Santa Aha, commonly That open public street in the City of known as and called West Pine Street, is hereby accepted as and declared to be an open public street of the City of Santa Aha, and nmmed, West Pine Street. It having been determined and declared by Resolution No. 759 of the City of Santa Ana, passed by the vote of two-thirds ~nd more of all the members of the Board of Trustees of said City, as the legislative branch thereof, that the public interest and also the public necessity demands the construction by the City of Santa Ana, Jointly with the City of Anaheim, a municipal corporatbn, of a municipal improvement, being a Joint outfall sewer, consisting of the acquisition of sufficient la,nd at or in the immediate vicinity of the East quarter cornsr of Section 32, Township 5 South, Range l0 West, S.B.B.&I~., to be used as a sewer treatment site, upon which to construct a sewer treatment plant, also the acquisition of all necesssmy materials, apparatus, appliances, machinery and equipment with which to construct and the construction on the sewer treatment site of a sewer treatment plant, adequate for the reception of audfor the proper, sufficient, and scientific treat- me~t of-sewage, also the acquisition of the necessary right of way extending from the sewer treatment site in a southerly direction approximately 23,750 feet to the Pacific Ocs-an, upon which to con- struct a sewer pipeline, arid also the acquisition of approximately 23,750 feet of 36-inch internal diameter sewer pipe, and tls necessary materials and equipment with which to construct and the construction on the right of way arid connected w~th the sewer treatment plant of a sufficient and adequate sewer pipeline, with proper manholes, outlets, and ~pplianoes for the transmission of sewage from the sewer treatment plant to, ~ud the discharge there- of in the waters of the Pacific Ocean, in order to carry out the objects, purposes a~ud powers of the City of Santa Aha, and the cost thereof, ~ud the proportion of thc cost Zhercof to be paid by the City of Santa Ana will be too great to be paid out of the ordinary annual income and revenue of t e City of Sants~ Aha. It is hereby further determ2ned ~nd declared that the Board of Trustees of the City of Santa Aha propose to incur a bonded debt 'and to issue ~ud sell the bonds of the City of Santa An~ to pay the proportionate part of the cost of said municipal improw~ment, to wit: said joint outfall sewer, required to be paid by the City of Santa ;~ua. (The use hereinafter in this "Joint outfall sewer" means s~ _.~ Or~dinance of the phrase at all times be construed to mean the municipal improvement set forth in Resolution No, 759, and in this Section described.) The objects and purposes for which the indebtedness is 366 proposed to be incurred is tc pay the p~oportionate part of the estimated cost of the construction of the joint outfall sever required to be paid by the city of Sancta Ana, as pro- vided for by the terms and provisions of a joint agreement authorizing and providing for the joint construction of a Joint outfall sewer by the city of Santa Aha and the city of Anaheim, municipal corporations, and in order tc furnish mud provide the city of Santa Aha with adequate facilities and means for the reception, treatment, and disposal of thc sewage accumulating in the city of Santa Aha, for the proper amnitation thereof. The cost of the joint outfall sewsr is estimated to be the sum of $240,000.00 arid thc proportionate part thereof to be paid by the city of Santa Aha is the s~um of $172,O00.00, and the amount of the principal of the indebtedness to be in- curred therefor by the city of Santa Aha is the sum of $172,000.00, which sum is and will be too g~eat to be p~id out of the ordinary aunual income and revenue of the city of Santa Aua. ~e maximum rate 'of interest to be paid on such in- debtedness is hereby fixed at five per cent per annum, payable semi-annually, which rate of interest shall not be exceeded in the issuance of bonds for such indebtedness. Section 2. It having been determinod and declared by Resolution No. 75~ of the city of Santa Aha, passed by the vote of two-thirds and more 0£ all the members of the Board of Trustees of said city, the legislative br~anch thereof, that the public interest mud also the public necessity demands the construction by the city of Santa Aha of a municipal improvement, being two main sewer pipelines other and different from the sewer pipeline described in Section I cf this Ordinance, and consisting of the acquisition of the necessary right of way upon which to construct a main sewer pipeline, extending southerly from West Fifth Street at a point thereon approximately 200 feet east of the' center line of Hawley Street, public streets in said city, to the southerly boundary line of the city of Santa Aha, a distance of approxi- mately 