The Board of Trustees of the City of Santa Aha, do ordain as follows: Section 1. That Ordinance No. 502 pertaining to the compensation of members of the Tire Department, that the same is hereby repealed. Section 2. The City Clerk shall cause this Ordinance to be published once in the "Evening Blade" a newspaper primted and published in the City of Santa Aha, and thereupon and there- after it shall take effect and be in force. The Board of Trustees of the Oity of Santa Aha,do ordain as follows: ~ Section 1. That there is hereby granted to the Souther~ Pacific Railroad Company, a corporation, and its assigns, the right to construct, operate and maintain a railroad spur track across the intersection of Minnie and Walnut Streets, in the City of Santa Aha,California, along and over the route described as follows: Beginning at a point on private property in the center line of the constructed main track of the Southern Pacific R.R.Co. between Walnut and Pine Streets in the Oity of Santa Ana,Oalifor- nia, said point being distant southeasterly 71 feet more or less measured along the aforesaid center line of main track from its intersection with the southerly line of Walnut Street; thence northwesterly along an irregular curve concave to the west 71.5 feet to its intersection with the aforesaid southerly line of Walnut Street, said point being distant easterly 70 feet more or less measured along the aforesaid southerly line of Walnut Street from the southeasterly corner of Walnut and Minnie Streets; thence northwesterly across the intersection of Walnut and Minnie Streets tangent to the last described curve 117.5 feet more or less to its intersection with the westerly line of aforesaid Minnie Street; said point being distant northerly 43 feet more or less seasured along the aforesaid westerly line of Minnie Street from the north- westerly corner of Minnie and Walnut Streets; thence continuing across private property 13 feet more or less to the beginning of a curve concave to the east; thence northwesterly along said last mentioned curve 92 feet more or less to its intersection with the southerly line of the east and west alley in Block B of Bailey's Addition between Evergreen and Minnie Streets, said point being distant westerly 43 feet more or less measured along the aforesaid southerly line of alley from its intersection with the westerly line of Minnie Street; thence continuing northwesterly along the last mentioned curve across the aforesaid alley 15 feet more or less to its intersection with the northerly line of the aforesaid alley, said point being distant westerly 4~ feet more or less measured along the aforesaid northerly line of alley from its intersection with the westerly line of Minnie Street; thence con- tinuing northwesterly along the last mentioned curve across the aforesaid alley 15 feet more or less to its intersection with the northerly line of the aforesaid alley; said point being distant 144 westerly 47 feet more or less measured along the aforesaid norths erly line of alley from its intersection with the westerly line of Minnie Street; thence continuing across private property along last mentioned curve 156 feet more or less to the end of track. Section 2. The said railroad spur track shall at all times conform as near as practicable to the official grads of said streets as now established or may hereafter be established and that the grantee of this franchise or its assigns shall at all times keep the roadbed flush with the streets and provided with good and suitable crossings and shall plank and macadamize the same between the rails and if the streets shall be paved then with the same material as the adjoining streets and for at least two feet on each side thereof whenever and wherever ordered by the Board of Trustees or other legislative body of said City so to do, and in the event of a failure to comply with the requirements hereof for ten days after notice so to do then the City will cause its Superintendent of Streets to proceed to construct the required work iff a good and substantial manner and the grantee of this franchise or its assigns by acceptance hereof agrees to pay the cost therefor within thirty days after the presentation of a bill for the same, and the gutters. upon said streets shall be so constructed upon said streets as to permit the passage of storm water along and under said track. Section 5. That within thirty days after the passage of this Ordinance the grantee or its assigns shall file with the City Clerk a written acceptance of this Ordinance and all of its terms, conditions and requirements. Section 4. That no train, engine or car on the spur track of said Con, any shall be left standing across said Minnie and Walnut Streets and that said Company will not obstruct said streets by any train, engine or