HomeMy WebLinkAbout64-059RESOLUTION NO. 64-]9 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA, DETERMINING RESULTS OF HEARING PURSUANT TO ITS RESOLUTION OF INTENTION NO. 64-46 TO ORDER CHANGES TO WORK IN THE ~TTER OF THE CONSTRUCTION OF CERTAIN SEWER LINES TOGETHER WITH APPURTENANCES AND APPURTENANT WORK WITHIN THE SAID CITY FOR THE USE AND BENEFIT OF THE CITY OF SANTA ANA ASSESSMENT DISTRICT NO. 218. WHEREAS, the City Council of the City of Santa Ana, pursuant to the provisions of the "Improvement Act of 1911" being Division 7 of the Streets and Highways Code of the State of California, has heretofore passed and adopted its Resolution of Intention No. 62-156 to order the work described therein in the City of Santa Ana Assessment District No. 218 to be done and had acquired jurisdiction to and has heretofore passed and adopted its resolution ordering the same said work to be done by its Resolution No. 62-177; and WHEREAS, the City Council did on the 6th day of April, 1964, adopt Resolution of Intention No. 64-46, declaring its intention to order changes to the work in the City of Santa Ana assessment District No. 218, and by said resolution fixed the time and place for hearing by it of objections to said changes for the 20th day of April, 1964, at the hour of 7:30 P.M. in these chaa%bers; and WHEREAS, said Resolution of Intention was published as required by law as set forth in Division 7 of the Streets and Highways Code of the State of California, Section 5232 thereof; and WHEREAS, at the time and place so fixed, a hearing was held by said City Council at which all written protests or objections were presented, read and all persons desiring to be heard thereon were heard, and this City Council gave all persons present an opportunity to be heard in respect to any matter relating to said report, said work or improvement, or any of the proceedings therefore; and WHEREAS, all persons desiring to appear and be heard were heard at said hearing, and said hearing having been regularly held; and WHEREAS, no objections either written or oral were presented prior to or at the time of the hearing. NOW, THEREFORE, the City Council of the City of Santa Ana, California, does hereby resolve as follows: SECTION 1. That Resolution of Intention to order changes to the work in the City of Santa Ana Assessment District No. 218, adopted on April 6, 1964, has been duly and regularly published as required by Streets and Highways Code, Section 5232 thereof. SECTION 2. That n° written protests or objection to said changes has been filed with the Clerk of this Council, and that no protests or objections were made at the time of this hearing. SECTION 3. That the changes proposed have been duly con- sidered by this Council and found to be in the best interests of the public and said Assessment District No. 218. SECTION 4. That by this Resolution it is the intention of the City Council to acquire jurisdiction to order the changes to the work in said Assessment District as proposed in Resolution No. 64-46.