30~00 feet, thence southerly to the public highway known as Edinger Street; thence westerly to the public highway known as 01d Newport Roo~cl$ thence southwesterly to a Junction place at or near the termination of the public highway known as Delhi Road in 01d Not, port Road, a distance of approximately ~300 feet; also the acquisition of the necessary right of way upon which tc construct a main sewer pipeline, extending from the intersection of Edinger and South Bristol Streets south to the septic t~.k now constructed and existing on South 367 Bristol Street; thence west and southwesterly to ed junction place at or nea~ tbs termini of Delhi port Road, a distamce cf approximately 5400 feet; the above mention- Road in Old New- thence south- westerly from the Junction place to a point at or in the immediate vicinity of the east quarter corner of Section 32, Township 5 South, Range l0 West, S.B.B.& M., m distance o£ ~pproximmtely 13,400 feet; also the acquisition of a~'proximately 2600 feet of 12-inch internal diameter sewer pipe, 8~00 feet of 2~-inch internal diaznetsr sewer pipe, 10,600 feet to 20-inch internal diameter sew~ pipe, 13,400 feet of 2~-inch inte~rnal dian~.eter Sewer pipe, and the necessary equipment mud material with which to construct and the construction on ~e rights of way of sufficient and adequate main sewer pipelines with proper manholes, outlets, and appliances for the transmission of sewage, in order to carry out th~ objects, purposss az~d powers cf the city of Santa Aha, and the cost thereof ~ill be too great to be pai~ out of the ordinary annual income and revenue of the city of Sautm &ua. The cost of the main sewer pipelines is estimated to be $14~,~000.O0, an.d the amount of the principal of the indebtedness to be inct~rred therefor is the sum of $149,000.00, which sum is and will be too gre~t to be paid out of the ordinary annual income and revenue of the city of Santa Aha. The maximum rate of interest to bc paid on s.uch indebted- ness is hereby fixed at five per cent per annum, payable semi- anhually, which rate of interest shall not be exceeded in the issuance of bonds for such indebtedness. Section 3. It having been determined and declared by R~solution No. t~.~ vote of two-thirds and 75~ of the c~ty of Santa Aha, passed by ¥~ more Of all the members of the Board of Trustees of said city, as the legislative bred. ch thereof, thet the public interest azff also the ptfOlio necessity demands the construction by the city of Santa Aha of ~ mtuuicipal improve~ent, power plant, consisting of the power water tube boilers, condensing steam engines, power electric generators, being ~n electric light and acquisition of two 200 hor~e- two 175 horsepower cross compound directly connected with two 175 horse- one electric switchboard, approxi- mately six miles of electric transmission line, together with the necessary apparatus, appliances, equipment, machinery, and poles with which to construct and install and the construction and inst~llation of two electric generating units and transmission line, with which to generate and transmit electric auergy for lighting the public streets, buildings and places of the city of Santa Aha, and operating the pumps of the water system thereof, in order to carry out the objects, purposes and powers of the city of Santa Ana, and the cost thereof will be too g~eat to be paid out of the ordinary annual income and revenue of the city of Santa. Aha. (The use hereinafter in this Ordinance of the words or phrase "electric light and power plant" is intended to mean and shall at all times be construed .to mean the municipal improvement described in this Section ar.d set forth in Resolution No. 759.) It is hereby further determined and declared that the Board of Trustees of th~ city of Santa Aha propose to incur a bond- ed debt and to issue and sell the bonds of the city of Santa Aha to pay the cost of said municipal improver~ent, to-wit: said electric light and power plant. The objects and purposes for which the indebtedneas is proposed to be incurred is to pay the cost of the construction of t~e electric light and power plant in order to furnish and pro- vide the city of Santa Ana with adequate facilities and means for the generation and transmission of electric energy with which to light the public streets, buildings, and places in and of the city of Santa Aha, and tc operate the pm~ps of the water system thereof. The cost of the electric light and power plant is esti- mated to be $75,000.00, and the ~ount of the principal of the indebtedness to be incurred therefor is the sum of $~5,000.00, which sum is and will be t~.o great tc be paid cut of tls ordinary annual inc~me and revenue of thc city of Santa Aha. It having been determined and declared by Resolution No. ~5~ of the city of Santa Anm, p~ssed by the vote of two-thirds and more of