car except when the same are in motion. Section ~. The City Clerk shall certify to the passage of this Ordinance and cause the same to be published once in the ? "Evening Blade" a newspaper published and circulated in said City. AN ORDINANCE ~EENDING ORDINANCE NO. 561, ~ND ADDING TWO NEW SECTIONS Nos. ~(a) and 4(b),AND GRANTING POWERS TO THE CENSOR CONMISSIONTO ENABLE SAID COMNISSION TO REQUIRE AND ENFORCE THE PRODUCTION OR EXHIBITION OF FILMS; SCENES;PICTURES; ILLUSTRA- TIONS OR DELINEATIONS ADVERTISED OR PROPOSED TO BE EXHIBITED TO PUBLIC AUDIENCES IN THE CITY OF SANTA ANA; CALIFORNIA. The Boexd of Trustees of the City of Santa Ana do ordain as follows: Section 1. That two new Sections shall be added to Ordinance No.561 to be known as Sections b(a) and b(b) and providing for the granting of power to the Censor Commission or smy member thereof to require and enforce the production or exhibition of pictures, films, illustrations or delineations advertised or proposed for public exhibition in the City of Santa Ana. Section b(a). Upon reasonable notice and demand by the unanimous vote of the censor commission, upon any person, firm or corporation, or their agent or employee, who shall undertake, advertise or propose to exhibit any picture, film, illustration, delineation, or other character to any public audience of the City of Santa Aha, the said person, firm or corporation by himself, itself, agents or employees, as the case may be, shall produce, run, show or exhibit for the said commission or any member thereof in whole or in p~rt, at the election of said commission any pic- ture, film, illustration or delineation or production of any chaxacter whatsoever, proposed to be exhibited, displayed or pro- duced to any public audience in the City of Santa Section 4(b) Upon failure or refusal of any person, firm or corporation or their agent or employee to produce or exhibit to said censor commission as provided in the preceding section any picture, film or production whatsoever then said censor com- mission is hereby empowered to prohibit or prevent the same from public exhibition. Section 2. The same penalty provided for in OrdinanceNo, 561, in Section 5 thereof'shall apply to fhe violation of any of the provisions of this Ordinance. Section 3. This Ordinance is deemed one of urgency for the immediate preservation of public peace, health, safety, and morality and shall take effect from and after its passage. Section b. The City Clerk shall cause this Ordinance to be published once in the "Evening Blade" a newspaper published and generally circulated in said City, and thereupon and there- after it shall take effect and be in force. An 0rdin~nce Defining the Boundaries of the General Fire Limits in the City of Santa Ana, and Amending Sections I and 21 of Ordinance No.342, and Repeeling any and all Ordinances in Conflict therewith. The Board of Trustees of the City of Santa Ana, do ordain as follows:- Section 1.- All that portion of the City of Santa Ana bounded and described as follows, to-wit:- Beginning at the point of intersection of the center line of East First Street and French Street, thence north along the center line of French Street tO its intersection with ths center line of East Third Street; thence east along the center line of East Third Street to its intersection with the center line of Mortimer Street produced southward, thence North along this center line of ~ortimer Street produced, and the center line of 2ortimer St., to its intersection with the center line of East Fifth Street, thence west along the center line of East Fifth Street, to its inter- section with the center line of French Street; thence north along the center line of French Street, to its intersection with East Sixth Street, thence west along the center line of East and West Sixth Street to its intsrsection with the center line of North Ross Street, thence south along the center line of North Ross Street, to its intersection with the center line of West First Street; thence east along the center line of West and East First Street to its in- tersection with the center line of French Street, the point of beginning. Section of buildings hereinafter erected within the fire limits of Dis trict No. I the general fire limits of the City of Santa Ana shall be made and constructed of brick or stone, or brick and stone or composition of cement and stone or cement applied to steel laths, and in case the said walls 8hall be constructed of one or more of above materials, the same shall the top of and through the roof of be constructed so as to thoroughly extend from the foundation to the building, and the same sha~l separate all woodwork from the exterior of such buildings and from all and every part of the ex- terior of any adjoining building and every such wall shall pass through the roof of the building to which it may appertain in such manner as to break entirely any communication with wood whatevsr between the roof of such building and any other building. Section 3.