THREE PARCELS OF REAL PROPERTY ON THE SO~£H
SIDE OF EIGHTH STREET KNOWN AND NUMBERED AS
1136-38, 1146, AND 1232 WEST EIGHTH STREET
WHEREAS, the continuing increase in traffic volume in down-
town Santa Ana and the rapid expansion of the Civic Center area
of the City has made it necessary to provide for increased east-
west flow on Eighth Street by the widening of Eighth Street between
the Community Center area and Bristol Street; and
WHEREAS, it has become necessary to acquire rights of way
for public street purposes through and across certain properties
before Eighth Street can be widened to provide for the present and
prospective traffic demands in the area.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Ana hereby finds, determines and declares that
public interest and necessity require that Eighth Street be widened
and further require that said City have and acquire for street
purposes fee simple title to that certain land necessary to said
widening; that as to each of the three parcels herein described the
new street right of way line will run through the existing residential
structure so that said structure will have to be demolished or moved,
and that as to Parcel 3 herein described the real property remaining
outside of the street right of way line will contain so few square
feet of property and will be of such shape as to be unuseable as a
building site and the City Council further finds, determines and
declares that public interest and necessity require the acquisition
in each case of the entire parcel of real property; that said real
property is in the City of Santa Ana, County of Orange, State of
California, and is described as:
PARCEL 1:
That portion of Lot 2 of Tract No. 33, in the City of
Santa Ana, as shown on a map thereof recorded in Book 9,
Page 31, Miscellaneous Maps, records of said Orange
County, bounded and described as follows:
Beginning at a point in the southerly line of Eighth
Street (formerly Hickey Street), distant thereon 250 feet
easterly from the easterly line of Bristol Street, as
shown on said map, (said point also being distant 240
feet easterly from the easterly line of the strip of land,
10 feet wide, granted to the City of Santa Ana, for
street purposes, by deed dated December 27, 1923, and
filed May 26, 1924, as document No. 4737, in the office
of the Registrar of Titles of said Orange County); running
thence south 120 feet; thence east 50 feet; thence north
120 feet to said southerly line of Eighth Street; thence
westerly along said line of Eighth Street, 50 feet to
the point of beginning.
PARCEL 2:
Beginning at a point 200.50 feet east of the intersection
of the centerlines of Baker and Eighth Streets; thence
south 165 feet; thence east 53 feet; thence north 155
feet; thence west 53 feet to the point of beginning.
PARCEL 2A:
PARCEL 3:
The west 2 feet of Lots 9 and 10 of J. W. Birt's
Subdivision, as shown on a map thereof, recorded in Book
3, Page 45, Miscellaneous Maps, records of said Orange
County.
Lot 10 and the north 5 feet of Lot 9 of J. W. Birt's
Subdivision, as shown on a map thereof, recorded in
Book 3, Page 4~, Miscellaneous Maps, records of said
Orange County.
EXCEPTING THEREFRO.~I the West 2 feet.
BE IT FURTHER RESOLVED:
1. %~at the City Attorney is hereby ordered to bring an
action in the name of the City to condemn said property necessary
to be taken and to do all things necessary to prosecute said action
to final determination;
2. That public interest, necessity and convenience require
and it is hereby ordered that said City take immediate possession
and use of the property herein ordered to be acquired upon compliance
with the requirements of law applicable thereto as a right of way for
public use;
3. 'I~at said public improvement is planned and located in a
manner which will be most compatible With the greatest public good
and the least private injury;
4. 'i~nat the City of Santa Aha, a municipal corporation, is
authorized and empowered to provide for the opening, extension,
widening, construction and maintenance of public streets and highways
within the City;
5. rfhat said action in condemnation shall be taken in
accordance with the provisions of the Code of Civil Procedure and
the Constitution of the State of California relating to eminent
domain.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 15th day of February, 1965.