all the members of the Board of Trustees of said city, ,,,J 369 as the legislative branch thereof, that the public interest and also the public necessity demands the construction by the Oity of Santa Aha of a municipal improvement, being street work, con- sisting of the p~ving of or portion of West Fifth Street, an open public street in the City of Santa Ana, from the place of its intersection by Baker Street west to the westerly boundary of the city of Santa Ana, with an adequate concrete base overlaid and finished with an asphaltic concrete top or ~-~earing surface, and the construction in and across West Fifth Street at a point there- on approximately 42.5 feet west of the center Line of English Street of one concrete twin culvert, in order to carry out the objects, purposes and powers of the city of Santa Aha, and the cost thereof will be too great to be ?.ai~% out of the ordinary annual income and revenue of the city of Santa Ana~ (The uss hereinafter in this Ordinance of the words or phrase "West Fifth Street paving and culvert" is intended to mean and sl%all at all times be construed to mean the municipal improve- ment described in this Section and set forth in Resolution It is hereby f'u~rther determined and declared that the Board of Trustees of the city of Santa Aha propose to incur a bond- ed debt and to issue a~ud sell the bonds of the city of Santa Aha to~ pmy the~cost of said municipal improv.~ment, to-wit: said West Fifth Street paving and culvert. The objects ~nd purposes for which the indebtedness is proposed to be incurred is to pay the cost of the construction of the West Fifth Street paving and culvert in order to make West Fifth Street, a public street in the city of Santa Aha, safe, adequate and convenient for public travel. The cost of the West Fifth Street paving a~..d culvert is estim~ted to be $22,000.00, a~d the a~ount of the principal of the indebtedness to be incurred therefor is the sum cf $22,000.00, which su~ is and will be too great to be paid out of the ordinary annual inoo~ue arid revenue of the city cf Santa Aha. The maximum rate of interest to be paid on such indebt- edness is hereby fixed at five per cent. per annum, payable semi- annually, which rate of interest shall not be exceeded in the is- suance of bonds for such indebte&~ess. It having been determined and declared by Resolution No. ~59 of the city of Santa Aha, passed by the vote of t~o-thirds and more of all the members of the Board of Trustees of said city, as the legislative branch thereof, that the public interest a~d also the public necessity demands tls construction by the city of Santa Aha of a municipal! improvement, being street work, consisting of the paving of ~ portion of' West Seventeenth Street, street in the city of Santa Aua, frown the place of an open public its interseotiqn.. 370 by the extended center line of Ross Street west to the westerly boundary of the city of Santa An~, with -an ~dequate concrete b~e overlaid ar.d finished with an asphaltic concrete top or wearing surface, in order to carry out the objects, purposes a.ud powers of the city of Santa Aha, a~ud the cost thereof will be too great to be pmid out of the ordinary annual income and revenue of the city of Santa Aha. (The use hereinafter in this Crdinance of the words or phrase "West Seventeenth Street paving" is intended to mean and shall at all times be construed to mean the municipal improvement described in this Section and set forth in Resolution No. ?59.) The maximum rate of interest to be paid on such indebted- ness is hereby fixed at five per cent. per ~nnum, payable semi- annually, which rate of interest shall not be exceeded in the is- suance of bonds for such indebtedness. Section 6. It having been determined and decls-red by Resolution No, ~59 of the city of Santa An~, passed by the vote of two-thirds and more of all the members of the Board of Trustees of said city, as the legislative branch thereof, that the public interest and also the public necessity demands the construction by the city of Santa Aha of a municipal improvement, being a fire engine house, consist- ing of the acquisition of the necessary land in the easterly psurt of the city.of Santa Aha upon which to construct a fire engine house the acquisition of the necessary material, apparatus, and appliances with which to construct and the construction on said land of a fire engine house, equipped and connected with the fire alarm system of the city of Santa Ana, in order to c-~rry out the objects, purposes, and powers of the city cf Santa Ana, and the cost thereof will be too great to be paid out cf the ordinary annual income ~ud revenue of the city of Santa Aha. 371 (The use hereinafter in this Ordinance of the words or phrase "Fire Engine House" is intended to mean and shall at all times be co~strued to mesh the municipal improvement