HomeMy WebLinkAbout64-050FOR ANNEXATION OF TERRITORY TO THE CITY OF SANTA ANA, DESIGNATING AN APPR~~ NAME FOR SAID TERRITORY OF "SANTA~ AND TUSTIN N.W. ANNEX" AND GIVING~.O,~I~ WHEREAS, at the request of property owners in the territory herein described, a description and map of said territory were presented to the Santa Ana Planning C~aission, which approved annexation of said territory; to the Orange County Boundary Commission, which caused a report to be prepared finding that the boundaries of said proposed annexation met with the approval of the Orange County Surveyor's Office in respect to Government Code Section 35002; and to the Local Agency Formation Co~mission of Orange County, which approved the same. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby initiates proceedings for annexation of said territory, hereinbelow described, to the City of Santa Ana for the following reasons: That said territory can best be served by the City of Santa Ana with municipal services of the highest quality anywhere obtainable at a cost for such services which is lower than can be obtained anywhere else in the County of Orange; o That it is to the mutual advantage of the City and the landowners that said territory become a part of said City. BE IT FURTHER RESOLVED: That the City Council hereby declares its intention to annex all of the territory hereinbelow described under the provisions of the Annexation of Uninhabited Territory Act of 1939; hereby finds and declares that said territory is uninhabited within the meaning of the Government Code Section 35303 on the date of the adoption of this Resolution; that said territory is contiguous to the City of Santa Ana, lies in the County of Orange, State of California, and is described as: Beginning at the intersection of the South line of Santa Clara Avenue with the West line of Tustin Avenue said point being 25.00 feet South and 30.00 feet West of the Southwest corner of Lot 5 in Block "B" of the A. B. Chapman Tract as surveyed by Frank Lecouvreur in December, 1870 and shown on a map thereof recorded in Book 102, page 15, Miscellaneous Maps, Records of Orange County, California, said point of beginning~eing on the point of beginning of the description of land annexed to the City of Santa Ana August 5, 1963, by Ordinance No. NS-682; and running thence North 0° 53' 22" East, 685.00 feet along said NS-682 boundary and along the West line of Tustin Avenue to the Westerly extension of the North line of the South One-half (S.½) of said Lot 5, said West line being 30.00 feet Westerly measured at right angles from the center line of Tustin Avenue; thence continuing along said NS-682 boundary South 88° 57' 07" East 1,350.30 feet along said Westerly extension and along said North line to a point on the East line of said Lot 5 and to a point in the Tustin city boundary as estab- lished by Tustin City Ordinance No. 145; thence departing from said Santa Ana city boundary and running along said Tustin city boundary North 0° 53' 22" East, 660 feet, more or less, along the East line of said Lot 5 to the Southeast corner of Lot 16 of Tract No. 2989 as shown on a map thereof recorded in Book 89, page 1, Miscellaneous Maps, Records of said Orange County; thence departing from said Tustin city boundary and running North 88° 57' 09" West, 1,350.82 feet along the South line of said Tract No. 2989 and along the South line of Lot 4, Block "E", in said A. B. Chapman Tract, and its Westerly extension to a point in the West line of Tustin Avenue, said West line being 30.00 feet Westerly, measured at right angles from the center line of Tustin Avenue~ thence along said West line South 0° 53~ 22" West 145 feet, more or less, to a point in the North line of Lot 8, Block "A", said A. B. Chapman Tract~ thence along the North line of said Lot 8 West, 804.57 feet to the Northwest corner of the East one-half (E.½) of said Lot 8, and to a ~olnt in the existing Santa Ana city boundary as established by Ordinance No. NS-576~ thence along said NS-576 boundary and along the West line of the East One- half (E.½) of said Lot 8 and its Southerly extension South 0° 10~ 15" East 1,225 feet, more or less, to the South line of Santa Clara Avenue, said South line being 25 feet Southerly, measured at right angles from the center line of Santa Clara Avenue, and to an angle point in the existing Santa Ana city boundary as establishedby Ordinance No. NS-664~ thence along said NS-664 boundary the next six courses= East 550 feet, more or less, along said South line of Santa Clara Avenue to a point that is 298.00 feet West and 25.00 feet South of the Northeast corner of Lot 9 of said Block "A"~ thence South 0° 04~ 24" West 175.00 feet~ thence South 44° .55~:36"'i'East 35.36 feet~ thence South 89~ 55' 36" East 23.00 feet~ thence South 0~ 04~ 24" West 564.81 feet~ thence South 89~ 43~ 55" East 228.00 feet to the West line of Tustin Avenue, said West line being 30.00 feet Westerly, measured at right angles from the center line of Tustin Avenue, and to a point in the Santa Ana city boundary as established by Ordinance No. NS-468~ thence North 140 feet, more or less, along said West line of Tustin Avenue and along said NS-468 boundary to an angle point in said NS-468 boundary, said angles point being on the Westerly extension of the South line of the North One-half (N.½) of Lot 12 in said Block "B"~ thence along said Westerly extension and along said South line and along said NS-468 boundary South 88° 57' 48" East 657.00 feet to an angle point in the Santa Ana cityboundazy as established by Ordinance No. NS-606, and to a point in a line that is parallel with and 30.00 feet Westerly, measured at right angles from the West line of the East One-half (E.½) of Lot 12, Block "B" of said A. B. Chapman Tract~ thence alon~ said NS-606 boundary and along said parallel line North 0 53' 22" East 635 feet, more or less, to a point in the South line of Santa Clara Avenue, said South line being 25 feet Southerly, measured at right angles from the center line of Santa Clara Avenue, and to an angle point in said NS-606 boundary~ thence North 88° 57~ 07" West 663 feet, more or less, along said South line of Santa Clara Avenue, and along the Santa Ana city boundary as established by Ordinance No. NS-682 to the point of beginning. BE IT FURTHER RESOLVED: That "SANTA CLARA AND TUSTIN N.W. ANNEX" is hereby designated as an appropriate name by which said territory shall be known for the purpose of this annexation. BE IT FURTHER RESOLVED: That notice is hereby given that June 15, 1964, at the hour of 7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets, Santa Ana, California, is the time and place fixed at which said Council will hear written protests against this annexation made by any person owning property within said territory. At any time prior to the final adjournment of the hearing on protests any owner of property within the territory may file written protest against this annexation. The protest shall state the name of the owner of the property affected and the street address or other description of the property sufficient to identify it on the last equalized assessment roll, all as provided for in California Government Code Section 35312. -2- PASSED AND ADOPTED by the City Council of the City of Santa Aha at its regular meeting held on the 20th day of April, 1964.
