APPLICATION NO. 1857 FILED BY RUBY MARIE
FRANTZ, SUBJECT TO CONDITIONS
WHEREAS, after hearing on notice. ~he Planning Commission
DENIED a variance On Variance Application No. 1857, filed by RUBY
MARIE FRANTZ, and Appeal Application No. 115 was duly filed presenting
the matter to the City Council; and
WHEREAS, the City Council, after public hearing on notice,
has determined that said Variance Application meets the requirements
of Section 9250.8 of the Santa Aha Municipal Code, that the decision
of the Planning Commission should be overruled and that said Variance
should be granted subject to certain conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana does hereby overrule the decision of the Planning
Commission and does hereby grant a variance on Variance Application
No. 1857 to permit the conversion of a portion of a single family
residence in an R-2 District at 1139 West McFadden Avenue, Santa Aha,
into a one operator beauty shop. Said Variance is granted subject
to the following conditions:
1. That the beauty shop be only for the applicant, non-transferable,
and contain only one operator;
That the applicant provide off-street parking to City standard
at such time as parking restrictions are imposed on McFadden
Avenue;
That the following conditions be ccanplied with prior to the
issuance of a building permit:
a. That an easement be provided for McFadden Avenue for a
width of 42 feet, center line to property line, for
street purposes and vehicular access rights.
NOTE: Access can be determined and approved prior to
dedication.
b. That the owner repair or eliminate step-up in sidewalk
at west property line.(Problem caused by settling of
sidewalk in front of adjacent property.)
PASSED AND ADOPTED by the City Council of the City of Santa
Aha at its regular meeting held on the 20th day of January,1964.