described in this Section and set forth in Resolution No. 759.) It is hereby further determined and declared that the Board of Trustees of the city of Santa Aha proposed to incur a bond- ed debt anl to issue ~ud sell t~e bonds of the city of Santa Ana to pay the cost of said municipal improve~ent, to-wit: said fire engine house. The objects and purposes for which the indebtedness is proposed to be incurred is to pay the cost of the construction of the fire engine house, in order to furnish and provide the city of Santa Aaa with adequate facilities for housing its fire apparatus, used in the extinguishment of fire. The cost of the fire engine house is estimated to be $1~,O00.00, and the amo~unt of the principal of the indebtedness to be incurred therefor is the sum of $12,000.00, which s~n is and will be too great to be paid out of the ordinary a~unual income suud revenue of the city of Santa Aaa. The maximum rate of interest to be paid on such indebted- ness is hereby fixed at five per cent. per annum, payable semi- annually, which rate of interest shall not be exceeded in the is- suance of bonds for such indebtedness, Section ~. (The use hereinafter in this Ordinance of the words or phrase "Birch Park Improvement" is intended to mean and sha].l mt all times be construed to mean the municipal improvements dewcribed in this Section mud set forth in Resolution No. 75~o.) It is hereby further determined and declared that the Board of T~-ustees cf t:~e city of Santa Aua propose to incur a bond- ed debt and to issue ~:d sell the bonds of the city of Santa Aha to pay the c~t of said municipal improvs.~:cnt, to-wit: Birch Park Improvement. 372 The objects and pub-poses for which the indebtedness is proposed to be incurred is to pay the cost of the construction of the Birch Park Improv~r,~ent, in order .to properly light Birch Park, care for the lawns therein, construct proper side- walks, a~d to beautify thc grounds thereof, and prepare a place for keeping the tools used by workmen in the meinten~nce thereof. The cost of the ~irch P~k imprc.¥en.3nt ~is estimated to be ~lO,0OO.OO, and the amount of the principal of the indebtedness tc be incubated therefor is the su~ of $10,OO0.00, which su~ is and will be too great to be paid out of the ordinary annual income ~d revenue of the city of Sant~ Aha. The maximum rate of interest to be paid on such indebt- ed_ness ia hereby fixed at five per cent. per annum, payable semi- annually, which r~te of interest eh'al! not be exceeded in the issuances Of bonds for such indebtedness. Section g.~ The Board of' Trustees of the city of Santa Ana hereby orders %he submission of the several mbove stated propositions of incurring bonded indebtedness by the city of Santa Aha, for the several purposes, and in the several amounts of the principal of indebtedness to be incua-red therefor, as set forth in said Resolution Ho. 75~, aud in this Ordinance hereinbefore recited, described, and stated, to the qualified voters of the city of Santa Aha, and for th:~t purpose an election is hereby called end ordered to be held mt and within ~hc city of Santa Aha on Tuesday, thc 4th day o:~ April, 1922, which day is hereby fixed as the date on which said election shall be held, and the said election shall be a special election. Section ~o. .. At the special election called, or?ered to be held, and provided for by Section 8 of this Ordinance, there sh~ll be is hereby submitted to the qualified voters of the city of Santa An&, the several propositions of inou_rring bonded indebtedness by the city of Santa Anm, for thc several purposes, and in the sever?~l amounts of the principal of the indebtedness to be in- curred, as set forth in said Resolution No. ~5~, and as in this Ordinance hereinbefore ~eoited, described eJ~d stated. Section lO. ?ne manner of holding such special election and the voting for o~ against incurring said indebtedness shall be as fol lows: The several propositions of incurring bonded indebted- ness by the city of Santa Aha shall be submitted to the qualified voters thereof by printed ballot. On said ballot the several purposes together with the amount cf the principal of the indebtedness to be incurred for such purpose shall be separately st,.ted, each as ~ distinct proposition. 