- All ordinances or parts of ordinances in conflict herewith are hereby repealed. (SEAL) by Visel, Not Voting, Trustee Greenleaf, I hereby certify that the foregoing Ordinance No.610, a full, true and correct copy of said Ordinance as passed the following vote: Ayes, Trustees Tubbs, McPhee, M~rymtt a~d and was published accord- lng to law. 150 ORDINANCE NO. 611, AN ORDINANCE PROHIBITING THE CARRYING OF CONCEALED WEAPONS AND PROVIDING FOR THE CONFISCATION OF THE Sk~E AND REPEALING ANY AND ALL LAWS IN CONFLICT THEREWITH; .AND PROVIDING A PENALTY FOR THE ENFORCEMENT OF THE SAME. The Board of Trustees of the City of Santa Ana do ordain as follows, to-wit:- Section 1.- It shall be unlawful for any person within the corporate limits of the City of Santa Ana, Orange County,California other than a duly elected or appointed peace officer, to carry concealed upon his person, or about his person, any revolver,pistol, dagger, dirk, slug or sling-shot, billy or other deadly weapon or instrument, without first having ootained a written permit from the City Marshal. Section 2.- The City Marshal of the said City may, in his discretion, issue permits to responsible persons to carry concealed weapons for a period of time not exceeding the term for which such Marshal shall have been elected. Section 3.- All permits issued by the City Marshal must be in writing and sig~ed by said Marshal, and a record thereof kept in the Marshal's office; such permit must contain the name, age,occupa- tion, residence, height, weight, and any visible scars or marks of identification, the color of the hair and eyes, of the person to whom such permit is issued, also the kind, make, number and calibre of the weapon desired to be carried. Section 4.- Every person desiring to obtain a permit from the marshal to carry any concealed weapon, referred to in section one (1) of this Ordinance, must file with the Marshal, a writtem application for t~e same, which application must be signed by the person making such application, and a record thereof preserved in the said Marshal's office; age, occupation, residence, or marks of. identification, said application must contain the name, height, weight, and any visible scars the color of the hair and eyes of the person making such application; also the kind or make, number and calibre of the weapon desired to be carried. Section 5.- Every person having a permit as provided for herein and who refuses to exhibit such permit upon demand of any peace officer of this City is guilty of a misdemeanor. Section 6.- Every person violating any of the provisions of thi~ Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine not exceeding two hundred dollars, or by imprisonment in the City Jail for a period not exceeding one hundred days, or by both such fine and imprison,- ment in th~ discretion of the Court. Section 7.- All concealed weapons found on persons vio- lating the provisions of this Ordinance, shall upon conviction of 15! said persons be confiscated, upon order of the Court in which said conviction has been had. Section S.- All ordinances or parts of'ordinances in conflict with this ordinance are hereby repealed. Section 9.- This ordinance being of urgent public necess- ity for the safety of the public welfare, shall be in force and effect after publication in the "Daily Bl~le", a newspaper of general circulation in the City of Santa Ana, Cal. AN ORDINANCE PROHIBITING AND REGULATING THE HOLDING OF PUBLIC MEETINGS IN THE PUBLIC PARES OF THE CITY OF SANTA ANA AND FIXING A PENALTY OR PENALTIES FOR THE ENFORCEMENT THEREO~ AND REPEALING OF ORDINANCES IN CONFLICT THEREWITH. The Board of Trustees of the City of Santa Ana, do ordain as follows: Section 1. That it shall be unlawful for any person, organiza- tion or association of persons to hold or undertake to hold any political meeting within any of the public parks of the City of Santa Aha, California, on the first day of the week generally known as Sunday. Section 2. It shall be unlawful for any person, organization or association of persons to hold or undertake to hold or take part in any public meeting in. any of the public parks of the City of Santa Ana without the said person or persons, organization or association of persons holding or attempting to hold said public meeting shall first have obtained permission of the Boand of Park Commissioners of the City of Santa Ana. Section 3. Any person or persons violating any of the pro- visions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed One Hundred ($100) Dollars, or be imprisoned in the City Jail for a period of time not to exceed fifty (50) days, or