HomeMy WebLinkAbout60-025RESOLUTION NO. b0-25 DECLARING INTENTION TO CALL A SPECIAL ELECTION IN THAT CERTAIN TERRITORY HERETOFORE KNOWN AND HEREIN DESIGNATED AS "BERRYDALE AND TRASK N. E. ANNEX" TO SUBMIT TO r~E ELECTORS RESIDING THEREIN THE QUESTION OF ANNEXATION TQ THE CITY OF SANTA ANA, AND GIVING NOTICE OF THE DATE AND PLACE FOR PROPERTY OWNERS TO SHOW CAUSE WHY SAID TERRITORY SHOULD NOT BE ANNEXED AND FOR THE FILING OF PROTESTS AGAINST SAID ELECTION WHEREAS, heretofore, at the request of residents and prop- erty owners ~[thin the area hereinbelow described, and after approv- al and recommendation favoring said annexation, fr~m the Santa Ana Planning Commission, the City Cotmcil of the City of Ssnta Ana adopted Resolution No. 59-313, giving consent to the commencement of proceedings under the Annexation ~ct of 1913; and WHEREAS, taereafter, proponents of said annexation published notice of intention to circulate petition for said annexation, and an accompanying statement of reasons, and then filed a copy of said notice and statement of reasons, together with an affidavit of publication thereof, with said City Council, and said City Council adopted Resolution No. 59-314 which, among other things, approved circulation of petition for annexation of said area to the City; and WHEREAS, thereafter said petition was duly circulated, filed with the Clerk of the Council, examined by said Clerk and by the County Clerk of 0range County, California, and the voters' records having been examined, and Certificates of said two Clerks having been rece~.ved and filed, certifying that said petitions represent more th~u one-fourth of the qualified electors residing within the territory, as shown by the County registration of voters; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby finds that said petition requests annex- ation of the territory to the City of Santa Ana, describes said territory, and is signed by more than one-fourth of said qualified electors residing within said territory; BE IT FURTHER RESOLVED: That said City Council hereby de- clares its intention to call a speci~ annexation election to submit to the electors residing wit~in said territor~ the question of annexation of said territory to the City of Santa Ana. Said territory is hereby designated as "Berrydale and Trask N. E. Annex", an appropriate name by which said territory may be referred to upon the ballots used in said election. BE IT FURTT~ER RESOLVED: That the ?th day of March, 1960, at the hour of 7:30 P.M., in the Council Chambers of the City Hall, at 3rd and ~ain Streets, in Santa Ana, California, is hereby designated as the day, hour and place where any person owning real property within said territory may appear before the legislative body and saow cause why it should not be annexed to the City of Santa Ana. At any time not ~a ter than said day and hour, any owner of property within said territo~y may make written protest against said election. Such protest shall state the name of the owner of the property affected and tae street address or ot~er description of the property sufficient to identify it on the last equalized assessment roll, as provided for by Section 3~120 of the Govemmen$ Code of the State of California. BE IT FURTHER RESOLVED: That the territory herein referred to lies in the County of Orange, State of California, and is described as: -2- BERRYD~r.~, .AND TRASKm N, E. ANNEX Be~lnni~ at the intersecti.n of a line which is parallel with 20.00 feet northerly, measured at right angles, from the center line of Track Avenue, and the east line of the west half of the northwest quarter of Section 2, Township 5 South, R~ge 10 West, ~an Bernardino Base and Meridian, said point of beginning being a point on the city boundary of the City of Santa Aha, California, thence northerly along said east line of the west half of the northwest quarter of Section 2 to the southeasterly corner of Lot 25 in Tract No. 2519 as shown on a map thereof recorded in Book 79, pages 20 and 21 of Miscellaneous Maps, Records of Orange County, California; thence southwesterly along the southeasterly line of said Lot 25 to the southwesterly corner thereof; thence southwesterly in a straight line to the most easterly corner of Lot 3 in said Tract No. 2519; thence southwesterly, along the southerly line of said Lot 3 to an angle point therein; thence northwesterly along the southwesterly line of said Lot 3, 38.09 feet to the westerly line of said Lot 3; thence westerly along the north line of Lots 6, 7, 8, 9, 10, and 11 in said Tract No. 2519 to the northwest corner of said Lot 11; thence southerly along the west line of said Tract No. 2519 to the south line of the north half (N 1/2) of the northwest quarter (NW 1/4) of the northwest quarter (N~ 1/4) of said Section 2; thence westerly along said south line and its westerly prolongation to a line which is 30o00 feet westerly, measured at right angles, from t~e west line of said Section 2; thence southerly along said parallel line which is 30 feet westerly from the west line of Section 2 to said line which is parallel with and 20 feet northerly from the center line of Trask Avenue and to said city boundary of the City of Santa Ar~; thence easterly along said city boundary to the point of beginning. -3- PASSED AND ADOPTED by the Ana at its 196o.