373 The ballots used at said special election, except as other- wise provided for in this Ordinance, shall be prepared, printed, furnished, md distributed as provided by law for preparing, print- ing, furnishing and distributing ballots at municipal elections in the city of Santa Ar.a. E~ch ballot shall have printed on the top of thc face thereof the following: MINICIPAL TICKET BOND ELECTION CITY OF S~SITA A~A. INSTRUCTIOI{S TO VOTERS: To vote in favor of any pro- position stamp a cross (x) in the voting square at the right of the word "YES" following the proposition to be voted upon. In the transportation of persons by automobile busses under this franchise, the maximum fare to be charged, demanded, or received, of or from any person, for any one trip or carriage, the actual length of which'does not exceed one and one-half (1½) miles, shall be five (5) cents, and not to exceed five (5) cents for each additional one and one-half miles or fraction thereof. The City of Santa Ana reserves the right'and shall have full power~and authority to hereafter divide the City into zones, and to alter s~ch zones, for the purpose of this franchise and fix the rate of transportation therein, not'less, how- (lw) miles ever, than five (5) cents for each one and one-half of travel or fraction thereof. No automobile bus shall be operated uuder this franchise or transport any person therein until there shall have been provided for, and legally applicable to such automobile bus, a contract of liability, indemnity, or insurance, executed by the principal and at least two sureties, or a solvent surety como~.ny, legally authorized to write and transact that character of business in the State of California, approved by the Board of Trustees of the city of Santa Aha, in the sum of ~10,000.00 on each automobile bus. Such contracts may be a separate one on each bus, or a general contract appllcab]e to all automobile busses used. Each and every one of said contracts shall be in t~e form and contain the conditions, provisions, and substance required by the Board of Trustees, and shall provide for the payment to any and all persons who, as a passenger on a bus to which the same is applicable, may be injured or damaged through or on account 385 of the wrongful act, fault, or neglect of the holder of the franchise or person operating automobile busses under it, or of their agents, servants or employees, or to the heirs of any person who may be killed through any such wrongful act, fault, or negligence. All such contracts, when approved by the Board of Trustees, shall be delivered to and filed with the Clerk of the city of Santa And. Section 8. accommodations to the public for service The grantee, its successors and assigns operating automobile busses under the franchise, shall desist from operating the same upon and along any street or streets during the time such streets are used or about to be used for the purpose of a public parade, exhibition, or entertslnment, or closed for construction or repair, upon request in writing, signed by the President of the Board of Trustees, designating the streets and the time during which they are to be so used or closed. Section 9. Every automobile bus operated in the use of this francblse shall be of a substantial character, modern in design, and be kept in a clean, sightly and safe condition to operate. The Board of Trustees of the City of Santa Aha reserves. the right and shall have full ~ower and authority to prescribe and from time to time change the design, character and capacity of any automobile bus used in the operation of this franchise, provided that no automobile bus which, at the time it is out in service, complies w~th the requirements of this franchise, and with the orders and regulations of the Board of Trustees of the City of Santa And made concerning the same, shall be thereafter required to be changed during the life of such automobile bus. The exercise of the authority herein ~eserved by the 386 City of Santa Ana shall never be construed as creating any liability on its part for injury or damage to person or property on account of the use of automobile busses, the character or condition of which was ordered orprescribed by it. Section 10. assigns, must and shall, pay to the City of Santa The grantee, its successors or during the life of this franchise, Ana two per cent. (2~) of the gross annual receipts arising from its use, operation, or possession, the same.to be paid annually; provided, however, that no percentage shall be required or paid for the first five (5) years succeeding the date of this franchise. Six (6) years from the date of the passage of this Ordinance, the grantee, its successors or assigns, shall file with the Clerk of the City of Santa Aha a verifie~ statement showing the gross receipts arising from the use and operation of this franchise during the preceding year, and pay to the 6ity of Santa Ana two per cent of the amount of the gross receipts shown by said statement, and a like statement of annual gross receipts shall be filed and a payment of two per cent thereof shall be made each year thereafter during the life of this franchise. The Board of Trustees shall have the right, power and authority to cause an examination of the books and records of the grantee, its successors o~ assigns, to be made in order to ascertain the true amount of gross annual receipts arising from the operation of the franchise, and all suc~ books and