QUITCLAIM DEED TO FRANK HILDITCH TO CORRECT
ERROR IN RESOLUTION 63-45 AND EXECUTION OF
DEED QUITCLAIMING SEWER EASEMENTS TO OWNERS
OF RECORD
WHEREAS, heretofore, by authority of Resolution 63-45, a deed
was executed by the City quitclaiming to FRANK HILDITCH certain real
property at the Northwest corner of Chestnut Avenue and Lyon Street
which deed contained a typographical error, and it has been determined
that a new deed should be executed to correct said error and to
clarify the deed from the City to FRANK HILDITCH which was recorded
March 27, 1963, in Book 6483, at pages 873, 874 and 875; and
WHEREAS, the City is the owner of a storm drain and sanitary
sewer easement East of Bristol Street at Central Avenue which is no
longer of use to the City and it has been determined that said
easement should be deeded to the owners of the adjacent property.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and the Clerk
of the Council are hereby directed to execute a deed quitclaiming
to FRANK HILDITCH certain real property at the Northwest corner of
Chestnut Avenue and Lyon Street to correct an error in the quitclaim
deed recorded March 27, 1963, and deliver the same to said owner.
BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the
Council are hereby directed to execute a deed quitclaiming IN
SEVERALTY TO THE VARIOUS OWNERS OF THE UNDERLYING FEE, AS THEIR
RESPECTIVE INTERESTS MAY APPEAR OF RECORD storm drain and sewer
easements East of Bristol Street at Central Avenue and deliver the
same to the Clerk of the Council.
PASSED AND ADOPTED by the City Council of the City of Santa
Aha at its regular meeting held on the 16th day of March, 1964.
