INTENTION TO VACATE A PORTION OF EDINGER AVENUE
AT THE SOUTHWEST CORNER OF FLOWER STREET AND
EDINGER AVENUE AND RESERVING AN EASEMENT THEREIN
WHEREAS, the Public Works Department has requested that a
portion of Edinger Avenue be vacated because of realignment of said
street.
NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby
adopts the map attached hereto and orders the same filed with the
original of this Resolution in the office of the Clerk of the Council,
and reference is hereby made to said map for details as to exterior
boundaries of the portion of Edinger Avenue proposed to be vacated.
The City Council declares its intention to proceed with this
vacation under the provisions of the Street Vacation Act of 1941
(§§8300 through 8374 of the California Streets and Highways Code)
to vacate that certain portion of Edinger Avenue (reserving therein
an easement for utility structures) in the City of Santa Aha, County
of Orange, State of California, described as:
Commencing at the intersection of the center lines of
Flower Street and Edinger Avenue as shown on a map of
Tract No. 1888 recorded in Book 53 at pages 13 and 14,
of Miscellaneous Maps, records of Orange County,
California, and running thence South 89° 28' 50" West
along said center line of Edinger Avenue 185.00 feet;
thence South 0° 18' 20" East 13.00 feet to the true
point of beginning; thence South 0° 18' 20" East 27 feet
to a line that is parallel with and 40.00 feet South,
measured at right angles from said center line of Edinger
Avenue; thence North 89° 28' 50" East along said parallel
line 119.91 feet to the beginning of a tangent curve,
concave Southwesterly, having a radius of 25.00 feet;
thence Southeasterly along said curve through a central
angle 90° 12' 50" to a point of cusp with a tangent lane;
thence North 0° 18' 20" West 27.00 feet to the beginning
of a tangent curve, concave Southwesterly, having a radius
of 25.00 feet; thence Northwesterly along the arc of said
curve through a central angle of 90* 12' 50" to a tangent
line that is parallel with and 13 feet South, measured at
right angles from said center lane of Edinger Avenue;
thence South 89° 28' 50" West along said parallel line
to the point of beginning.
RESERVING and EXCEPTING an easement and right of way to
construct, lay, install, use, maintain, alter, add to,
repair, replace, inspect and/or remove, at any time and
from time to time, aerial and underground electric lines
and communication lines, consisting of poles, guys and
markers and other fixtures and appliances, for conveying
electric energy to be used for light, heat, power, telephone
and/or other related uses, in, on, over, under and through
that certain real property in the City of Santa Aha, County
of Orange, State of California, described as follows:
A strip of land, 10 feet in width, lying within the south-
east quarter of the northwest quarter of Section 24, Township
5 South, Range 10 West, S. B. B. & M.; the centerline of
said strip being described as follows:
Commencing at the northeast corner of said southeast quarter
of the northwest quarter of Section 24; thence along the
easterly line of said southeast quarter of the northwest
quarter of Section 24, southerly 42 feet; thence westerly
parallel with the northerly line of said southeast quarter
of the northwest quarter of Section 24, a distance of 40
feet to the True Point of Beginning of this description;
thence Northwesterly to a point located 185 feet westerly
and 27 feet southerly, measured at right angles respectively
from said easterly and northerly lines; thence westerly
parallel with said northerly line a distance of 55.94 feet.
BE IT FURTHER RESOLVED: That these proceedings are taken
subject to the reservations and exceptions next hereinabove set out.
BE IT FURTHER RESOLVED: That January 4th, 1965, at the hour
of 7:30 P.M., in the Council Chambers, City Hall, Third and Main
Streets, Santa Ana, California, is hereby fixed as the time and place
for hearing all persons interested in or objecting to said proposed
street vacation.
BE IT FURTHER RESOLVED: That Resolution 64-166 is hereby
rescinded and the Clerk of the Council is ordered to publish this
Resolution in the manner prescribed by law for the publication of
ordinances of the City, and the Director of Public Works is ordered
to post notices of street vacation conspicuously along the line of
said streets,stating the passage of this Resolution of Intention to
vacate and the time and place of hearing thereof. Said notices shall
be posted not more than 300 feet apart and at least three such notices
shall be so posted. Both publication and posting shall be completed
at least 10 days before the date of said hearing.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 7th day of December, 1964.