records shall be exhibited to an authorized aUditor of the City of Santa Ana on demand. Section ll. ~o sale, assignment or lease of this franchise shall be valid or binding upon'the City of Santa Ana, or recognized by said Gity, until notice thereof in writing has been filed with the Clerk .of the City of Santa Aha, showing the date of such sale, assignment, or lease, the correct name and address of the person, natural or artificial, to whom th~ sale, assignment, or lease is made, and the terms thereof. No person other than Pacific Electric Land Com- pany shall possess, use or enjoy this franchise or exer- cise any right under it until the notice above provided for is filed. The person named as purchased, assignee, or lessee, in such notice shall, for all of the purposes of this franchise, be considered the holder thereof, and the service of any and all notices required by this Ordinm ce or by law to be served upon the holder of this franchise shall be deemed complete, when deposited in 38? the United States postoffice at the city of Santa Ana~ postage prepaid, addressed to such person at the address given in the said not,ce. Section 12. The operation of automobile busses under this franchise shall be commenced in good faith within not more than four months from the date of the passage of this ordinance and if not so cormmenced the franchise herein granted shall be declare5 forfeited. Section 13. This franchise is granted upon the express condition that if the grantee, its successors or assigns, shall neglect, fail or refuee to promptly and faithfully comply with all of the tezTas, provisions, conditions, and requirements of this Ordinance granting the franchise, or such ordinance or ordi- nances, orders, rules, and regulations as may be hereafter passed or adopted by the city of Santa Aha concerning the use ~nd operation of this franchise, then the franchise shall be for- feited, and all persons wholly and immediately excluded from the use, occupation and enjoyment thereof. That it shall be unlawful for any person, firm or corporation to maintain any hotel, inn, or lodging house containing ten or more guest rooms, and not provided with hydrant and fire hose as provided in the preceding paragraph of this Section of the above Ordinance, shall at all times keep, place and maintain convenient and accessible and in proper condition for immediate use, subject at all times to the app,-oval of the Chief of the Fire Department or his assistant, one or more chemical fire extinguishers of two and one-half gallon tank type and of standard ~ake. Section 3. The number of said fire extinguishers herein provided for shall be in proportion' to the number of guest' rooms of the aforesaid hotel,' lodging house or inn, as follows: one fire extinguisher for each ten guest rooms or more up to the number of fifteen, which number shall require two fire extinguishers and one fire extin~ guisher for each ten additional rooms thereafter. Section 4. Any person, firm or corporation violating the provisions of this Ordinance shall be guilty of a mis- demeanor and upon conviction shall be punished by a fine not exceeding $50.00 or imprisoned in the City Jail for ten days or both said fine and imprisonment at the discretion of the Court. AN OrdINANCE RELATING TO ~E APPOINTING AND QUALIFICATION OF A POUND-KEEPER PRESCRIBING ~IS POWERS, DUTIES AND COMPENSATION AND THE ACCOUNTING OF FFES COLLECTED BY HIM AND ~E DISPOSITION OF SANE. The Board of Trustees of the City of Santa Ana do ordain as follows: Section 1. A City Pound-keeper shall be appointed by the Board of Trustees and he shall take and have charge of the City Pound, and shall furnish metal tags for dogs registered to the person owning or controlling the same upon paying the fees therefor; he shall take and impound all animals found at large upon any street, sidewalk, lane, alley or other public or uninclosed place, within the City of Santa Aha. Section 2. The City Pound-keeper shall execute a bond to the City of Santa Aha, in the penal sum of one thousand (~1,000.00) with such security or securities as shall be aperoved by the Board of Trustees for t~e faithful perfo~uance of his duties and shall hold his office and receive the compen- sation for such time and in s~ch amount and shall discharge such duties as in this or other Ordinances from time to ti'.e provided. Section 3. Ail persons owning, or having charge of or harboring any dog shall be subject to the provisions of this Ordinance in respect to dogs and it shall be the duty of the pound-keeper to register'once, every 1~ months, in a book kept for that purpose all dogs, in the city of Santa Aha, charging and collecting therefor the s~ of ~8.e0 for males and ~3.00 for femal§s: such owners or eersons harboring or ~aving charge thereof upon the eayment of such fees' the pound master shall enter in such dog