both said fine and imprisonment in the discretion of the Court. Section 4. All Ordinances or parts of Ordinances in conflict with this Ordinance or any part thereof s,re hereby to that extent repealed. An Ordinance toamend Ordinance No.602 of the City of Santa Aha, approved Sept. 8th, 1915, providing for the regulation of auto- mobiles for hire, and adding a new Section thereto to be known as Section 16A. The Board of Trustees of the City of SantaAna, do ordain as follows:- Section 1. That Ordinance No.602 of the City of Santa Ana, California, approved the gth day of September, 1915, shall be amended by adding a new section thereto to be known as Section 16A. Section 2. It shall be unlawful for any person, firm or corporation maintaining or operating an automobile for hire design- ated in the above named Ordinance No.602 as an "Auto car" to solicit upon the streets or in public places of the City of Santa Aha either by themselves, agents or employees or passengers for said auto oar. Section3. All Ordinances or parts of Ordinances of the City of Santa Ana in conflict with this Ordinance are to the extent that the same affects this Ordinance are hereby repealed. Section 4. The penalties provided in this Ordinance shall be governed by the provisions of Ordinance No.602 as therein provided. Section 5. The City Clerk shall certify to the passage of this Ordinance and cause the same to be published once in the "Evening Blade" a newspaper of general circulation in said City, and the same being of immediate and pressing public necessity in c~der to preserve the peace and quiet and order in the City of Santa Aha, the same shall take effect and be in force from the publication thereof a~ heretofore provided. An Ordinance granting to Pacific Electric Rail- way Company and its assigns the right to construct, maintain and operate a standard gauge double track curve connection between its double track railroad on Fourth Street in the City of Santa Ana, County of Orange, State of California, and the double track on Main Street in said City. The Board of Trustees of the City of Santa Ana do ordain as follows:- Section 1. That the right and privilege is hereby granted to Pacific Electric Railway Company, and its successors and assigns, to construct, maintain and operate, for the period of fifty (50) years, a standard gauge double track curve connec- tion between the double track railroad of Pacific Electric Rail- way Company on Fourth Street in the City of Santa Ana, County of Orange, State of California, and said Company's double track railroad line on Main Street in said City, said double track connection to extend over and across the northwesterly inter- section of said Main Street and Fourth Street, as shown in broken yellow lines on the blueprint attached to the application of Pacific Electric Railway Company for said permit, filed with the City Clerk of the City of Santa Ana on the lOth day of June, 1916, and marked H.977, to which map and plan reference is hereby made for further particulars. Section 2. The terms and conditions upon which said right and privileges are granted are as follows: 1. The railroad tracks constructed and operated under this right and privilege shall be used as a connecting track between the lines of the grantee Pacific Electric Railway Company on Main Street and on Fourth Street, in said City of Santa Aha. 2. That the tracks to be constructed and operated under this right shall be placed as near each other as a proper regard for safety will allow. Section 3. That said grantee, its sudcessors and assigns, shall use good material in the construction of said road, and the said road shall be built in a good and workmanlike manner; and the said grantee, its successors and assigns, shall at its or their expense, pave, gravel or macadamize the said road, between the tracks, and between the rails, and for two feet on each side thereof, where said road is constructed along or across said streets, with the same material used by the City and under the same specifications and in the same manner as upon the streets across which said road runs, respectively, and shall keep the same constantly paved, graveled or macadamized and in good repair and as near as possible on the grade with the streets; all repairs and grading on said street or streets where such road 156 or roadbed runs, to be done under the direction of and to the satisfaction of the Board of Trustees or the Superintendent of Streets of said City of Santa Aha, at the expense of the grantee of this franchise, its successors and assigns, In case the said grantee, its successors or assigns, shall fail to comply with the instructions given by the said Board of Trustees or said Superintendent of Streets in regard to such work, then the said Superintendent of Streets shall entor upon