HomeMy WebLinkAbout65-078RESOLUTION 65-78 AUTHORIZING CONDF24NATION FOR PARK PURPOSES, AUTHORIZING CONDEMNATION OF AN EASF24ENT FOR STREET PURPOSES, AND AMENDING RESOLUTION 64-98 WHEREAS, the rapid population growth of the City of Santa Ana makes it necessary that additional parks be established within the City and that Edinger Avenue be opened westerly of Standard Avenue to Maple Street to accOmmodate the increasing demands of vehicular traffic. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby find and declare that public interest and necessity require the acquisition of land for public park purposes; that fee title be acquired for said park site; and further require that the City do have and acquire, in fee, that certain land in the City of Santa Ana, County of Orange, State of California, described as: PARCEL 1: That portion of the land allotted to F. W. Koll in Decree of Partition of the Rancho Santiago de Santa Ana, recorded in Book B of Judgments of the 17th Judicial District Court of California, described as follows: Beginning at a point distant South 89° 15' 09" West 546.60 feet and South 0° 34' 10" West 1320.01 feet from the center line intersection of Standard Avenue and McFadden Avenue, said point being the Northwesterly corner of land described in a deed to the City of Santa Aha, recorded July 25, 1955, in Book 3150, page 217 of Official Records; thence South 0° 37' 15" West 1127.70 feet to the South- westerly corner of said land of the City of Santa Ana; thence North 89° 22' 45" West 270.00 feet along the Westerly prolongation of the Southerly line of said land of the City of Santa Ana to the Westerly line of land described in deed to A. H. Lyon recorded January 4, 1919 in Book 313, page 257 of Deeds; thence North 0° 37' 15" East 1121.26 feet along said Westerly line to the Southerly line of Tract No. 2626, as shown on Map recorded in Book 86, pages 6, 7 and 8 of Miscellaneous Maps, records of Orange County, California; thence North 89~ 15' 09" East 270.08 feet along said Southerly line to the point of beginning. EXCEPTING THEREFROM the southerly 28.00 feet. BE IT FURTHER RESOLVED: That the City Council of the City of Santa Ana does hereby find and declare that public interest and necessity require the acquisition of an easement for street purposes for the location of paving and/or sewer and water line and all other purposes of a public street in through and over that certain land in the City of Santa Ana, County of Orange, State of California, described as: PARCEL 2: An easement for street purposes over a strip of land 56.00 feet in width, the center line of which is described as follows: Commencing at the Southeast corner of Tract 266, as shown on a map thereof recorded in Book 13 at page 39, Miscel- laneous Maps, Records of Orange County, California, and running thence South 89~ 19' 03" East along the Easterly extension of the center line of Edinger Avenue 40.00 feet to the Easterly line of the Pacific Electric Railway Company right of way and to the true point of beginning; thence South 89~ 19' 03" East 35.73 feet to the beginning of a tangent curve concave Southerly having a radius of 4000.00 feet; thence Easterly along the arc of said curve -1- through a central angle of 9° 03' 07" an arc distance of 631.94 feet to a point of reverse curvature; thence Easterly along the arc of a curve concave Northerly having a radius of 4000.00 feet through a central angle of 9° 06' 37" an arc distance of 636.02 feet to a tangent line and to the Northwest corner of Tract 3594 as shown on a map thereof recorded in Book 127 at pages 4 and 5 of Miscellaneous Maps of said Orange County. PARCEL 3: An easement for street purposes over the southerly 28 feet of Parcel 1 as described hereinabove, which said 28 feet was excepted in the last paragraph of the description of said Parcel 1 and which said 28 feet is the easterly extension of the northerly half of the land described in Parcel 2. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Ana to condemn said property neces- sary to be taken and to do all things necessary to prosecute said action to final determination; 2. That the City of Santa Ana is authorized and empowered to acquire, develop, maintain, and operate parks and streets within the City; 3. That said public improvements are planned and located in a manner which will be most compatible with the greatest public good and the least private injury; 4. That said action in condemnation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain. 5. That public interest, necessity, and convenience require, and it is hereby ordered, that said City take i~ediate possession and use of the property herein ordered to be acquired for street purposes, and described as Parcels 2 and 3, upon compliance with the requirements of law applicable thereto as right of way for public street. BE IT FURTHER RESOLVED: That Resolution 64-98 is hereby amended by deleting therefrom Parcel 4, which said land is herein authorized for acquisition as Parcel 1.