re~tster book a descrfntion sufficient to identify such dog with name of owner and number and date of registration and he shall then deliver to the person making such payTnent a metal tag with the number and date thereof stamped or cut thereon and the word "Dog Tag" stamped thereon and such tag while attached to the collar upon the neck of such dog and in charge of its owner, or bis employee shall exempt said dog from impounding for 12 months from such date, except as provided herein for vicious or dangerous dogs, unmuzzled. Any aminal found trespassing upon any pri- vate enclosure in said corporate limits may be taken up by the party owning such enclosure or by his agents and committed t~ the pound-keeper who shall hold the same subject to a reason- damages in addition to~e fee prescribed by able demand for this Ordinance. All animals herein specified in this Ordinance required to be destroyed shall be cremated or other- wise disposed of by the pound-keeper in a manner to be approved by the Board of Trustees and without expense to the City. There ~hall be no building permit issued for the erection, construction or establishment of any building, structure or improvement in any of said Dis- tn!ets contrary to the provisions of this Ordinance: and every a~pllcation for a building pe~uit shall state there- in the use, heighth and area of the buildln~ applied for. Ordinance No. ?02 An Ordinance of the City of Santa ~ns, a city containing a population of more than 3500 i~habizants, as ascertained by the last preceding census taken under the authority of the Congress of the United States, calling a special election with the verified petition of Fore than fifteen per cent of the registered elect- ors of the said city for the ~urpose of choosing by the electors of said city abo~d of fifteen (15) free- holders to form a charter for the government of the City of Santa Aaa, fixing the date of such election and providing for the holding t}~ereof. The Board of Trustees of the City of Santa ~na do ordain as follows:- Section 1. A petition, signed by more than fifteen percent of the r~gistered electors of the City of ~anta An~, being presented to this, the legislative body of said city and being duly verified by the authority h~ving charge of the registration records of said city, and said city of Santa Aaa, having a poF~lation of more than 3500 in- habitants as ascertained by the last preceding census taken under the authority of t~e Congress of the United States; it is hereby ordered that a Board of fifteen (15) freeholders be chosen by the electors of said city to frame a charter for the government of said City of Santa Aaa. Section 2. No person shall be eligible as a candidate for such Board of Freeholders unless he or she shall have been for the five years next preceding an elector of the city of Santa Aaa. Section 3. For the purpose of choosing said Board of fifteen (15) freeholders, a special election is hereby called and ordered to be held at and within the City of Santa Ana~ on Tuesday, the 9th day of January, 1923. Section 4. Candidates for the office of freeholder shall be nominated either as is provided for the nomination of officers of the City of Santa Aaa, or by petition sub- stantially in the same manner as is provided by general law for the nomination by petition of electors of candidates for public office to be voted for at general election. Section 5. The Board of Freeholders shall, within one hnndred twenty (12a) days after the res~lt of the special election called and ordered to be held by Section 3 of this Ordinance, prerare and propose a charter for the government of the City of Santa Ans, unless said period of one hundred twenty (120) days is, with the consent of the Board of Trustees of the City of Santa Aha, as the legislative body thereof, extended, pro- vided that no extension shall exceed a total of sixty (60) days. ~ The Board of Freeholders selected at said special election shall proceed as provided for, and at all times be governed by, Section 8 of Article XI. of the Consti- tution of the State of California. -~ Section 6. ] The said special election being one of the elections provided for by Sec. 1044 of tt~e Political Code of the State of C~ifornia, the same shall be held as provided by said Section. Section V. For the purpose of holding said special election, the City of Santa ~na is he~eby snbdivided into ten special election precincts, and for that purpose the election precincts of~and~in the City of Santa ~na, now existing, are hereby consolidated into ten special election precincts, provided, that not exceeding six of said exist- ing precincts are or shall be consolidated into one I special election precinct. The ten special election precincts, so established, are hereby consecutively number- ed as special election precincts Nos. 1-2-3-4-5-6-V-8-9-10. Section 8.