said street or streets and do the work as ordered by the Board of Trustees and said Superintendent of Streets shall keep an itemized account of said work which the g~antee hereof, its successors and assigns, by the acceptance of this franchise hereby agrees to pay, upon the presmntation of such account, to said grantee, its successors or assigns. Its or their cause for forfeiture of in case said roadbed or before provided. failure to do so shall be sufficient said right or privilege hereby granted, tracks are not kept in repair as herein- Provided further, ~hat the said grantee, its successors and assigns, shall construct all necessary flumes and culverts for the free passage of water under the tracks where the same naturally flows and that such flumes and culverts shall be con- structed in accordance with plans and specifications approved by the Board of Trustees. Provided further, that said grantee, its successors and assigns, shall have the right to excavate and remove portions of said streets, necessary to properly construct said road and to erect and install apparatus, turnouts,switches and other appliances,-poles and wires for carrying trolleypower, telephone and telegraph wires and other wires used by said grantee in the operation of said railroad. Provided further that said City,in granting said right and privilege, expressly reserves the right to pave, gravel, macadamize, renew or sewer any of said streets or to lay water, gas or other pipes therein or to erect telephone and telegraph and other wires over and across said road, said work to be done so as to injure said road as little as possible. That the further privilege, authority and right be and the same hereby is granted to the said grantee, its successors and assigns, to use electricity over said line of rail- road, to be constructed, operated and maintained and the privilege thereof, within the said City, for the purpose of propelling cars and trains on said railroad, or on its branches, or any portion thereof. Section 5- Provided further, that said grantee, its successors and assigns, shall at all times carry all regular and special policemen, police officers, firemen and letter-carriers while on duty, free, over said road, subject at all times to such reasonable regulations as said grantee, its successors or assigns, 157 may prescribe. An Ordinance Regulating the Sale of Bread and Establishing a Standard Weight thereof, in the City of Sa~ Ana County of Orange, State of California. The Board of Trusteesof the City of Santa Ana, do ordain as follows:- Section 1. The standard weight of all loaves of bread known as milk, or white, rye or graham, and made or pro- C~red for the purpose of sale, sold, offered for sale, or exposed for sale in the City of Santa Ana, State of California, shall be 12 ounces, avoidrupois net weight, when baked, or regular multiples of 12 ounces avoi~dupois net weight when baked. Section 2. It shall be unlawful for any person, firm or corporation, to make or procure for the purpose of sale, sell, offer or expose for sale, within the City of Santa Ana, State of California, bread, the loaf or loaves of which is or are, not of standard weight, as provided in Section i of this Ordinance. Section 3. Every person, firm or corporation, who~shall make or procure for the purpose of sale, sell, offer or expose for sale, any bread in said City of Santa Aha, whenever requested by a buyer of bread, shall, in the presence of said buyer, weigh the loaf,or loaves of bread. All inspections of the weight of bread Ahall be made on the premises of the maker or manufacturer and all weight of bread shall be determined by taking an average weight of not less than twenty loaves. Section 4. The provisions o£ this Ordinance shall not apply to crackers, pretzels, bisouit~, buns, scones, rolls or loaves of fancy bread, weighing less than 1/4 of a pound avoi:dupois to what is commo$ known as stale bread, sold as such; provided, or the seller, shall, at the time of sale,expressly state to the buyer that the bread so sold is stale bread. Section 5. Any person, firm or corporation, who shall violate any of the provisions of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall pay a fine of not less than ~lO,O0 or be imprisoned in the County Jail not more than 100 days. Section 6. If any section, sub-sections, sentence, clause or phrase of this Ordinance, is for any reason held to be unconstitutional such decision shall not affect the validity, of the remaining portions of this Ordinance in that the Board of Trustees of the City of Santa Ana, declares that it would have passed this Ordinance and each section, sentence, clause and phrase thereof irrespective of the fact that any one or more of the sections, sentences, clauses or phrases be declared unconstitutional. 162 Section 7.
