of whether or not the same shall be so annexed. BE IT FURTHER RESOLVED: That the boundaries of the "South Santa Ana Annex No. 2" are hereby changed and amended to delete from said territory an amount of less than 5% thereof, the same to be an area lying West of Bristol Street and South of Paularino Avenue, in accordance with detailed instrUctions ~ereto given to the Public Works Department for an amended description and map of -2- said territory, said deletion being in accordance with the gentle- men's agreement made by this Council with residents in said deleted area, and the City Attorney is directed to ~mmediately submit and file with the Orange County Boundary Commission a description and map of said territory, as hereby and heretofore ordered to be amended, showing and describing said corrected boundaries, and when the same has been approved as to definiteness and certainty by said Boundary Commission to use said amended description of the boundar- ies of said territory in all matters hereinafter pertaining to "South Santa Ana Annex No. 2", and to file a copy of said revised or amended map with the County Clerk of Orange County, for the use of tD~ office of Registrar o2 Voters of said County. PASSED AND ADOPTED by the City Council of the City of Sauta Ana at its regular meeting held on the 1st day of February, 1960.
