HomeMy WebLinkAbout64-130RESOLUTION 64-130 AUTHORIZING EXECUTION OF A DEED QUITCLAIMING ALL RIGHT, TITLE AND INTEREST WHICH THE CITY OF SANTA ANA HAY HAVE IN CERTAIN PROPERTIES LYING NORTHEASTERLY OF THE ATCHISON, TOPEKA AND SANTA FE RAILWAY TRACK ON BOTH SIDES OF SANTIAGO CREEK CHANNEL WHEREAS, on January 5, 1935, the Atchison, Topeka and Santa Fe Railway Company leased to the County of Orange by Santa Fe's Secretary's Contract No. 36972 a parcel of land for park purposes, which said lease was assigned on July 20, 1961, to the City of Santa Ana with consent of lessor; and WHEREAS, it now appears that the California Highway Department may require that portion of said leased premises lying northeasterly of lessor's operating right of way and trackage through said leased area. NOW, THEREFORE, BE IT RESOLVED: That the Mayor and the Clerk of the Council are hereby ~uthorized and directed to execute a deed quitclaiming all right, title and interest which the City of Santa Ana may have in or to a~. portion of the land leased by Santa Fe's Secretary's Contract No. 36972, as herein- above set forth, which lies northeasterly of the lessor's operating right of way and trackage along both sides of Santiago Creek Channel to Glassell Street, to the ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY and deliver the same to the grantee together with a certified copy of this Resolution. PASSED AND ADOPTED by the City Council of the City of Santa Aha at its regular meeting held on the 8th day of September, 1964.
